Trustee Pierce 8:00 P.M. Mayor Behmler, out of town. Minutes of the regular meeting of August 9 were read, and motion by Wenkstern, seconded by Livingston were 'unanimously approved as read. on Minutes of the adjourned meeting of August 19 were read, and on motion by Livingston, seconded by Wenkstern were unanimously approved as read. Minutes of the adjourned meeting of August 30 were read. Litts moved, Wenkstern seconded, and it was unanimously carried to approve the minutes as read. Patch and Burton I. Petri, doing business as Patch & Petri, Associated Architects. have offered to furnish architectural services for the contemplated new fire station and office building upon the followio~ terms: 1. Said architects will furnish plans and perspectives suitable for newspaper publication and assist in the selection of a site for said building and fire sta- tion for a fixed fee of $250.00. Said fee shall constitute the total compensation for said architects should bonds for said fire station and office build- ing not be sold. If said bonds are sold, said $250.00 shall be credited to the percentage fee hereinafter specified; 2. The architectural services to be performed by said architects shall consist of preliminary studies, working drawings and specifications for architectural, plumbing, heating and electrical work, checking of contractors bills, issuance of certificates of pay- ments, supervision of the work by trips as required and issuance of certificate of completion; 3. For said services, said architects are to be paid a fee equivalent to 6~% of the lowest accepted bid by the Village of Mound. Said fee is to be paid 25% on completion of sketches, 50% on completion of working drawings, 15% as construction proceeds and the remain- ing 10% upon completion of the building and fire sta- tion and its acceptance by the Village of Mound. NOW THEREFORE, BE IT RESOLVED THAT: 1. Said offer be and it is hereby accepted by the Vil- lage or.Mound; 2. The Mayor and the Village Manager be and they are hereby authorized and directed to execute a contract in the name of the Village of Mound with said archi- tects embodying the foregoing terms. Wenkstern seconded the 'motion and the roll being called, the vote was as follows: Litts Aye Livingston Aye Wenkstern Aye Behmler Aye And so the resolution was passed. VILLAGE OF MOUND 1491 PAVILION The following bid was received on the sale of the Park Pavilion: Village of Spring Park ...... $650.00 Wenkstern moved that the bid be accepted. Litts seconded the motion and on a roll call the vote was as follows: Litts ~-Yea Livingston Nay Wenkstern Yea Beb~nler Yea And so the motion was carried. ALLEY VACATION Shirley Hills "A" Livingston offered the following resolution and moved its adoption: WHEREAS, R. J. Rondorf, the sole owner of the property abutting the fifteen (15) foot wide alley in Block l, Shirley Hills, Unit "A", according to the plat thereof on file and of record in the office of the Registrar of Titles in and for Hennepin County, Minnesota, has requested the Council of the Village of Mound in a petition dated August 9, 1954 to vacate said alley according to law. and, ~HEREAS, a public hearing was held on September 13, 1954 before the Village Council in the Village Hall on such petition after due published and posted notice had been given by the clerk on Septem- ber 2, 1954, and all persons interested were given an opportunity to be heard, and WHEREAS, it appears that it will be for the best interest of the Village to approve such petition, NOW, THEREFORE, BE IT RESOLVED THAT such petition is hereby granted and the said alley above mentioned is hereby vacated as a public alley. Wenkstern seconded the motion and the roll. being called the vote was as follows: Livingston Aye Wenkstern Aye Litts Aye Behmler Aye And so the resolution was passed. ALLEY VACATION Mound Terrace A petition was presented, signed by the property owners affected, asking for the vacation of a part of Forest Lane in Mound Terrace. Wenkstern moved that a hearing be called on this petition. Livingston seconded, and it was carried 'unanimously. Pierce wishes to be on record that he did not favor sale of Pavilion. i492 VILLAGE OF MOUND DITCH BY GEORGE OHMAN A request by George 0hman for a culvert across Elm Street to divert the water which flows into his yard into the school yard instead of flowing in an open ditch between his property and Elm Street, was read. The cost of this culvert was estimated at $156.00. Livingston moved, Wenkstern seconded and it was unani- mously carried that if 0hman would pay part of the expense, the Village would pay up to $100 toward it inasmuch as this situation was caused when Elm Street was put in a few years ago and blocked the natural flow of the water. ROAD IN AUDITOR'S SUB #168 A letter was read asking the Village to accept the south thirty feet of Lot 50 Auditor,s Sub #168 for road purposes. Wenkstern moved,~Livingston seconded and it was passed unanimously to accept the land offered. V llage' Manage~ / MINUTES OF REGULAR ADJOURNED MEETING September 20, 1954 Meeting was called to order at 8:00 P.m. in the Village Office. Present were Mayor Behmler, Trustees Wenkstern, Pierce, Livingston, Attorney Bonham and Manager Leikvold. MUNICIPAL BUILDING Architects Petri and Patch reported on their study of the site for the proposed Village Hall and Fire Station. They recom- mended, depending on soil investigation reports, the present Fire Station site to be considered by the Village Council. Wenkstern moved, Livingston seconded, and it was passed unanimously that a maximum of $150 be authorized for the investi- gation of the subsoil. TRANSFERS Pierce moved, Livingston seconded, and'~it was passed unani- mously that the following transfers be made:
