MINUTES OF ADJOURNED REGULAR MEETING, May 24, 1954'
Meeting called to order at 8:00 P.M. at the Village Office.
Present were Mayor Behmler, Trustees Wenkstern, Pierce, Livingston
and Litts, Attorney Bonham and Manager Leikvold
Bids were opened on the sale of the Pavilion.
The following bids were received:

Both bids had conditions attached. Livingston moved, Pierce
seconded that all bids be rejected. The motion was carried; Wenkstern
not voting. BUILDING ORDINANCE
The proposed building ordinance was discussed. Some changes /.~

Meeting was called to order in the Park Pavilion at 8:00 P.M.
Present were Mayor Behmler, Trustees Livingston, Litts, Pierce,
Wenkstern, Attorney Bonham and Manager Leikvold.
Minutes of the regular meeting of May 10 were read, and on
motion by Pierce, seconded by Livingston, it was unanimously carried
that they be adopted as read.
Minutes of the adjourned regular meeting of May 24 were read,
and on motion by Litts, seconded by Wenkstern, it was unanimously
carried that they be adopted as read.

POPCORN WAGON PERMISSION
.Pierce moved that Homer Rivard be granted permission to operate
a popcorn wagon in the Village of Mound. Livingston seconded, and
the motion was passed unanimously. This permit is to run through the
summer of 1954. BUILDING ORDINANCE
Litts moved relative to Section 6 of the proposed building
ordinance that the fee be $4.50 for permits for building in the
amount of $1.00 to $1,000.00, and that each additional thousand
should be charged $1.50 per thousand. Livingston seconded, and

ORDINANCE NO. 55
An ordinance Regulating the Erection, Construction, Enlarge-
ment, Alteration, Repair~ Moving, Removal, Demolition, Conversion,
Occupancy, Eqqipment, Use, Height, Area and Maintenance of Ail
Buildings and/or structures in the Village of Mound, Hennepin
County, Minnesota; providing for the Issuance of Permits and
Collection of Fees Therefor: Providing PenalZies for the Violation
Thereof and Repealing Ordinances No. 45, and Ail Other Ordinances
and Part of Ordinances and Resolutions of Said Village in Conflict
Therewith, Saving and Excepting ordinance No. 46.
The Village Council of the Village of Mound do ordain as
follows:
Section 1. That a certain document, three copies of which are
on file in the Village Office of Mound, Hennepin County, Minnesota,

being marked and designated as "Uniform Building Code 1952 Edition
Published by Pacific Coast Building Officials Conference" except-
ing, however, the following: Section 204, the second paragraph of
Section 205, Section 302 (d) Table No. 3-A, Section 303 (a) and the
exception provided in Section 305 (a), be and the sam~ together
with the regulations, provisions, terms and conditions set forth
in Sections 2 to 12, both inclusive hereof is hereby adopted as
a building code of said Village of Mound for regulating the erection,
construction, enlargement, alteration, repair, moving, removal,
demolition, conversion, occupancy, equipment, use, height, area
and maintenance of all building and/or structures in said Village
of Mo'und; providing for the issuance of permits and collection of
fees therefor; providing penalties for violation of such code, and
each and all of such "Uniform Building Code" above described on
file in the Village Office are hereby referred to, adopted and re?de
a part hereof as if fully set forth in this ordinance. Wherever
the word "city" occurs in said Code, the same shall mean "Village
of Mo and."
Section 2. That in addition to the regulations, provisions,
conditions and terms set forth in said "Uniform Building Code"
and supplementarv thereto, the following regulations, provisions,
conditions and terms shall be a part of the building code of this
village, all as follows, to-wit:
(1) All applications for building permits shall be accompanied
by a plat drawn to scale, showing the location and actual dimen-
sions of the lot to be built upon, the size and location of the
existing building and buildings to be erected, the proximity of
other buildings on the same property and on adjacent property and
such other information as may be necessary to provide for the en-
forcement of such ap~lication, ~hich plat shall be kept in the
Village Office. The Building Inspector may, at his discretion,
require that said plat be certified by a competent survevor Or
civil engineer. .
Section 3. That 'upon the completion of any building, the same
shall not be occupied and used until the provisions of this ordin-
ance have been complied with. and the said Building Inspector shall
have issued a Certificate of Occupancy therefor except that a tem-
porary certificate may be issued for a period of not exceeding six
months during construction.
Section 4. In order to determine the suitability of alter-
nate materials and types of construction and to provide for rea-
sonable interpretations of the provisions of this Code, the mem-
bers of the Board of Zoning Appeals created by Section ll (2) of
Ordinance No. 46, as amended, shall constitute a Board of Appeals.
The Building Official shall be an ex-officio member and shall act
as Secretary to the Board. The Board shall adopt reasonable
rules and regulations for conducting its investigations and
shall render all decisions and findings in writing to the appellant
and may recommend to the Village Council such ammendment to this

