MINUTES OF THE REGULAR NEETING OF THE NOUND VILLAGE COUNCIL HEED

Responding to roll, all were Pierce, Winkel, White, andAlwin;
Pierce serving as chairman in t~e absenceof Mayor Davis.
Mr. Prank Kelly of the law firm Wolner & Kelly served in the
place of H. E. Wolner as village attorney.
The meeting proceeded with the reading of the MXNUTE~of the meet lng
of July 5th, 1949, which were approved subject to the following
corrections: The Pete SollleBeer License was to be for "Off Sale only"
and the size of ~Nes for the New Section of Mound Union Cemetery
was to be 9xl?. The Minutes of the Meeting of July 18th were
corrected to read that the Rosenwald-Cooper Grader bid, although
the ~owest of the bids, was turned down because it did mot comply
with specificztions, namely, did not come up to horse-power and
offered dual instead of tandem drive. The Minutes of July 22nd
were approved as read, and the whole, with coDrections, accepted
upon the motion of Wlnkel, White supporting. The above corrections
also included a change of wording in the Minutes of July 22nd,
showing that the SJ.§O,in connection with the Park Ave. watermain
installation, was not ~o be understood as the possible basis of
an assessment, but was only given as an e~imate. The Minutes of
July~nd were also bo show council agreement authorizing the village
attorney to prepare papers for the signatures of owners of affected
frontage and establishing written consent in connection with the
Park Ave. Watermain Improvement.
Frank Groschen appearingbefore the council in connection with his
status as Deputy Village Policeman, it was the agreement ~f the council
that Groschen be recognized as a Mound ~eputy Policeman and that he
be held subject to call at any time of need.
At the~request of FireChief Lloyd Bowers, the council was agreed
t° fin~temporary shelter elsewhere for the fire trUcks pending the
Park Ave. improvements. . .
At the request of Taxi Cab Operator D. D. Bryce, and by geaeral
agreement, the ~ouncil allowed a rate increase of 55 on fares-less
than $1.00, the basic rate being J§~ for the first.mile. The council
made it clear that these increased rates were te be properly posted
in the Taxi Cabs, and also in the local newspapers. ~.
On a motion by White, Winkel supporting, the.council officially~
designated Au~ust. 2Oth, 19~9, as the day for the meeting of the
Equilization Board, hours t o be from 9 A. M. to'12 Noon and from
X P. M. to § P. M. The Clerk was authorized to publish the fact
in the .Minnetonka Pilot, issues of Aug. llth & 18th, 19~9.
In connection with the Park Ave. Watermain Extension, it was moved
by White that the council declare.an emergency in the matter of
this installation because of the time factor and the prohibitive
character of a later installation. This was seconded by Alwin,
the council carrying.
Following a discussion of the difficulties in connection with Dell
Street, it Was moved by White that the Village advertise for ~ids
on the excavation of the frost-boil area on Dell Str., over the
distance from its intersection with Sentral Ave., East. to its
intersection with Harrison Avenue, and the s~pplying of a necessary

fill over the same distance, all of this to conform to specifications
to be supplied by Toltz, King & Day, such advertisements to appear
after the completion of all detail. This was seconded by Winkel
and :c&rried.
It was mo~ed by Winkel, and seconded by White that the balance due
on the bill owing the Alexander Construction Co. on Project No. l0
be approved for payment, subject to completion of backfill and
Mr. Winkelts inspection and approval. This was carried.
In connedtion with the purchase of a Village Police Car, bt was moved
by ~hite, and seconded by Winkel, that the village advertise for
bids on a Black Two-Door Sedan, suitable for police .work, equipt
with a heavy-duty generator, a Heater, supplied with either a 90
or a ll5 H. P. Notor, and otherwise furnished with all standard
equipment, such advertisement to appear in the Ninnetonka Pilot of
August 4th & llth, 1949; bids ~to be opened and read out loud for
consideration at a council meetin~ dated for August 16th, 1949,
at 8. P. M. This was carried.
Following a report of Attorney Frank Kelly on v~ll&~?precedure
in the Park Ave Watermain Extension, and the Attorney General's
Opinion covering the matter, it was moved by White that the preceding
motion declaring the laying of the Park Ave. watermain extension as
an action compelled by an emergency be withdrawn from the records
and that all action in the matter be held in abeyance pending further
developments. Winkel seconded this motion, the council carrying.
In connection with the sale of village bonds, Councilman Winkel
presented the following resolution and moved its 9doption:
WHEREAS, the Village of Mound is a duly organized and existing
municipal corporation in the County of Hennepin and ~State of
Ninnesota and
WHEREAS, the Village of Mound is the owner and holder of the follow-
ing United States Securities. ~a~ely: Bond Nos. 69819 K $1,000.00;

WHEREAS, the council of the Village of Mound, being the governing
body of said municipality, deems bt to the best interest of the
community to sell said securities and employ the proceeds in the
conduct of municipal affairs; Now, therefore, be it
RESOLVED, that Louise Huestis, as Treasurer of the Village of
Mound in the County of Hennepin and State of Minnesota, be and she is
hereby authorized and empowered to sell and assign or to request
payment of reDssue of the bonds listed above and as registered in
the Books ~f the United States Treasury Department, and registered
securities with respect to which %he Treasury Department acts as the
transfer agent, in the name of, or assigned to the Village of Mound,
Minnesota.
Alwin secondinE the motion.for adoption, the vote of the council

On a motion by Winkel, White supporting, the Clerk was authorized to
notif$ the County Audi$orte cancel all village special assessments
for water main improvements dated Prier to Jan. let, ~948
With reference to the Hennepin Co. Relief Proposal as presented t&
the council for approval, it was the general agreement of the council
that the Clerk be authorized to notify County Commissioner Jens
Christianson and others that the council was opposed to any change
in the administration of relief in the County as it affect~ the village
