Adjourn • • CITY OF MOUND ORDINANCE NO. 02-2009 ORDINANCE AMENDING CHAPTER 256 OF THE CITY CODE AS IT RELATES TO THE DOCKS AND COMMONS COMMISSION The City of Mound does ordain That Section 256 which was repealed by the City Council on December 15, 2005, be restored to read as follows: SECTION 256 — DOCKS AND COMMONS COMMISSION 256.01 Establishment of Commission. The Docks and Commons Commission for the City of Mound is hereby established. 256.05 Composition. The Docks and Commons Commission shall consist of six members. Five members (to be composed of three inland and two abutting property owners, all of whom must be active in the City licensed dock program) shall be appointed by the City Council and may be removed by a four -fifths vote; the Council shall select one member of the Council to serve on the Commission from among the Councilmembers, the said Councilmember to be appointed for one year, commencing in January of each year. On the terms of the members first appointed, one shall expire December 31, 2009; two shall expire December. 31, 2010; and two shall expire December. 31, 2011. Their successors shall be appointed for terms of three years. Both the original and successive appointees shall hold their offices until their successors are appointed and qualified. An appointee shall be automatically removed from the Commission upon ceasing to be active in the City licensed dock program. Every appointed member before entering upon the discharge of his or her duties shall take an oath that he or she will faithfully discharge the duties of his or her office. All members shall serve without compensation but may be reimbursed for actual expenses if funds therefore are provided in the adopted budget of the department. 256.10 Organization, meetings, etc. The Commission shall elect a Chairperson from among its appointed members for a term of one year with a limit of two consecutive terms as Chairperson; and the Commission may create and fill such other offices as it may determine. The Commission may hold at least one regular meeting a month. It shall adopt rules for the transaction of business and shall keep record of its resolutions, transactions and findings, which record shall be public record. 256.15 Duties. It shall be the duty of the Commission to meet from time to time with the City Manager, the City Council and the Parks Superintendent to consider matters pertaining to docks and shoreline that is subject to City licensed docks in the City as shall be referred to the Commission by the City Council, City Manager, Parks Superintendent, or as members of the Commission deem proper with respect to such matters. -1- Ordinance No. 02 -2009 The policy of the City of Mound is to strive to: a. provide present and future residents of the City an unpolluted environment b. provide. access to lakes and streams in the community; and c. provide parks which afford natural beauty as well as recreational enjoyment It is understood that the Commission is advisory to the City Council and is created Pursuant to the authority, conferred upon the City Council by Minnesota Statutes. 256.20 Reports to be advisory. The Commission. reports, conclusions and recommendations shall be made to the Council, Manager and Parks. Superintendent as may requested, or to any or all of them as the Commission deems appropriate in the light of the matter under consideration. Its reports, conclusions and recommendations are purely advisory, and the final determination and responsibility shall be with the Council. It shall be aided and assisted in every way possible by the Parks Superintendent, who shall be appointed- by -the City Manager. Members may also ask additional pertinent questions, as reflected by the form. I am aware this is a repetition of the questions on the application. However, responding orally to the same questions will indicate candidates' ability to verbalize, their ability to think on their feet, and their ability to think and express under pressure. To make it a fair process, the same questions need to be asked of all the candidates.
