1949-07-051011 VILLAGE OF MOUND ~INUTES OF THE REGULAR MEETING OF THE MOUND VILLAGE COUNCIL. HELD July 5th, lg49. Present at this meetin& were Mayor Davis, Councilmen Winkel, Pierce, and White, with Alwin as Recorder. The minutes of June ?th were read and approved with the following insertion and correction: "After a discussion on the proposed rate increase in the. electric service charges in the village of.Nounal, it was moved by Winkel and seconded by White that Ordinance No. 160 be adopted, which ordinance reads as follows:#(See Page 1504 of Minute Book.) The Minutes of the Board of Review Meeting of June 10th were revised to r~ad as follows: mRoy Haeg, Supervisor of Assessors, was present. No property owners appeared at that date to offer any complaint. It was the ruling ~f the Board that the meeting was to be resumed upon the completion of the assessment by the Assessor. This decision made, the ~eeting adjourned." The Minutes of June 13th and of June 2?th were approved as read. Upon the presenta$ion of the proper applications and their com- mensurate fees, it was moved by Winkel, supported by White, that the following licenses be '~9~r~w~d and awarded: Darrell David Cafe: 3.~% Beer, Sff and 9ri, and Soft Drink. American Legion: Hard Liquor and On Sale 6% Beer. Robert Neises: Off and On Sale 3.2% Beer. Henry Neises: 3.~% Beer, Off Sale only. Peter $ollie: On and Off Sale ~.~% Beer and Soft Drink. A. Lake Water Pollution Ree&lution presented ~or council action was referred to the village attorney for study. The request of Mrs. Lulu Rhode for an adjustment of her two- frontage watermain assessment wm~ereferred to the Water Committee for attention In a discussion of the new law, Chap. 119, delegating powers to the Village Council in the matter of initiating local improvements, it was revealed that the council may initiate action for local improvements in connectio$ with Roads, Sewers, Steam Heat, Side Walks, Tree Trimming, etc., etc. Such to be started by petition bearing ~e!mam~s of at least 3§% of the affected owners and the majority of the council's approval. Or, if it is to be started without a petition, then it must have the approval of at least a 4/§ vote of the council. These conditions met, the rest is to be governed by the following procedure: A. Ordering of a Hearing. The Setting of the time, place, and the declaration of the nature of. the improvemeHt and the benefited properties to be assessed. B. The adoption of a Resolution Authorizing the work, Either by majority, or a 4/§ vote of the council The improvement ordered; the publication for Bids. The letting of contracts The levying of assessments and the holding of hearings on assessments. Such assessments to be based on benefits, and n6t necessarily on abuttments (In regard to Great Northern Railroad property, the council can proceed and make assessment.) With reference to the extension of the village watermains from the intersection of the Legion Hall alley to forty feet beyond the Fire Barn, Gene White moved the resolution covering the above of June 10th be r$inded and that in lieu thereof the following resolution be a~opted, to wit: Pursuant to Chap. ll9 of the Law of ~innesota, 1949, Article 4, covering a hearing relative to an improvement in the Village of Nound with reference to the laying of a water main, with appurtenances, for the purpose of supplying water to businesses and to residences along Park Avenue, running from the intersection of said street with the alleyway between the Legion Hall and the Office of the Ninnetonka Pilot, extending Eastwardly beyond the Village Fire Barn; that said hearing be held en the ~2nd Day of July, P. N. in the office of the Council of the Village of Nound~ Nound, Ninnesota, and that due and proper notice of such hearing be printed in the Ninnetonka Pilot, in the issues of July ?th and 14th of the current month. The motlon~being for the adoption~of the above resolution, and Winkel seconding, the vote of the council stood unanimous. Yielding to.~.the request of Custodian Arthur Holmquist of Nound Union Cemetary, Winkel presented the following Resolution and moved its adopt&on, t e. wit: RESOLVED, That the presently unplatted East Portion of Nound Union Cemetery be properly surveyed and platted in Lots 9X10, and containing ~ graves each, such lots to be Numbered from 81 to §00. Pierce seconding the motion for adoption, the vote of the council stood unanimous. The Treasurer's Report with reference to paying the Arleigh Smith bill for engineering services in connection with Watermain Project No. 8 being incomplete because of information missing with the Village Nlnutes of the Years 194~ through 1947, it was moved by White that the Clerk be authorized Ao insert an ad in the columns of the Ninnetonka Pilot requesting the return of these Ninutes to the Village Office. This was supported by P~erce, the council carrying. After an open discussion covering the matter b~ the council, governmental changes made legal in Chap. ll9, Nlnnesota Statues,~9~9, the following plans were submitted to committee for further study.
