1977-08-09133 REGULAR I~iEETING OF THE CITY COUNCIL August 9, 1977 Pursuant to due call and notice thereof a regular meeting of the City Council of the City of Mound, Hennepin County, liinnesota was held at 5341 Maywood Road in said City on August 9~ 1977 at 7:30 p.m. Those present were; Mayor Tim Lovaasen, Councilmembers; Orval Fenstad Gordon Swenson Benjamin jdithhart and Robert Polston. Also present were City Planager Leonard L, Kopp, City Attorney Curtis Pearson and City Clerk Mary H. Ilarske. MINUTES The minutes of the regular meeting of July 26, 1977 were presented for con - sideration. Swenson moved and Polston seconded a motion to accept the minutes of the meeting of July 26~ 1977 as presented. The vote was unanimously in favor, so carried and accepted. PUBLIC BEARING - USE CF REVENUE SHARIP;G FUNDS The City Clerk .presented an affidavit of publication in the official newspaper of the notice of public hearing on said Revenue Sharing Use. Said affidavit was then examined approved and ordered filed in the office of the City Clerk. The Mayor then opened the meeting for public input on the Revenue Sharing Use and persons present to do so were afforded the opportunity to express their views thereon. A1rs. Janet Gellman questioned what lot was proposed to be purchased Judge Herbert Wolner questioned if the lot was subdivided and sold would the • new lots go back onto the tax roll. Councilmember Polston suggested that the Commons be upgraded with part of the funds. The Mayor then closed the public hearing. The items recommended by the staff and tl:e public will be placed under consideration in preparing the budget. DI;LINOTJE~ ~ UTILITY BILLS -PUBLIC HEARING The City Clerk presented an affidavit of publication in the official newspaper of the notice of public hearing on said Delinquent Utility Bills. Said affidavit was then examined, approved and ordered filed in the office of the City Clerk. The Mayor then opened the meeting:_for.public input on the Delinquent Utility Bills and gersons present to do so were afforded the opportunity to express their views thereon. No persons present offered comment and the Mayor then closed the public hearing. Fenstad moved and ~•lithhart seconded a :notion to follow the policy previously established and proceed to shut off water service to those delinquent cus- tomers. The motion carried with Swenson voting nay. BEER LICENSE Lovaasen moved and ,Fenstad seconded a motion to call a public hearing on the .matter of issuance of a 3.2 beer license for September 6, 1977. The vote was unanimously in favor. Swenson moved and Lovaasen seconded a motion to rescind the previous motion. The vote was unanimously in favor. The vote was unanimously in favor. 134 PLANNING CDr9~4ISSI0N RECOMMENDATIONS Double Front Yard Variance - Block 6, Lot 1, Avalon Tr7ithhart moved and Lovaasen seconded a motion RESOLUTION 77-349 RESOLUTION GRANTING REQUESTED VARIANCE AND STIPULATING THE BY-PASS DF.AINAGE TILES BY INSTALLED WITH THE CITY CONTRIBUTING THE CULVEP.T ONLY. The vote was four in favor with Polston voting nay. Subdivision of Land -Part of Lot 26, Auditors Subd. 170 Lovaasen moved and Swenson seconded a motion RESOLUTION 77-350 RESOLUTION TO CONCUR WITH THE PLANNING cor~•i- ISSION TO APPP.OVE THE SUBDIVISION AS REQUESTED. The vote was unanimously in favor. Variance - Double Front - Lots 3 and 4, Block 3, Avalon Penstad moved and Swenson seconded a motion RESOLUTION 77-351 RESOLUTION TO CONCUR 6JITH THE PLANNING COMM- ISSION TO APPROVE THE VARIANCE AS P.EQUESTED. The vote was unanimously in favor. Sign Variance - Lot 9, Block 5, Koman~s Addition Swenson moved and Polston seconded a motion to table this item for two weeks and request the Chief of Police submit a recommendation. The motion passed with Lovaasen and 47ithhart voting nay. Lake Front Setback -Part of Blocks 1 and 2, Minnesota Baptist Assembly Lovaasen moved and Polston seconded