1977-08-23142 REGULAR MEETING OF THE CITY COUNGIL August 23, 1977 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Mound, Hennepin .County, Minnesota was held at 5341 Maywood Road in said City on August 23, 1977 at 7:30 p.m. Those present were: Mayor Tim Lovaasen, Councilmembers Orval Fenstad, Gordon Swenson, Robert Polston and Benjamin 4ithhart. Also present were City Manager Leonard L. Kopp and City Clerk Mary H. Marske. MINUTES The minutes of the regular meeting of August 16, 1977 were presented for con- sideration. Swenson moved and Withhart seconded a motion to accept the minutes of the meeting of August 16, 1977 as presented. The vote was unanimously in favor, so carried and accepted. PUBLIC HEARING - BEER LICENSE - MOUND LAIv'ES The City Clerk presented an affidavit of publication in the official newspaper of the notice of public hearing on said Beer License. Said affidavit was then examined, approved and ordered filed in the office of the City Clerk. The Mayor then opened the meeting for public input on the Beer License and per- sons present to do so were afforded the opportunity to express their views thereon. No persons present offered objections and the Mayor then closed the public hearing. Lovaasen moved and Swenson seconded a motion RESOLUTION 77-381 RESOLUTION GRANTING A 3.2 NON-INTOXICATING BEER LICENSE TO THE OWNER OF THE MOUND LANES. The vote was unanimously in favor. BIDS - SKYLIGHT REPAIR The Council considered bids received in regard to the repair of the skylight on the City Office building. Fenstad moved and Withhart seconded a motion to reject all bids and authorize the architect Williams/O~Brien and Central Roofing Company to complete Proposal A-1 and Proposal B at no cost to the City. The vote was unanimously in favox. PLANNING COMMISSION RECOMriENDATION ~n Variance - Westonka Villa Apartments Polston moved and Swenson seconded a motion RESOLUTION 77-382 RESOLUTION GRANTING APPROVAL OF PLACEMENT OF SIGN AT WESTOIv'KA VILLA APARTMENTS AND GRANTING NECESSARY VARIANCE The vote was unanimously in favor. COMMENTS AND SUGGESTIONS FROM CITIZENS PRESENT Mrs. Janet Gellman asked some detail about the skylight problem and possible reasons for the problems, Ruth kTyman, reporter for The Lalcer asked for clarification of time of City meetings. SPECIAL ASSESSMENT HEARINGS Fenstad moved and Swenson seconded a motion RESOLUTION 77-383 RESOLUTION PROVIDING FOR A PUBLIC HEARING TO BE CALLED REGARDING THE SFECI6>L ASSI:SSt~1ENTS TO BE LEVIED FOR THE YEAR OF 1977 ON SEPTEIi- BER 21, 1977 AT 7:30 P.i1. Tlie vote was unanimously in favor. The City Council will be meeting with the Spring Park Council on Septemv~r 12, ?cs77. 143 TUXEDO EASEMENT Withhart moved and Polston seconded a motion RESOLUTION 77-384 RESOLUTION AUTHORIZING OBTAINING OF RIGHT OF WAY EASEMENT OF LOTS 1 AND 27, BLOCK 5, ARDEN IN TliE ADDITIONAL AMOUPdT OF $350.00 FOR TREE REMOVAL AS ORIGINALLY APPROVED BY RESOLUTION 77-284 FOR TUXEDO BOULEVARD The vote was unanimously in favor. LICENSES - CIGARETTE AIdD OFF SALE BEER Swenson moved and 4dithhart seconded a motion RESOLUTION 77-385 RESOLUTION PROVIDING FOR THE CALLING OF A PUBLIC HEARING FOR AN OFF-SALE BEER LICENSE FCR PETER WARDS dba '~OP4 THUi4B SUPERETTE FOR SEPTEM- BER 6, 1977 AT 7:30 P.M. The vote was unanimously in favor. Fenstad moved and Swenson seconded a motion RESOLUTION 77-386 RESOLUTION GRANTING A LICENSE FOR THE SALE OF CIGARETTES TO PETER WARD dba TOM THUMB 5UPERETTE. The vote was unanimously in favor. ASSESSING CLERK '1'he Council considered a memo from the City Clerk regarding the establishment of the position of Assessing Clerk and changing the classification of Clerk- Typist Delaris 5chwalbe to Assessing Clerk. Polston moved and Swenson seconded a motion RESOLUTION 77-387 RESOLUTION ESTABLISHING`POSTION OF ASSESSING CLERK AT A SALARY OF $750.00 PER MONTH EFFECT- IVE 5EPTEl~ER 1~ 1977..- The vote was unanimously ir> favor. MISDEMEANOR PENALTY INCREASE The Council considered a memo from the Prosecuting Attorney regarding the increase in maximum fines for misdemeanors from $300 to $500. Withhart moved and Swenson seconded a motion to ordain the following amendment as Ordinance 367 ORDINANCE NO. 367 AN ORDINANCE AMENDING SECTION 71.099 OF THE CITY CODE RELATING TO INCREASING THE PENALTY PROVISIONS FOR COISt4ITTING A MISDEMEANOR: AND REPEALING SECTION? 70.01 OF THE CITY CODE L The City of Mound does ordain: Section 71.09 of the City Code is amended to read as follows: Section 71.09 Penalties. a. Any person who commits a misdemeanor and violates the pro- visions of any ordinance of the City of Mounds shall be guilty or a misdemeanors and upon conviction thereof shall be punished by a fine of not more than $500. and by imprison- . ment for not more than ninety (90) days or both. b. The provisions of this ordinance increasing the rnaximum fine for a misdemeanor to $500 and permitting fine and imprison- ment for not more than ninety (90) days are pursuant to and consistent with the provisions cf Chapter 355 of the Laws of 1977 of the State of Tiinnesota. 144 Section 70.01 of the City Code is inconsistent with Section 71.09 and is hereby repealed. The vote was unanimously in favors so ordained. TRANSFER OF FUNDS Fenstad moved and Swenson seconded a motion RESOLUTION 77-388 RESOLUTION AUTHORIZING THE TRANSFER OF CERTAIN CITY FUYdDS. The vote was unanimously in favor. PAYr~NT CF BILLS Swenson moved and Withhart seconded a motion to approve payment of the bills as presented on the prelist in the amount of $23917.35 where funds are avail- able. The vote was unanimously in favor. INFORAlATION tiEY~ORANDUMS Withhart moved and Swenson seconded a motion to farm a sub-committee to establish an employment policy to include job descriptions and benefits. The motion carried with Fenstad and Lovaasen voting nay. Due to the pressure of budget time the matter will be placed on the agenda at the end of October.
