1948-10-18VILLAGE OF MOUND 959 ~NUTES OF THE ASJOURNED REGULAR MEETING OF THE MOUND VILLAGE COUNCIL HELD OCTOBER ~T}{ , 1948. Present were Davis, Newcomb, ~¥inkel, and Alwin. Pierce being absent for cause. Present, also, were Attorney Wolner, and Engineer Arleigh Smith. In response to an advertisement f6r bids appearing in the Minnetonka Pilot of Oct. 7th, 1948, the council receive~and considered the bids of Fred Thomas, $1,085.00; and the bid of Co~ Bro~ $1,150.00. Thereupon it was moved by Newcomb and ..oondeAdby Winkel that the bids be referred to Engineer Arle~gh Smith for his recommendations. This was carried. The purpose of the meeting being to present a hearing on the assessment levy for Water Main Project No. 9, and, on call, there::being noons to present a complaint or to contest the levy, or any portion thereof, and after ~ue consideration, Winkel presented the following resolution and moved its adoption: BE IT RESOLVED by the Council of the Village.o~ Mound, Minnesota, as follows: WHEREAS, the Clerk, with the assistance of the Village Engineer, has calculated the amount proper an~ necessary to be specifically assessed for the improvement of water mains covered by that certain project in said village of Mound identified as Watermain PoJect No.9, against every assessable lot, piece, or parcel of land withih the said village affected thereby upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Section 452.1~ of Minnesota Statutes; an~, WHEREAS~ NOTICE. OF THE TIME AND PLACE WHEN AND WHERE THE Council of the V~llage of Moun& will pass upon said proposed assessment has been given by publication in the Ninnetonka Pilot on the 7th ~ay of Octol~er, 19~8,; and, WHEREAS, the sai~ propose~ assessment has at ali times since its filing on the 20th Day of September, 1948, been open to the public inspection, and an opport~nit]~ has been giver~.to ~all interested persons to review the same and to present their objections, if any, to such proposeA assessment; and, WHEREAS, ~he hearing on the proposed assessment has been..duly hel~ at the time and placd spedifie4 in the notice abo~ referre~ to and this resolution i~ submitted at the conclusion thereof, NOW THEREFORE, this Council after full and careful deliberation, finds that each of the. lots, pieces and parcels of lan~ enumerated in said proposed assessment was ,and is speoi~.t~l~nefltte~ by the construction of the watermain improvement covered by Watermain Project No. 9 in the Village of MounA in proportion to the ~mount in said proposed assessment set opposite the description of each such lot, piece or parcel of land respectively, an~ that said amount, so set out is hereby levie~ against each of the respective lots, pieces and parcels of land therein described; except that the amounts of partiqular assessments specified in the proposed assessment are changed and altered as follows: NONE. 960 VILLAGE OF MOUND BE IT FURTHER RESOLVED that such proposed assessment is hereby affirmed, adopted, confirmed, and ratified, and the sum~ fixed and named in said proposed assessment for ach of said lots, pieces or parcels of land therein described respectively; and such assessm®nts, to~ether with interest accruing on the face amounts thereof at the rate ~f sim percent per annum from the ~.ate hereof to June lst~ 1949, shall be a lien upon the ~property des- cribed therein and all thereof. The total amount of ~ach such assessment shall be payable in 15 equal annual installments extend- ing over a period of lO years, the first instalment ~to ~be payable on or before June l, 1949, and all deferred payments, after June l, 1949, shall bear interest at the rate of six percent per annum from June l, 1949, said interest to be payable annually with each instalment of principal. BE IT FURTHER RESOLVED THAT THE Villag~ ~le~k~.~ha~i~m~l.~tely after the adoption of this resolution transmit a certified dupli- cate of this resolution and of the proposed assessment to the County Auditor of the County of Hennepin and State of Ninnesota to be extended on the proper tax lists and to be collected, accounted for and paid over to said Village of Nound in the same manner as other village taxes. BE IT FURTHER RESOLVED that the owner of any lot, piece or parcel of land assessed hereby may at any time pay the whole of the assessment against said lot, piece or parcel of land or any instal- ment thereof with accrued interest to the 1st day of June follow- ing. ON~ Whereupon said resolution was declared duly passed an~ adopte~, and the President of the Village Council being present affixed his s~gnature thereto in approval thereof. The Clerk was directed to attach copy of the above to pertinent tax rolls and to send the whole to th~ Auditor's Office on the 19th Day of October, 1948. Acting on the recommendation of Engineer Arleigh Smith, i. e., to ~i~ action taken by the Mound village Council in the matter of bi~s in connection~ with th~ Chipman Ave. street improvement, it was moved b~ Newcomb that all action be rescinde~ ah~ that the council reconsider th~ bids as then presented. On the subject of the &rainage problem presente~ by Geo. 0hman of Lots 88 & 89, Nound A4dition, and the running of ~etermining levels, it was a~re~ by Engineer Smith to give a report covering the matter at the next regular meeting. On the request of Trustee Winkel, Smith also agreed to supply the village with a plat, or plats, showing the location of all hydrants an4 main valves, etc~, of projects 8 & 9. He'was also to report to the council, after conferring with Roelfs of the Alexander Construction Co., as to the progress of Project 10. In cgnnection with the corner lot adjustments and the consequent re-assessment of Project 8, an~ a report by Attorney Wolner cover- ing the legal requirements of the situation, an4 after an agreement within the council as to the manner of a~Justments in the Sub4ivision of Brookton, it was finally ~eci~e~ to go ahead on the basis' of~ the re-assessment, an~ a motion was made by Winkel, seconde4 by Alwin, that the. N~tice of a Hearing be publishe~ in the October ~lst, 19~8 issue of the Ninnetonka Pilot, setting the ~te for the hearing as 0c[ober ~Sth, 19~8, aame being for the presentation to the intereste~ public of the assessment levy covering Project 8.