ordinance as is consistent therewith.
Section ~. Every permit issued by the Building official 'under
the provisions of this code shall expire bv limitation and become
null and void, if the building or work authorized by such permit
is not commenced within 60 days from the date of such permit, or
if the building or work authorized by such permit is suspended or
abandoned at any time after the work is com~enced, for a period of
60 days. Provided, however, that in either case, an extension of
time, not exceeding 30 days, may be obtained upon application in
writing therefor to the Building official. Such application shall
state the reasons for such extension and shall be made to the
Building Official prior to the expiration of the period hereinbefore
provided in this section. Upon the expiration of the foregoing
periods, or the extension of either, as hereinbefore provided, no
such work can be recommended until a new permit shall have been
first obtained so to do, and the fee therefore shall be one-half
the amount required for a new permit for such work, provided no
changes have been made or will be made in the original plans and
specifications for such work; and provided further, that such .Sus-
pension or abandonment has not exceeded one year.
Section 6. Building Permit Fees

Section 7. A fee for each building permit shall be paid to
the Village Treasurer as set forth in Section 6.
Section 8. The Building Official and/or the Board of Appeals
may waive the requirement for the employment of a special inspector,
as required by Section 305 (a) if he or such Board of Appeals finds
that the construction or work is such that no 'unusual hazard exists.
Section 9. Any person, firm or corporation violating any of
the provisions of this Ordinance shall be guilty of a misdemeanor
and each such person shall be guilty of a separate offense for each
and every day or portion thereof during which any violation of any
of the provisions of this ordinance is committed, continued or per-
mitted. Upon conviction of any such violation such person shall
be punished by a fine of not more than $100.00 or by imprisonment
in the county jail for not more than 90 days.
Section 10. Every section, provision, section or part thereof
and if anv part, provision or section of this ordinance shall be
declared invalid, such invalidit.v shall not affect any other part,
provision or section thereof.
Section ll. That an ordinance entitled "An Ordinance Regulating

the Construction or Alteration of Buildings and Reguiring a Permit
Therefor" and all other ordinances or parts of ordinances in con-
flict herewith are hereby expressl.v repealed, saving and excepting
Ordinance No. 46 entitled "An Ordinance for the Purpose of Promot-
ing Health, Safety, Order, Convenience and General Welfare by
Regulating the Use of Land, the Location and Use of Buildings and
the Arrangement of Buildings on Lots, and the Density of Population
in the Village of Mound. Wherever the provisions of this ordinance
conflict with the provisions of said Ordinance No. 46, the pro-
visions of Ordinance No. 46 shall control and supercede the con-
flicting portions of this ordinance.
Section 12. That this ordinance shall take effect from and
after its publication.
Councilman Wenkstern moved that this ordinance be adopted as
read. The motion was seconded by Litts and on a roll call the
vote was as follows:

FIREMEN' S GAS MASK
Wenkstern moved that the Village pay for second gas mask asked
for by the Firemen. Livingston seconded the motion and it was carried
unanimously.
PARK PAVILION
A letter addressed to the Council was read in which three
veterans were interested in dismantling the Park Pavilion, utilizing
whatever they could to build three homes. Because there is a great
deal of activitit¥ in the park during the summer months and it was
thought to be too hazardous to do this work at this time of the
year, the Council decided to hold the disposition of the Park
Pavilion in abeyance.
JUSTICE OF PEACE
A letter of resignation as Justice of Peace from Roger Reed
was read. He has recently moved outside the Village limits.
Livingston moved, Wenkstern seconded, and it was passed unani-
mously to accept the resignation and to send a letter of appre-
ciation for the services he has given while Justice of Peace.

EMPLOYEES UNION
A letter was read from the Public Employees Union Local 918,
asking the Council for a meeting. The Council agreed to take this
matter up the July meeting but directed the Manager to write acknowl-
edging the letter.
On motion duly made, seconded and carried the meeting adjourned
to June 21, 1954 at 8:00 P.M.

Meeting called to order at 8:00 P.M. at the Park Pavilion.
Present were Mayor Behmler, Trustees Litts, Pierce and Livingston
and Manager Leikvold.
SHIRLEY HILL, S DRAINAGE
William Schoell of Pfeifer & Schultz was present with prelim-
inary plans for a storm sewer which would relieve the drainage
situation near the Shirley Hills School. The Council instructed
the manager to check with the County to see what they would con-
tribute to the project. The Council asked the Attorney for an
opinion on which the Mount Olive Luther Church could legally fill
in the ditch which runs across their property and through which
