MINUTES OF THE REGULAR MEETING OF THE MOUND VILLAGE COUNCIL ADJOURNED,
BECAUSE OF THE NATIONAL ELECTION,, PROM NOVEUiBER 9nd TO NOVE~BER 5th, 1948.
Responding to roll, call were Mayor W. I. Davis, C~unci.lmen
Newcomb, Pierce, and Winkel, with Alwin Recording. Present, also,
were Attorney H. E. Wolner, and Engineer Arleigh Smith.
The minUtes of October 5th, 18th, and 28th ~eing approved as read,
the council proceeded with a hearing to Arthur Kane with reference
to a water main assessment~ against Lots i & ll, Blk. e, Auditor's
Subdivision No. 271, in connection with Water Main Project No. 8,
and in conclusion of which it was agree~ to adjust ~ane'- tax,
in the total principal amount, down to $441.46. Engineer Arl,igh
Smith likewise reporting a clearing-up of the difficulties within
the ~ubdivision of Brockton, Newcomb presented the following resolution
and moved its adoption:
..... WHEP~EAS. it. appears, from. the. files and records of the
village of Mound relative to Watermain Project No. 8 in said village
that through inadvertence or mistake the period of the assessment was
spread over a period of ten years contrary to the wishes of the major-
ity of persons affected by said assessment; and, '
WHEREAS the Vimtlage Council for the Village of Mound
desires to correct its error in not reflecting the wishes of the
majority of persons affected by the watermain assessment referred to
above, and to otherwise correct certain errors in assessment under
authority of ~ection A39.19 and ~39.~1 of Minnesota Statutes; and,
WHEREAS, the p~oposed re-assessment has been on file
with the Clerk of the Village of Mound sines pr&or to October 21, 19~8
and has been open to public inspection and due notice thereof has been
given the persons affected thereby; and,
WHEREAS, the hearing on the proposed reassessment
has been duly published in the Minnetonka Pilot on October 21, 1948,
setting forth the time and place when and where the Council of the
Village of Mound would pass upon said proposed re-assessment; and,
V~HEREAS, all persons affected by said proposed re-
assessment have been afforded an opportunity to review the said re-
assessment, and to present their objections, if any, to. such proposed
re-assessment, and to attend the hearing held pursuant to said notice
of such hearing; and,
WHEREAS, the hearing on the proposed re-Assessment
has been duly held at the time and place s~ecified in the notice here®$
inabove mentioned and this resolution is submitte~ at the conclusion
thereof;
NOW, THEREFORE, be it resolved: (~ that the County
Auditor of Hennepin County, Minnesota , suspend collection of the
special assessment heretofore levied for Watermain Project #8 in the
Village o~ Mound, and substitute therefor~ the assessment hereinabove

referred to, and hereinafter more particularly covered; (2) that this
Council of the Village 4f Nound after full and careful consideration
and deliberation finds that each of the lots, pieces and parcels of
land enumerated in said proposed re-assessment was and is specially
benefitte~ by the construction of the watermain improvement covered by
Watermain Project No. 8 in the Village of Mound in proportion to the
amount in said proposed re-assessment met opposite the description of
each such lot, piece or parcel of land respectively, and that said
amount so set out is hereby levied against each of the respective lots,
pieces and parcels of land therein described, except the the amounts
of particular assessments specified in the proposed assessment are
changed and altered as follows~
Lots #l and #ll, Block #9, Subdiv. 271, Owner'Arthur E. Kane,
formerly assessed in the total amount of $?29.94, changed to a
total amount of $441.46, for th~ two lots name~; as shown on
new assessment sheet attached to the re-~ssessment sheets for-
warded to the County Auditor's Office.
