REGULAR "iEETIPIG OF THE CITY COUNCIL September 7.7, 1877 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of ;Mound, Flennepin County, ~;innesota ~~ias held at 5341 Maywood Road in said City on September 27, 1977 at 7:30 p.m. Those present were: tlayor Tim Lovaasen, Councilmembers;. Orval Fenstad, Robert Polston, Gordon Swenson and Benjamin !~!ithhart. Also present were Gity Manager Leonard L. Kopp, City Engineer 1~!illiam ~"1cCombs, City Attorney Curtis Pearson and City Clerk t1ary H. Marske. RESOLUTION COMMENDING 4J,4RD DUANE MELENICH, EAGLE SCOUT PUBLIC HEARING - TONKA~,l00D AREA STREET IMPROVEMENT The City Clerk presented an affidavit of publication in the official newspaper of the notice of public hearing on said street improvements. Said affidavit was then examined, approved and ordered filed in the office of the City Clerk. City Engineer William McCombs presented a slide presentation of proposed street improvements in the are of Tonkawood. He also described possible storm drainage in the area and the formula for assessments. The Mayor then opened the hearing for public input on said street improvements and person present to do so were afforded the opportunity to express their views thereon. Persons present offering questions and comments included: Robert Hare, 5432 Breezy Road Willard Botka, 2149 Cardinal Lane N. Swenson moved and Withhart seconded a motion PESOLUTION 77-436 RESOLUTION TO TABLE THE HEARING ON TONKAWOOD STREET IMPROVEMENTS UNTIL ALL HEARINGS ARE COMPLETE AND CONTINUE THIS MATTER UNTIL OCTOBER 18, 1977. The vote was unanimously in favor. Lovaasen moved and Fenstad seconded a motion to ordain the following section be added to the City Code as Ordinance 369 02D I PJ.ANC E N0. 369 AN ORDINANCE AMENDING SECTION 26.x304 SUBDIVISION 10 OF THE CITY CODE PROVIDIPIG FOR WIIdTER DOCK STORAGE The City of Mound does ordain: C Section 26.9304 Subdivision l0 of the Ptound City Code of Ordinances is amended to read as follows: Subdivision 10. Winter dock storage by permit holders: A. Docks may be left in the water during the winter months providing the following conditions are met; 1. The required dock license for the following year must be applied for and paid by the tenth day of January. 2. Docks may be partially removed, provided that those sections left in public waters are complete. No poles, posts, stanchions or supports standing alone shall remain in public waters. 3. Docks must be brought up to the construction standards outlined in this ordinance within 2 weeks after the ice goes out- in the spring of the year. If not, the procedures as specified in subdivision of this ordinance will apply. 4. Docks may not be left in the water or on public land if they conflict with the following uses as shown on .the dock location map: a. Slide area b. Snowmobile crossings c. Skating rinks d. Trails e. Road access f. Other conditions or circumstances which are determined by the~Council to have an adverse affect on adjacent properties. 1 B. Docks may be stored on commons during-the winter months providing the following conditions are met: 1. Docks may not be stored on the commons if they conflict with the following uses as shown on the dock location map: ' a. Slide area b. Snowmobile crossing c. Skating rinks d. Trails e. Road access f. Other conditions or circumstances which are determined by the Council to have an adverse affect on adjacent properties. 2. Docks may not be stored on commons shown on the dock location map as having topographic conditions which are too steep, or have fragile flora or where tree damage may occur due to tree density or where there is unstable ground. 3. Docks may be stored only in areas designated for dock permits and as shown on the dock location map. 4. All storage shall be done in an orderly, compact and unobtrusive manner. 160 5. Docks and. associated hardware must be removed from the commons and/or public lands between June lst and September lst of each year. 6. Storage shall be restricted to dock .materials, dismantled docks and dismantled boat lifts. 7. The Park Commission, City Dock Inspector and City Council shall review the dock location map each year and designate areas available for winter storage and also designate the areas restricted because of the conditions here- tofore stated. Swenson moved and Polston seconded a motion to accept the minutes of the meeting of September 7_O, 1977 as presented. The vote was unanimously in favor. TAX FORFEIT LAND The City Manager informed the Council of a request from a property o~Nner to release some city owned park property to be attached. to the individuals lots. Lovaasen moved and !Jithhart seconded a motion to deny the request. Pcilston moved and Lovaasen seconded a motion to table this item to a future date to obtain additional information. The vote was unanimously in favor. The vote was unanimously in favor. COMMENTS AND SUGGESTIONS FROM CITIZEPJS PP,ESENT Mrs. Janet Gellman asked for clarification on the Suburban Nursing Service and tax forfeited land. TRANSFER OF FUNDS Fenstad moved and Swenson seconded a motion RESOLUTION 77-440 RESOLUTION AUTHORIZING THE TRANSFER OF CERTAIN CITY FUPJDS. The vote was unanimously in favor. PAYMEPJT OF B ILLS Swenson moved and 1!ithhart seconded a motion to approve payment of the bills as presented on the prelist in the amount of $35,434.56 where funds are available.
