2000-12-04MOUND CITY COUNCIL MINUTES DECEMBER 4, 2000 The City Council of the City of Mound, Hennepin County, Minnesota, met in regular session Tuesday, December 4, 2000, at 7:30 p.m. in the Council Chambers at 5341 Maywood Road in said City. Councilmembers present: Mayor Meisel; Councilmembers Bob Brown, Leah Weycker, and Mark Hanus. Councilmembers absent: Andrea Ahrens. 1. CALL TO ORDER AND PLEDGE OF ALLEGIANCE Mayor Meisel called the meeting to order at 7:30 p.m., and the pledge of allegiance was recited. 2. APPROVE AGENDA AND CONSENT AGENDA Changes in the agenda were noted - pulling item C1-4, MetroPlains land uses, and added to the agenda was the setting of a special meeting on December 19, 2000, at 7:30 p.m. MOTION by Brown, seconded by Weycker to approve the agenda and consent agenda, with the addition of a public hearing being set for December 19, 2000, at 7:30 p.m., to consider MetroPlains land uses. Roll call vote was taken. Those voting in favor: Brown, Weycker, Hanus and Meisel. Motion carried. 3. COMMENTS AND SUGGESTIONS FROM CITIZENS Bob Johnson, 2928 Westedge Blvd: stated he didn't receive notification of the November 30th Planning Commission meeting. Bart Rovland, 2260 Westedge: Understands that there is a meeting tomorrow night regarding the Westedge project. He feels he is greatly affected, as his neighbors are, but nobody received a notice. City Manager Hanson stated that a mailing list was purchased from Hennepin County and indicated that they were sent out notices. Weycker indicated that she did receive a notice. Rich Roberts, 2274 Westedge: Indicated he received no notice, either. Brown suggested that fliers be delivered to everyone affected, plus making phone calls. 4. TRUTH IN TAXATION Finance Director, Gino Businaro, outlined the 2001 budget, making a presentation covering budget amounts and allocation of tax dollars. Mayor Meisel opened the public hearing and asked for comments. The Mayor informed him that it is a whole different agency and has nothing to do with the storm water levy. Upon no further comments being heard, the public hearing was closed. Brown asked Businaro about the liquor store, always being profitable in the past, but now showing a loss. It was explained that liquor store operations are profitable, but after transfers of money to the general fund, a negative balance is shown. MOTION by Brown, seconded by Weycker to cancel the December 11, 2000, meeting that was previously scheduled to continue the public hearing. All ayes. It was noted that further budget discussion will take place at the December 12th Council meeting. 5. PUBLIC HEARING - STORM SEWER MANAGEMENT FEES City Manager Hanson reviewed the events that led to the need for storm water fees. There had been an open house held to answer the public's questions. The city's churches were the majority of the concerned parties. Mayor Meisel opened the public hearing. Rhonda Urech, representing Our Lady of the Lake Church, asked why this was being pushed through so quickly if there was so much disagreement. Some churches are listed as institutions, while others are schools. She asked where the classifications came from and the City Manager indicated that they were modeled after similar cities with similar situations. Rick Roberts, 2274 Westedge; questioned why this should apply to him because he lives on a dirt road and feels he shouldn't have to pay this tax. It was explained to him that when his area is developed, it will have storm sewers and the money collected will also be used for maintaining the system. Hanus added that the City thought this to be a simple, fair system. It creates better ground water conditions, better lake water conditions, and the community as s whole will be bettered by this plan. A representative from St. John's Lutheran Church appeared, stating that his church is also related to institutions, as Head Start, Kid's Corp, and the Senior Citizens, so the location is not strictly used as a church. He stated that St. John's has put two runoff ponds in, in the past two years. He appreciates the council reassessing the church issue. Mayor