BE IT FURTHER RESOLVED, that sFch propose~ rea
assessment is hereby affirmed, adopted, confirmed and ratifie~, an4
the sums fixed and named in said proposed assessment or re-assessment
for each of maid lots, pieces or parcels of land therei~ described
respectively; and such re-assessment, together with interest accruing
on the face amount thereof at the rate of six per cent per annum
from the ~ate hereof to June lst~ 1949, shall be a lien upon the property
described therein and all thereof. The total amount of each such
assessment remaining to be paid shall be payable in fourteen equal
annual installments extending over a period of fourteen years, the
first of said instalments shall be payable on or before June 1st, 1949,
and all deferred payments after June l, 1949, shall bear .interest at
the rate of six per cent per annum from June l, 1949, said interest
~to be payable annUally w~th each instalment of principal.
BE IT FURTHER RESOLVED, that the Clerk of the
Village of Nound shall immediately after the adoption of this resolu-
tion transmit a certified duplicate of this resolution and of the
proposed re-Assessment to the County Auditor of the County of Henne-
pin and State of Ninaesota to be extended on the proper tax lists
and to be collected, accounted for ahd paid over to said Yillage of
Nou~d in %he same manner' as other village taxes.
BE IT FURTHER RESOLVED, that the'owner of any lot,
p~ece or parcel of land re-assessed hereby may at any time pay the
whole of the assessment against said lot, piece or parcel of lan~ or
any inatalment thereof with accrued interest to the 1st of June
following.
Adopte~ by the Village Council of the Village of
Nound, in the County of Hennepin and State ~f Ninnesota, this 5th
Day of November,. 1948.

The foregoing resolution was introduced by Trustee
Newcomb after full consideration by the Village Council of the Village
of Nound, and motion was duly made for its adoption. Trustee Alwin
duly seconded the motion, and Spon vote thereon the following voted in
favor thereof: Davis, Newcomb, Alwin, Pierce, Winkel,
And the following voted against the same: None.
Whereupon said resolution was ~eclared duly passed and adopted, and the
President of the Village Council being present affixed his signature
thereto in approval thereof.
With refeSence~to the work stoppage on Chipman Ave. by Al. Gooder
because of work on the Water Street spur&in order to reach an agree-
ment as to the cost against frontage for this extra and un~.nticipated
development, it was explained by Attorney Wolner and generally
understood by the council, that this development over village-owned
territory required no special hearing and would proceed cost-free
to abutting frontage. ~This satisfied all concerned.
By general agreement of the council and without motion, the council
approved the recommendation of I~ayor Davis to install water and
toilets in the village office, and the clerk was instructed to
communicate the fact of this improvement to the MinnesoAa Industrial
Commission.
The council received reports with reference to the drainage pro-
blem of the ~eo. 0hman property and its relation to culvert levels
on Elm Street, and the drainage problem along Willow Street at
Seton as it affects the driveway and garage of Nfs. Heleine Beane
All of this was in the hands of Engineer Arleigh Smith for a
solution. The counil also r~ceived reports on bri~gin~¢the rail-
road track to grade at its intersection with Central Ave., on
progress with reference .to police officer Schwartz's Uniform, on
snowfencing to shelter the school football field, and on th~ out-
of-zone activities of Andy Farness. All of these matters were in
the hands of those empowered and qualified to care for them..
Following a report by attorney Wolner with reference to the deeds
establishdng the right-of-way for Chipman Ave., and those that were still
needed, it was moved by Newcomb to authorize the President and the
Clerk to execute Quit-claim deeds to E. B. Hoff an~ to Alice B. Hoff
"on I~ots ~, Z4, ~dd ~5, except the southeast 25 ft. thereof, in Blk. 2
Lakeside Park, A. L. Crocker~s 1st Division, Noun~, Ninnesota, and
excepting and reserving unto the grantor an easement for the main-
tenance, repair, and reconstruction of 'waterm~ain, and exc. epting
conveyance for Lot ~2 in the same block.,, ?his was secgnded~by
Winkel and carried.
Excepting the Health service bill of Dr. J. P. Wilkins, which was
made ~ontingent upon a proper itemization, the council authorized
payment on'the following bills:
