MINUTES OF THE ADJOURNED REGULAR MEETING April 16, 1956' The meeting was called to order at 8 P.M. in the Village Office by Mayor Behmler, Present were MaMor Behmle r, Trustees Pierce, Livingston, Adams, Lock- hart and Ac~ing Manager Harry Martin. VILLAGE NANA~ER APPLICANTS Richard J. Kroon of Sioux Center, Iowa was interviewed as to his qualifi- cations for the position of Mound Village Manager. Donald L. Walliok, 2SS Herman Terrace, Hopkins, Minnesota, was heard on his application for Village Manager of Mound. Vernon Boxell~ of Minneapolis and Howard Lake, Minnesota, also met with the. council in regard to the position of Village Manager. Discussion of applicants followed. ORDINANCE ON HARBOR LIMITS ~ND NUISANCES Hr. Livingston moved the adoption Sf the ordinance establishing harbor J limits md prohibiting nuisances therein as corrected, chmged and amended as follows: AN ORDINANCE ESTABLISHING HARBOR LIMITS AND PROHIBITING NUISANCES THEREIN The Village Council of the Village of Mound ordains: SECTION 1. Harbor Limits. The geographical and Jurisdictional limits of the village in, on and over navigable waters in or adjacent to the village shall extend to the harbor limits of any adjoining municipality or other governmental uni2. SECTION 2. Primary Harbor Limit. The area within ~00 feet of the water line on the shore of any lake or ether body of water in or adjacent to the village shall be kn~w,, as the "Primary Harbor Limit." SECTION $. Secondary Harbor Limit. The area extending from $00 feet of the water line on the shore of any lake or other body of water in or adjacent to the village and to the harbor limits of an adjoining municipality or other gover- nmental unit shall be known as the "Secondary Harbor Limit." SECTION 4. Juridictional Limit. The harbor limits of thAs village shall be deemed not to extend beyond a point half we~ between the shore cg the body of water located in another village or governmental unit. SECTION 5. Nuisances Prohibited. No person shall commit or maintain a public nuism ce in or upon the wate.rs of any l~e or other body of water within the jurisdiction of thAs village, nor, shall any person let, permit, or enable any VILLAGE OF MOUND 1645 other person to use any boat, dock, craft or structure, or portion thereof, knowing that it is intended to be used for oow~tting or maintaining a public nuisance. No person shall willfully prevent, hinder, oppose or obstruct a pu~llo o££icial in %he pe~orm~ace of his auty in c~rr~i~ out ~hs provisions of this ordin~ce, or in removing or aba~/ng a public nuis~ce. SECTION 6. Nuisances Defined. A pubLic nuis~ce is a crime, punishable as a misdemeanor, a~d consists in unlawfully doing a act or omitting to perform a duty, ~hich act or omission s~llt 1. infure or endanger the safety, health, or comfort of the public; or, 2. offend public decency; or, $. :~ unlawfully interfere with, obst~,Act, or tend to obstruct or render dangerous for use or passage, a body of water w~ thin the harbor limits of the village. SECTION ?. Specific Public Nuisances Defined. The term "Public Nuisance" shall be deemed to include the following: 1. Anything declared to be a public nuisance by an ordinance of this villag~ 2. The depositing of refuse, waste or other deleterious, poisonous or inpurious substance within the harbor limits of this village. $. The depositing of sewage within the primary harbor limits of this village. 4. The erection or maintenance of a~r dock or structure which interferes with, obstructs, or tends to obstruct or render dangerous for use the waters within the primary harbor limits of the village. 5. The failure to operate a boat or vessel in accordance with the provisions of Minnesota Statutes Annotated $61.01 to $61.21, inclusive, and Minn- esota Statutes annotated $61.A1 to $61.§0, inclusive, which statutes are hereby adopted and incorporated herein, and made a part hereof, as fully as if set forth completely. Water skiing or suft boarding within 50 feet of an occupied craft shall be deemed a public nuisance; and any careless or reckless act on water skis or a surf board within the p~mary harbor limits shall be deemed a public nuisance. ?. The overtaking and/or passing of any craft in a channel or narrow pass- age by the operator of any motor boat, speed boat, or of any vessel under power, so as to endanger other craEt, shall be deemed a public nuisance, and all such crafts shall proceed through all channels and narrow passages of water at safe speeds, otherwise the operator thereof shall be deemed to have commited a public nuisance. The failure to equip and maintain lights, and to have such lights lighted when the boat or vessel is operating within the harbor limits of the village at night, shall be deemed a public nuisance. $. Obstructing or interferring with passage of a boat or vessel through a channel or narrow passage. 10. Operating a boat or vessel in a careless or reckless manner in or about a public swimming beach shall be public nuisance. 11. Swi~ng in a channel or jumping or diving from a channel bridge shall be a public nuieance. SECTION 8. Penalty. Any person violating any of the provisions of this or- dinance shall be guilty of a misdemeanor and shall be punished by a fine of not to exceed one hundred dollars ($100.00). or by imprisonment for a period not to exceed ninety (~0) days. SECTION $. Effective Date, This ordinance shall take effect and be in full force from and after its passage and pbulication. VILLAGE OF MOUND The question was on the adoption of the resolution, and the roll being called, there were five YEAS and no NAYS, as follows.. GAS FOR COUNTY SHERIFFS Pierce moved, Livingston Seconded that we approve the cost of gas not to exceed $100.00 for the season in conjunction with the County Sheriffs enforce- sent of the Harbor Limits Ordinance. Attest: A6ting Village Manager Mayor // SPECIAL MEETING OF VILLAGE TRUSTEES MAY ~, 1956 A special meeting of the trustees of the Village of Mound, a municipal corporation, Hennepin County, Mimuesota, to be held at the Mound Fire Hall, on the 5th day of Ms~, 1956, at 9 A.M. for the pure.se of consideration and/~r appointment of a village manager md to comaide~ 1Nme setting of~a date for a hearing on the request for a building permit for a Gas and Oil Service Station and for such other action in regard thereto as the trustees may deem advisable. The special meeting of Village Trustees was called to order by Ma~or Behmler at the Fire Hall on the 8th day of May, 1956, at 9A.M. Those present were Pierce, Livingston, Adams, Lockhart, and Mayor Behmler We, the undersigned trustees of the Village of Mound, a municipal corporatikn, hereby admit receipt of a copy of the foregoing notice, hereby consent that the meeting may be held as called, and do hereby waive any and all notice as provided by the statutes of the State of Minnesota, of a meeting to be held on the 5th day of May, 19§6, for the purpose of consideration and/or appointment of a Village Manager and to consider the setting efa date for a hearing on a request for a Building Per,it for a Gas and 0il Service Station. LOCKHART Livingston moved, Adams seconded we offer Vernon Boxell compensation of $8000.00 per year for his services for the position e~ Manager of the Village of Mound. Motion carried. Mr. Boxell stated he would accept the appointment of Manager at the salary of $5000.00 per year, and Mr. Behmler asked on two points as to Boxells' intention of a three year minimum stay at Mound and 60 to 90 day notice of intention to r~ign, and