Meisel indicated that Mt. Olive Church had called her with the same concerns. Mound City Council Minutes - Dec, ember 4, 2000 Gary Pettis, 6200 Co. Rd. 26; indicated he is glad that the Council is reevaluating the churches. Bart Rovland, 2260 Westedge; added that nobody wants a new tax because they are overtaxed as it is. The Mayor stated that this is a fee, not a tax. Duane Norbert, 6015 Aspen: questioned what happened to the remainder of the revenue surplus. City Manager Hanson explained the bonding for the coming year, and future projects. City Manager Hanson suggested meeting with the churches on a one-to-one basis and establish what their hardcover content is, and where issues might be issued - like the ponds at St. John's. She added that the proper channeling of storm sewer water will also save on city streets and costs to maintain them. Mayor Meisel closed the hearing upon no further comments. Mayor Meisel expressed wanting to approve the rates, except for the churches, and to delay billing until the church issue is resolved. MOTION by Brown, seconded by Weycker to adopt the following resolution. All ayes. RESOLUTION NO. 00-115: RESOLUTION ADOPTING STORM SEWER RATES FOR THE CITY OF MOUND, MINNESOTA. 6. CASE #00-60: VARIANCE REQUEST - 4924 GLEN ELYN ROAD City Planner, Loren Gordon, reviewed the request by Franz Burris to modify a resolution and agreement from two years ago, directing him to have his garage torn down by March 1, 2001, Burris acknowledged the need to remove it, but is asking for an extension because of the weather and personal reasons. Hanus' concern is that this will start ongoing issues. MOTION by Weycker, seconded by Brown to adopt the following resolution. Those voting in favor: Weycker, Brown, Meisel. Those voting against: Hanus. Motion carried. RESOLUTION NO. 00-116: RESOLUTION GRANTING A REQUEST TO EXTEND A REMOVAL AGREEMENT ESTABLISHED BY RESOLUTION #98-136 TO REMOVE A NON-CONFORMING GARAGE AT 4924 GLEN ELYN ROAD, LOTS 5 & 6, BLOCK 23, SHADYWOOD POINT, PID 13-117-24 11 0081, P & Z CASE #00-60. ACTION APPROVING CHANGE ORDER FOR ASBESTOS ABATEMENT FOR COAST TO COAST DEMOLITION It was noted that the asbestos survey couldn't be done in time to include it in the bid when due. The bid couldn't be extended to wait for the bid because the needed to get started with demolition. Approval was also requested for soil borings in that area, in case they are needed when the building is removed. The total for the change order is $8850. MOTION by Weycker, seconded by Hanus to approve the change order as above described. All voted in favor. 8. DOCK AND COMMONS ADVISORY COMMISlON RECOMMENDATION FOR 2001 DOCK FEES It was noted that there are no dock fee changes recommended for 2001. Brown questioned having a fiat fee for docks, noting that others charge $100-$125/foot for a dock. Weycker feels that fees cold have been discussed earlier so that recommendations for raising fees could be completed. MOTION by Brown to raise dock fees an average of $50 across the board. Motion died for lack of second. Hanus noted that the Commission's recommendation was not to raise the fees., The Council can kick it back to them to reconsider, but can't be pushed back to them unless they are given some direction. Weycker wants to be noted on record that the Commission was advised not to give Council a recommendation. MOTION by Hanus, seconded by Brown to adopt the 2001 fees as recommended by the Dock and Commons Advisory Commission, which remain the same as last year. Those voting in favor: Hanus, Brown, Meisel. Those voting against: Weycker. Motion carried. Brown suggested that the Council and Dock and Commission get together to discuss this issue in a workshop environment so that this can be resolved for next year. 9. EXEMPTION OF GILLESPI SENIOR CENTER FROM PROPERTY TAXATION MOTION by Brown, seconded by Weycker, to adopt the following resolution. All ayes. RESOLUTION NO. 00-117: RESOLUTION APPROVING EXEMPTION OF CERTAIN PROPERTY FROM PROPERTY TAXATION At this time the Mayor requested a 10 minute recess. Mound City Council Minutes - December 4, 2000 10.
