1949-07-22'~ VILLAGE OF NIOUND 1016 · MINUTE~ OF THE ADJOURNED MEETING OF THE MOUND VILLAGE COUNCIL HE4D July 22nd, 1949. Present at this meeting were Mayor Davis, councilmen Winkel, Pierce, and White, and village Attorney Herbert E. Wolner. Alwin was ~ absent on vacation. The pUrPose of the meeting was to present a hearin~ with respect to t~e extension of village watermains from their present location on Park Ave. down Park Ave., East, to a point forty feet beyond the Fire Barn. Prior to the Watermain Hearing, however, the council gave ear to the complaint of Mr. Kane of Lots I & ll, Blk. 9, Mound Terrace, with reference to the village's enc~roachment upon his property with it' s watermain and street. Kane was agreed to give the village an easement for damages, which he stated would come to about $150.00. The council was a~reed to take the matter under advise- ment and report to Kane later. As to the Hearin~ with reference to the Watermain Extension: After hearing all arguments, both for and against, as presente& by affected frontage, including the village, Councilman Pierce presented the following resolution and moved its adoption: to wit: WH~REA~, the Village of Mound, pursuant to the provi~ions of Chapter 119, Laws of Minnesota, 1949, duly ordered, a. Hear.in~' to be. h~d on July ~2nd, 1949, at 8 o'clock P. M. in the Village 0ffioes in. said ~ village for the purpose of de~ermining whether or not to order an ~ improvement in said village, the general nature of which is to lay watermain and appurtenances along Park Avenue in said village from the Legion Hall to a point forty (40) feet East of the Firebarn in ~ said Village; and, WHER~A~ a proper notice of said meeting was duly published in the Minnetonka Pilot in the Village of Mound advising all persons interested or affected ~Y such improvement that they would be heard at the time and place of said hearing; and, WHEREAS the said meeting was duly held relative to said proposed Public Improvement, and the Council of the Village of Mound having heard all parties interested in or affected by said proposed improvement whomattended the said meeting and having fully considered the advisability and desirability of said improvement; NOW, THEREFORE, Be it Resolved: That an improvement be made in the Village of Mound, the genderal nature of which is to lay watermain and appurtenances along Park Avenue in said Village from the Legion Hall to a point forty (AC) t~ feet East of the firebarn in said Village, and thereby extend the'presen water system to serve property abutting on said street in the are~ of the improvement; and that the cost of the same be assessed according to law upon property benefited by the improvement based upon the benefits received; That the Village Engineer shall immediately make plans and speci- fications of said improvement and file the same with the Village Clerk, together with an estimate of the cost of said improvement; ., and, ~A VILLAGE OF MOUND 1017. That, upon receipt of said Plans and Specifications, the Village Clerk shall cause te be published in the Minnetonka Pilot for one week a pu~llo advertisement prepared by the Village Attorney according to the provisions of Section §~of Chapter llg, Laws of Minnesota, 1949, calling for sealed bids for said improvement. White seconding the motion for the adoption of the above resolution, the vote of the council stood as follows: Yeas, Winkel, White, Pierce, and Davis. Nays, NOne, And so the Resolution stood adopted. After discussion, it was generally agreed that the above work should be put out on bids. _ In' line with the above improvement, it was moved by White that the Village advertise for bids, same to be published in the Minnetonka Pilot, issues of July 2@th and August 4th, and to cover the installation of plumbing, toilets, lavatory, and sewage dlsposal~for~the Municipal Bldg., such bids to be sealed and accompanied by a certified cheek in the .amount of 5% of the bid, and to75pened and read out loud at - an~ AdjoUrned Meeting of the Council held on August 16th, 1949, 8. ][. M. ~ierce secgnding the motion, it was carried by the council. Railroad Co., through its representatives, wanted The Great Northern the records to show that they were entering a verbal protest to the Park Avenue Watermain Project. ' After a further discussion of a car for the police and the need of closer supervision of law enforcement at the' village Park with reference to the sale of beer etc. and the bearing of these pre- blems on the matter of police vacations, it was finally moved by White that, in the ease of our local police, they be allowed to take their vacations two weeks at one time, each officer, however, to cover the other during his absence and be subject to call 24 hours of the day. This was seconded by Pierce, the council carrying. Thio business ~ene, the meeting ad~eurned.
