The Housing and Redevelopment Authority in and for the City of Mound, Minnesota, met
in regular session on Tuesday, December 8, 2009, at 7:20 p.m. in the council chambers
of city hall.
Members present: Chair Mark Hanus; Commissioners David Osmek, Ray Salazar, Heidi
Gesch
Members absent: Commissioner Greg Skinner
Others present: City Manager Kandis Hanson, Acting City Clerk Vicki Weber, Finance

1. Open meeting
Chair Hanus opened the meeting at 7:20 p.m.
2. Approve agenda
Hanson requested addition of 4A, Resolution Approving the Procurement Policy for the
Mound Housing and Redevelopment Authority.
MOTION by Osmek, seconded by Salazar to approve the agenda as amended. All
voted in favor. Motion carried.
3. Approve minutes
MOTION by Osmek, seconded by Gesch to approve the minutes of the November 24,
2009 meeting. All voted in favor. Motion carried.
4. Approve claims
MOTION by Osmek, seconded by Gesch to approve the claims in the amount of
$103,362.53. All voted in favor. Motion carried.
5. Catherine Pausche with requests for action
5A. Civil Rights Certification
Pausche explained that this action is certify that the Mound HRA will carry out the public
housing program in conformity with the Civil Rights Act of 1964, the Fair Housing Act,
and the Americans with Disabilities Act of 1990.
MOTION by Osmek, seconded by Salazar to adopt the following resolution. All voted in
favor. Motion carried.
RESOLUTION NO. 09-17H: RESOLUTION CERTIFYING THE PHA WILL
CARRYOUT THE PUBLIC HOUSING PROGRAM OF THE AGENCY IN CONFORMITY
WITH TITLE VI OF THE CIVIL RIGHTS ACT OF 1964, THE FAIR HOUSING ACT,
SECTION~504 OF THE REHABILITATION ACT OF 1973, AND THE TITLE II OF THE
AMERICANS WITH DISABILITY ACT OF 1990, AND WILL AFFIRMATIVELY
FURTHER FAIR HOUSING.

Pausche reviewed the 2010 Indian Knoll Budget as outlined in the packet material.

APPROVING AMENDING THE PROCUREMENT POLI Y FOR THE MOUND HOUSING
AND REDEVELOPMENT AUT ORITY
WHEREAS, the U.S. Department of Housing and Urban evelopment has agreed to
provide Capital Fund Program (CFP) assistance and an perating Subsidy to the HRA
of the City of Mound, Minnesota, for the purpose of helpin the HRA in carrying out
capital and management activities at the Indian Knoll Ma or Public Housing
Development, and
WHEREAS, the HRA of the City of Mound undertakes procurement activities in carrying
out the management responsibilities for Indian Knoll Man r, and
WHEREAS, the HRA has an obligation to comply with th requirements of the Annual
Contributions Contract with HUD, Federal Regulation 24 FR 85.36, Federal Regulation
Part 85 Compliance/Section 1605 of the Recovery Act, H D Handbook 7460.8, Rev 2,
and applicable State and Local Laws, and
WHEREAS, the HRA Board approved a Procurement Pol cy for the Mound Housing and
Redevelopment Authority Indian Knoll Manor Apartments n September 22, 2009,
NOW THEREFORE, BE IT RESOLVED, the Board of the Mound Housing and
Redevelopment Authority approves the amendment to th Procurement Policy for the
Mound Housing and Redevelopment Authority Indian Kno I Manor Apartments as
presented in Exhibit A.

AMENDMENT A
Part 85 Compliance
Any requirements relating to the procurement of goods and services arising under state
and local laws and regulations shall not apply to Capital Fund Stimulus Grants. The PHA
shall instead follow the Part 85 requirements.
Section 1605 of the Recovery Act: Buy American
The `Buy American requirements of section 1605 of the Recovery Act" of 2009 shall be
included as a part of any solicitation and award pertaining to ARRA monies.
Section 1605 of the Recovery Act provides:
Use of American Iron, Steel and Manufactured Goods.
(a) None of the funds appropriated or otherwise made avaialable by this Act may be
used for a project for the construction, alteration, maintenance, or repair of a
public building or public work unless all of the iron, steel and manufactured
goods used in the project are produced in the United States.
(b) Subsection (a) shall not apply in any case or category of cases in which the head
of the Federal department or agency involved finds that:
(1) Applying subsection (a) would be inconsistent with the public interest;
(2) Iron, steel and the releveant manufactured goods aze not produced in
the United States in sufficient and reasonably available quantities and
of a satisfactory quality; or
(3) Inclusion of iron, steel, and manufactured goods produced in the
United States will increase the cost of the overall project by more thatn
25 percent.
(c) If the head of a Federal department or agency determines that it is necessary to
waive the application of subsection (a) based on a finding under subsection (b),
the head of the department or agency shall publish in the Federal Register a
detailed written justification as to why the provision is being waived.
(d) This section shall be applied in a manner consistent with United States obligations
under international agreements.
