1953-01-05VILLAGE OF MOUND MINUTES OF REGULAR MEETING, January 5, 1953 1381 Meeting calied to order in the Village Office at 8:00 p.~. Present were Acting Mayor Behmler, Trustees Livingston and Wenk- stern, and Manager Leikvold. Trustee Pierce and Mayor Davis were out of town. · Mr. Wenkstern was administered the Oath of Office as a Trustee and thereafter participated in the meeting. The minutes of the Regular meeting, December 1, 1952 and Adjourned meeting, December 15, 1952 and Adjourned meeting, December 17, 1952,. were read and on motion by Livingston, second by Wenkstern, were 'unanimously approved as read. The council received and.with a motion by Livingston and second by Wenksterm approved the following election returns: There were 422 votes cast in the December 1, 1952 Village Election. All agreed. Mr. Wenkstern wondered about yearly rates to companies using the Dump regularly. The Manager said he thought it could be worked out. Fund be delayed until such time as there are sufficient funds in Project #1~ to make this transfer. Wenk- stern seconded, and it was passed unanimously. On Resolution by Wenkstern, second by Livingston and unani- mous vote, the Minnetonka Pilot was designated as the official newspaper for the year 1953. On Resolution by Livingston, second by Wenkstern and unani- mous vote, the State Bank of Mound was designated the official bank for the Village of Mound for the period of one year, 1953, provided that that institution deposits ~9~,000 (~20,000 in Village Bonds and ~7~,000 in U.S. Treasury Bonds as stated in the Collateral Agreement) in the 1st National Bank of Minneapolis. On Resolution bT Wenkstern, second by Livingston, and unani- mous vote, the Treasurer together with any one of the Trustees sho~ld have access to the Safety Deposit Box located in the vault of the State Bank of Mound. On Resolution bT Wenkstern, second by Livingston and unani- mous vote, all checks or drafts drawn on Village funds shall be signed by the Mayor, the Village Manager and the Treasurer. In the absence of the Ma~or they shall be signed b.v the Acting Mayor. ' ' Mayor Davis, letter of resignation was read, but no action was taken by the Council. On Resolution by Livingston, second by Wenkstern and unani- mous vote, the Treasurer,s Bon~ is to be renewed for ~1~,000. It is the opinion of the Council that the bond is in effect until the Treasurer,s reports are turned in, but their advised the Manager to look into this verT~ soon. ~cting Mayor Be~hmler relinquishe~ the chair to Trustee Wenkstern at this point. Trustee Behmler offer the following resolution and moved its adoption: ~'fH~REAS the ~Jillage of Mound owns the absolute fee to the property, herein described, without limitation or restrictions as to its alienation, and I~IHEREAS the Village Council of the Village of Mound has determined that said property is no longer needed for municipal purposes or uses, and ~ WH~JREAS Mound Metalcraft has offered to grant to the Village of Mound an easement for road purposes across the south 26 feet of Lots 2,3,~ and ~ of Koehler,s Addition to Mound to become effective upon the construction of any c~mmercial build- ing upon any portion of said lots, and further to execute appro- priate instruments to restrict the construction of anv building upon the property covered by such easement, and that said ease- ment can be used b? the Village of Mound for a p~blic use, at no 13 4 cost to the Village, UOW TH2REFORE be it resolved that the Village Council of the Village of Mound, based upon the above findings, does here- by authorize the Mswor of the Village of Mound and the Mound Village Manager to execute on behalf of the Village of ~ound, a ~uit claim deed covering the follow~ng described property owned by the Village of Mound: "Thst part of the Southwest Quartsr of the So.