1977-06-28114 MIlViJTES OF THE REGIILAR MEETING OF T't3E COUNCIL OF JIVE 28, 1977 AT 8:00 P.M. AT THE MOUND COUNCIL CHAMBERS Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Mound, Hennepin County, Minnesota was held at 534 Maywood Road in said City on June 28, 1977 at 8:00 p.m. Those present were: Mayor Tim Lovaasen, Councilmembers Robert Polston and Benjamin Withhart. Also present were City Attorney Curtis Pearson, City rlanager Leonard L. Kopp and City Clerk l~ry H. Marske. M.Q3UTE5 The minutes of the meeting of June 21, 1977 were presented for consid- eration. Polston moved and Withhart seconded a motion to accept the minutes as presented. The vote was unanimously in favor, so carried. PIIBLIC HEARING ON AMENDING ZONING CODE - ACCESSORY BUILDINGS The~~City Clerk presented an affidavit of publication in the official newspaper of the notice of public hearing on said zoning amendment. Said affidavit was then examined, approved and ordered filed in the office of the;City Clerk. The Mayor then opened the public hearing for public input on the zoning amendment and persons present to do so were afforded an opportunity to express their views thereon. Ted Jameson, 2021 Arbor Lane and Henry Stasik, 2028 Arbor Lane asked for clarification on parts of the amendment. The Mayor then closed the public hearing. Polston moved and Withhart seconded a motion to continue the public hearing to July 5, 1977 at 8:00 p.m. The vote was unanimously in favor, so carried. PLANNING COI~IISSION MINIITES Setback Variance - Lot 3, Subd.of Lots 1-32 Skarp & Lindguist~s Ravenswood Polston moved and Lovaasen seconded a motion RESOLUTION 7?-279 RESOLUTION TO CONCUR WITH THE PLANNING COMM- ISSION RECOMMErTDATION TO APPROVE THE SIDE YARD VARIANCE BIIT TAAT THE SHED BE NOT LESS THAN SIX FEET FROM THE MAIN DWELLING STRIIC- URE. The vote was unanimously in favor. Side and Rear Lot Variance - Lot 10, Block 1, Devon ' Polston moved and Withhart seconded a motion RESOLUTION 77-280 RESOLUTION TO CONCUR WITH THE PLANNING COMM ISSION RECOP~E'NDATION TO APPROVE A FOUR FOOT SIDE YARD VARIANCE. The vote was unanimously in favor. Sian Variance - Woodcrest Subdivision Lavaasen moved and Polston seconded a motion to continue this item to the meeting of July i2, 1977 for more information. The vote was unanimously in favor. Subdivision of band - Lots 3, 4 & 5, Block 14, Shadywood Point Side Yard Setback - Lot 16 and Part of 15, Block 6, The Highlands Polston moved and Lovaasen seconded a motion to continue discussion of these two items to the meeting of July 12, 1977. The vote was unanimously~in;'favor. 1~.5 Councilmember Fenstad arrived at 9:15 p.m. after attendirio a meeting of the Lske Minnetonka Conservation District as was requested of him by the Council. PARK COMMISSION MLNUTES The Council briefly reviewed the minutes of the Park Commission. Lovaasen moved and Withhart seconded a motion RESOLUTION 77-281 RESOLUTION CONCURRIAtG WITH THE PARK COI~i- ISSION AND APPROVE T!~E RELEASE OF LOTS 7-13 AND LOTS 33, 34 AND 48, AUDITORS SUBDIVISION FOR SALE AND APPROVE THE DIVISION OF SA:TD LOTS AS PROPOSED BY THE PARK COMMISSION. The vote was unanimously in favor. NO PARKING ORDINANCE - HICKORY LANE Withhart moved and Fenstad seconded a motion t© ordain the following amendment as Ordinance 364 ORDINANCE N0. 364 AN ORDINANCE ADDING SUBSECTION 49 TO SECTION 46.29 (b~ PROHIBITING PARKIl~TG ON HICKORY LANE 1 1 THE CITY OF MOUND DOES ORDAIN: Section 46.29 (b~ of the Cit-,~ Code is amended to add Subsection 49 which shall read as follows: 49. Both sides of Hickory Lane from Northern Lane northerly to Lake Minnetonka. The vote was. unanimously in favor, so ordained. LI~CUOP. i.ICENSE RENE'~JALS Withhart moved and Polston seconded a motion P.ESOLUTIOPd 77-282 RESOLUTION APPROVING THE ISSUANCE OF AN ON-SALE LIQUOR LICENSE TO THE SURFSIDE FOR ONE YEAR COMMENCING JULY 1, 1977. The vote was unanimously in favor. WitahtLrt moved to approve the issuance of the on-sale liquor license for the Briarwood with the stipulation that the property taxes be paid before July 9, 1977. The motion died for lack of a second. Lovaasen moved and Fenstad seconded a motion RESOLUTION 77-283 RESOLUTION APPROVING THE ISSUANCE OF AN ON-SALE LIQUOR LICENSE TO THE BRIARWOQD FOR ONE YEAR COMMENCING JULY 1, 1977. The vote was unanimously in favor. COBS AND SUGGESTIONS FROM CITIZENS PRESENT No comments or suggestions heard. 1977. LOTS 13 & 14, BLOCK 6, PEMBROKE FOR $120. LOTS 15 & 16, BLOCK 6, PEMBROKE FOR $90. AND LOTS 1 & 27, BLOCK 5, ARDIIV FOR $200. FOR TUXEDO BOULEVARD. The vote was unanimously in favor. DISEASED TREES Withhart moved and Lovaasen seconded a motion RESOLUTION 77-285 RESOLUTION SETTING POLICY FOR CAST DISTRI-• BUTTON FOR REMOVAL AND DISPOSAL. OF DISEASED ELM AND OAK TREES. The vote was unanimously in favor. Il~'ORMATION MEMORANDUM 77-125 The Council briefly discussed the memorandum regarding the retirement of Francis Johnson. The Council determined to table this item until more in- formation is available. LAKE MTNN~~TONKA CONSERVATION DISTRICT REPORT Councilmember Fenstad briefly reported on the action of the bake Minne- tonka Conservation District meeting he attended earlier this evening. Withhart moved and Polston seconded a motion RESOLUTION 77-286 RESOLUTION COMI~IYDING THE MAYOR FOR HIS. EFFORTS WITH T$E COUNTY BOARD IN PROMOTING ADDITIONAL FUND ALLOCATIONS FOR THE LAKE MINNETONKA WATER PATROL The vote was unanimously in favor. Fenstad moved and Lovaasen seconded a motion to adjourn to the next meeting on July 5~`, 1977.
