MINUTES OF REGULAR MEETING, MAY 11, 1953
Meeting called to order in Room 4-A of Mound High School at
8:00 P.M. Present were Mayor Behmler, Trustees, Pierce, Livingston,
Wenkstern and Litts, Manager Leikvold and Attorney Bonham.
The minutes of the regular meeting, April 13, were read, and
on motion by Pierce, seconded by Litts, were approved as read.
The minutes of the adjourned meeting of April 27 were read,
and on motion by Livingston, seconded by Wenkstern, were approved
as read.
Pierce moved, Livingston seconded, and it was passed unanimously
to pay the following bills where funds are available:

Wenkstern moved a transfer of ~116.77 be made from the
General Fund to Project #7 to cover the deficiency in that fund
and enable the Village to make the pa~ment of $175.00 due June 1,
1953. Livingston seconded, and it was carried unanimously.
Pierce moved, Wenkstern seconded, and it was passed
unanimously to approve the following building permits:

Litts offered the following resolution:
WHEREAS an application to build a Live Bait Shop on Lot 36
of Auditors Subdivision #170 has been submitted by Russell Breyette
and under Village Ordinance #46 it is necessary to have a special
permit for the operation of a live bait shop in the Village of Mound,
now therefore
BE IT RESOLVED that oursuant to Subdivision 4 of Section
of Section II of Ordinance ~o. 46 that the Village Manager be dir-
ected to insert in the Minnetonka Pilot a notice of public hearing
to be held on the 25th day of May, 1953 at 8:00 'P.M.
The resolution was passed unanimously. ..~.~\
In response to the advertisment for bids for
Flushing Unit, the Manager reported only one bid as follows:
Rosholt Equipment Company ....... $1,890.00.
Wenkstern moved, Litts seconded, that this piece of equip-
ment be purchased. The roll call of votes was as follows:

So the ~otion was carried 3 to 2.
The School Bosrd of District #85, several members of the
Mount Olive Lutheran Church and other interested oroperty owners
in the vicinity of the intersection of Highway #7 and #125 were
heard relative to s drainage problem at this point.
The School Board reported they had a two-fold problem in
the drainage of surface water and also sewage disposal, which they
hoped could be solved by a storm sewer being built down Highway
#125 to carry this water across #7 into Emerald Lake. They felt
this was a (1) Hennepin County, (2) School District #85, (3) Mt.

Olive Lutheran Church and (4) Village of Mound Pesponsibility.
The urface water has been problem since County R0sd #7 was
built, but the b~ilding of the school has aggravated the situ-
ation as has also the building of Highway #125 and the building
of the church. The School Board has received an offer from the
Hennepin County Engineer to supply the material, which they figured
would be half the cost, leaving a balance of $2,500 to be carried
either by the School, the Village or the Church.
Being this involves a county highway, it was decided to refer
it to the Village Attorney for further study.
The following ordinance was read:
AN ORDINANCE REGULATING THE TRANSPORTATION OF PERSONS
BY BOAT FOR HIRE AND THEIR USE IN TOWING PERSONS
ON DEVICES WHERE COMPENSATION IS ASKED OR RE-
CEIVED AND REQUIRING A LICENSE THEREFORE
THE VILLAGE COUNCIL OF MOUND DOES ORDAIN AS FOLLOWS:
Section 1. The term "motor boat" as used in this ordinance
shall incl~ude any water craft of any type whatsoever and propelled
by motor; "passenger" as 'used in this ordinance shall mean any
human being; ?hire" as used in this ordinance shall mean the ask-
ing or receiving of compensation in the form of money, goods, or
thing of value; "transportation" as 'used in this ordinance shall
mean the moving of any human being from one place within the limits
of the Village of Mound or from the shore line of Lake Minnetonka
within the Village of Mound to another place either within or with-
out the village limits of Mound or offering to do so; "person" as
· used in this ordinance shall mean a person, firm or corporation.
Section 2. No person shall engage in the business of trans-
porting persons for hire by ~otor boat within the limits of the
Village of Mound or upon the shore line of Lake Minnetonka within
the Village of Mound or from the shore line of Lake Minnetonka
within the Village of Mound without first having received a li-
cense therefor as hereinafter provided.
Section 3. No person shall engage in the business of oper-
ating or shall operate any motor boat within the limits of the
Village of Mound upon or from the shore line of Lake Minnetonka
within the village which said motor boat shall tow or pull any
person or persons upon water skis, surf boards or other device
in cases where such motor boat is operated for hire or where com-
pensation in the form of money, goods, or thing of value is asked
or received from the person so towed or pulled either for the act
of so towing or pulling or for instructions or lessons in the
riding, handling or operating of such motor skis, surf boards or
other devices without having first received a license therefor as
hereinafter provided.
Section 4. Application for such license shall be made to the
village clerk in such form as shall be approved by the village
council. Such application shall give such information as to the
licensee and the proposed business as the council may desire.

Section ~. The said application shall be presented to the
village council and the license shall be granted if the council
deems Such person a responsible party and does not believe that
the granting of such license shall be detrimental to the public
welfare or constitute a nuisance.
Section 6. Licenses granted hereunder shall be for the
term of one year, provided that all such licenses shall expire
on the 1st day of April in each year.
Section 7. any license granted hereunder is subject to the
condition that all boats shall operate in a quiet and orderly
manner and subject to the rules as to hours of operation and
general regulations established by the council by resolution
from time to time.
Section 8. Every application for a license hereunder shall
be accompanied by fees as follows:
For the first boat ........... ~1~.00
For each additional boat ..... 10.00
Upon the granting of any license hereunder, said fees shall
be transmitted by the clerk to the village treasurer and credited
to the General fund. If the license is denied, the fee shall be
retarned to the applicant.
Section 9. Any person violating the terms of this ordinance
shall be guilty of a misdemeanor and shall upon conviction there-
of be published by a fine of not more than $100.00 or by imprison-
ment for not to exceed 90 days.
S,sction 10. This ordinance shall be in full force and effect
from and after its publication according to law.
Wenkstern moved the adoption of the ordinance, Litts seconded,
and the roll being called the vote was as follows:

And so the ordinance was passed.
A petition was presented to the Council asking for a water
main for the Wilbur K. Palm Addition. The Council was concerned
that there would be delinquent payments and took no action.

The Council followed the recommendation of the Park Board and
agreed to let the Upper Tonka CoU. ncil have the Pavilion Concession

this summer. It was also the consenus of opinion that the Village
furnish a lifeguard. Although no vote was taken, it was the feel-
ing of the Council that the amount spent on a lifeguard should not
exceed $~00.
The dog situation was discussed, but no action was taken.
On motion duly made, seconded, and carried, the meeting was
adjourned at 12 o'clock to reconvene Msy ~Sth at 8:00 P.M.