a motion to .table this matter temporarily to seek advice from the City Attorney. T're vote was unanimously in favor. Fenstad moved and Swenson seconded a motion to refund the variance application fee in the amount of $15.00 to Steve Schmidt as the City Attorney ruled that a variance was not required. The vote was unanimously in favor. The vote was unanimously in favor. INSURANCE PROPOSALS Mr. Don David representing the City Insurance Committee appeared before the Council to present additional insurance coverage information to the Council. The vote was unanimously in favor. L.O.G.I.S. LCCAL GOVERNMENT INFCRMATION SYSTEMS ASSOCIATION The City Clerk briefly described the proposed new computerized governmental accounting system. EDUCATIONAL POLICY Swenson moved and Withhart seconded a motion RESOLUTION 77-364 RE5OLUTION ADOPTING THE EDUCATIONAL POLICY AS OUTLINED IN THE POLICE UNION CONTRACT TO APPLY Tp ALL CITY EMPLOYEES. The vote was unani::lously in favor. HANDICAPPED PARY.ING Withhart moved and Polston seconded a motion to ordain the following section be added to the City Code as Ordinance 3fi5 ORDINANCE NO. 365 AN OP.DINrtNCE ADDING SECTION 46.291 TO TIIE CITY CODE I:EGARDING PP.IdKING FOR TIIE HANDICAPPED The City of Aiound does ordain: Section 46,291 is hereby added to the City Code and shall read as follows: Section 46.291. Parking; for the handicapped. No person shall park in, obstruct or occupy faith a motor vehicles any parkins spaces on public or private property desisnated or signed as hnadicapped parkins unless said vechicle prominently displays an insisnia or certificate issued by the De- partment of Motor Vehicles pursuant to 2~linnesota Statutes Sec. 169,345 (3), and such vehicle is beins used by a physically handicapped persons as de- fined in Minnesota Statutes Sec. 169.345 Subd. 2. Signs designating handi- 137 capped parking spaces shall be presumed to have been placed according to laws unless the contrary is established by competent evidence. Violation of this provision is a petty offense. Motor vehicles found in violation of this section may be ordered removed by a member of the police department under the procedures stated in Section 46.30. The vote was unanimously in favor, so ordained. POLICE RESERVE ORDINANCE Lovaasen moved. and Swenson seconded a motion to ordain the following section be added to the City Code as Grdinance 366 UP.DINANCE N0. 366 AN ORDINANCE ADDING SECTION 8.20 TO THE CITY CODE ESTABLISHING A POLICE RESEF:VE FORCE The City of Mound does ordain: Section 8.20 is hereby added to the City Code and shall read as follows: Section 8.20. Police Reserve Force. The establishment of a volunteer Police Reserve is hereby authorized. The organizations directions supervision and control of the Police Reserve shall be the responsibility of the Chief of. Police. Members of the Police Reserve shall be voluntary and receive no hourly compensation from the City. The vote was unanimously in favors so ordained. BILLS Swenson moved and 4,Tithhart seconded a motion to approve payment of the bills as presented on the prelist in the amount of $138220.56 where funds are available. STREET LIGHTS - COMMERCE BOULEVARD SOUTH Withhart moved and Fenstad seconded a motion RESOLUTION 77-365 RESOLUTION RELATING TO STREET LIGHT REPAIRS The vote was unanimously in favor. COVER THE CLOCK Swenson moved and Polston seconded a motion to waive the requirements of Resolution 77-16 and ignore the time. The motion carried unanimously. the Council requested the City Manager to inform George Boyer of Hickok and Associates to proceed with the water efficiency study. The Council requested the City Manager to submit a letter to School District ido. 277 regarding the Community Services Levy. -~ Councilmember Swenson requested the City Manager to submit a recommendation and report regarding residences .not connected to the sanitary sewer at the next meeting.