~th west 0~uarter of Section 13, Townshi~ 117, Range 24, described as follows: Begin~ing at a point on the ¥~esterlv line of Linden Street as opened by the Village of Mound, which point is one foot north of the North line of Lot One (1) ~n Koehler's ~ddition to Mound; thence Northerly along the Westerly line of Linden Street 72 f~et, more or less, to a point which is Ninetw- two (92) feet So~th of the North line of the Southwest 0~uarter of said Section 13; thence West, parallel with the North line of the Southwest ~uarter of the So',~thwest Quarter of Section 13 a distance of ~ feet; thence South- westerl~ 74.4 fee~, more or le~s, to a point which is one foot North of the North line of said Lot One (t) of Koehler's ~ddition to Mound and is 21~.9 feet ~ast of the West line of said Section 13; thence East 21.4 feet~ more or less, to the point of begin~ing." and deliver the same to the Mound Metalcraft upon said Mound Metalcraft delivering to the Village of Mound a properl? ex- ecuted agreement to grant an easement for road ~ur~oses over and across the south 26 f~et of Lots 2,3,4 and ~ of Koehler's Addition to Moun~ to beco~e effective upon the construction of any commercial building upon any ~ortio~ of said lots, and further to include in said agreement restrictions upon con- struction of any building upon said so~th 26 feet. The question was on the adoption of the resolution, and the roll being called, there were Two Yeas and No Nays, as follows: ~ehmler -- Yea Livingston-- Yea Wenkstern -- Not voting. Resolution adopt~d this ~th day of January, 1993. Trustee Behmler offered the following resolution:and moved its adoption: ~!£REAS the petition for vacation of a portion of Linden Street as hereinafter ~escribe~, came on for hearing by the Village Council of the Village of Moun~, on this l~th day of Decemb~r, 19~2, at 8:00 ?.M., continued to December 17, 19~2 at 8:00 ~ ~'~ pursuant to the resolution and notice hereinafter referred to; and the Village Council of the Village of Mound, ~aving considered said petit .on and after having heard al! parties interested as to the necessit~ for, and as to t~e amount VILLAGE OF MOUND 1385 of damages to the land owners by reason of such vacation of that portion of said road as proposed and described in said petition: BE IT RESOLVED that t!~:is Council finds and makes the following findings, determination and order: 1. That tb.e petition for the vacation of that portion of Linden Street located in the Village of Mound, as hereinafter described, was signed by 100~o of the owners of land abutting on said street to be vacated; and was on the 1st day of Decem- ber 1952 laid before the Council of the Village of Mound; and that thereupon this Council adopted its resolution fixing and designating time and place for hearing on said petition and instr'~cting Village Manager of Mound, Carsten D. Leikvold, to prepare and insert a legal notice of said hearing to be pub- lished in the Minnetonka Pilot, a legal newspaper, on December 4, 1952 and December 11, 1952 and to farther post a notice of said heaping. 2. That this Council has caused two weeks published notice of hearing and posted notice of the time and place of said hearing, and that proof of such published notice and posting thereof has been made to the satisfaction of this ~ouncil, which notice and proof of publication and posting are on file in the office of the Village Manager in the Village of Mound. 3. That at the time and place designated in said notice this Coancil did meet and hold a hearing thereon, and con- tinued said hearing to December 17th at 8:00 P.M., and that after said hearing this Council did determine that it appeared to the best interest of the p'~blic to vacate the property de~ scribed in said petition. 4. That the names of the owners, the description of their land, the amount of gross damages, benefits and net damages, resulting by reason of the vacation of said portion of said road are as follow~, to wit: Names of Owners L.E. Koehler - Hortense Koehler Lot 2, Koehler, s Addition to Mo und Gross Damages: NONE Benefits: NONE Net Damages: NONE As conclusions from the foregoing findings, it is hereby determined that the vacation of that portion of said road 1388 oF Mouno hereinaft~¢r described, is desirable and in the best interest of the public; and IT IS HEREBY D!~CLARED &ND ORDERED that said petition be granted that that portion of Linden Street, in the Village of Mound, Hennepin bounty, Minnesota, described as follows: :~11 of Linden Street lying between a line twenty- six (26) feet North of the North line of Dell Street, as platted in Koehler Addition to Mop, nd, to the North line of the Southwest Quarter of the Southwest ~uarter of Section 13, Township 117, Range 24, a distance of 164 feet more or less. be and the same is hereby vacated as a village road. Livingston moved that we accept his resigna- tion. Wenkstern seconded, and it was unanimoms!¥ carried.
