Minnesota Baptist Assembly. ~he Planning Commission recommends this work.

WHEREAS Bruce Jarvey has applied to the Village fer permission to
construct a boardwalk on Cavan Lane adjacent to Lots 7,8
and 9, Block 25, Seton and to Seton Lagoon;
WHEREAS, it does appear to the Council that said boardwalk would be
an improvement and would benefit the public in general;
NOW, THEREFORE, BE IT MOVED that permission be granted for the said
boardwalk to be constructed and maintained at no cost to the
Village and expressly provided that the same be constructed and
maintained at all times in a safe and workmanlike manner.

That MIIII~ ~ of Ordinances, Chapter 26, Part D, entitled, *Building
0~e -- FA~J~g and Dewage Disposal Facilities" be amended as follows,
a. T~I% Slx%ion 26.64 (b) thereof be maanded to read as follows:

(10) feet from any drinking water supply line under pressure,
f~.~%een (15) feet from any building foundation, (4) ten (10)
any lot line, (5) fifty (%0) feet from any lake or stream,

Section 26.64 (J) thereof shall be amended to read as followsl
~lt~re a drainfield is used, a distribution box must be installed at
upper end of the field and connected to the septic tank by a
Il%er-tight sewer line.
'Xf a cealpool, it shall not be closer than ten (10) f~et to the
Ilptic tank and must be located in sandy or gravel soil, and the
btttom of the tank shall be not less than ten (10) feet above the
b/gh water table, and shall not be subject to flooding by surface
waters. The cover shall be not less than two (2) feet or more than
five (5) feet below the surface of the finished grade. The maximum
depth shall Be twenty (20) feet. But if the bottom of the tank is
more than ten (10) feet abeve the high water table, a grea~er depth
may be permitted by the inspector."
That Section 26.64 thereof be amended by adding thereto subsection
'"1" aa followa,
"No cesspool shall be installed except in gravel or coarse sand
having a minimum fall as establiabed bypercolation test of one
(1) inch per minute, and which strata shall have a !minimum depth
of four (4) feet."

"Effective absorption area of cesspool, defined as the side area,
~elow the inlet, exclusive of any hardpan, rock or Clay formations,
shall be at least 70 square feet per bedroom."
This ordinanae shall take effect from and after its adoption and publi-
cation according to law.

RiCHAP~D DlrERCKS PETITION
Richard Diercks appeared with several neighbors and complained about the noise
and disturbance caused by Three Points Tavern., A petition with ten names was
submitted to the Council supporting the ~omplaint. Mr. Roberb Braun owner of
the building supported the complaint, the petition is on file in the Village
Office.
No action taken.
BARNEY MADSEN - INSTALLATION OF CESSPOOL
Barney Madsen appeared with A1 Quello, attomney and A1 Lehman, Village Engineer
of Minnetonka Village. Mr. Madsen has requested the installation of a cesspool
in conjunction with t he septic tank in a house by installation of foundation and
septic system on a lot with a 50 foot front. The Planning Commission has
recommended that the Interim Zoning Ordinance be adoOted so that developmentm
such as this can take Place.

INTERIM ZONING ORDINANCE
The Village Manager was directed by the Village Council to give the Interium
Zoning Ordinance to the Lot Committee of the Planning Commission.

of resident use district A-1 and A-2 with uses and limitation as
defined in the proposed Interim Zoning Ordinance and with
substantially the same areas as proposed therein

A request was received from Mr. Hobert Smestad to put on a Fire Works display.
The Attorney explained a state permit with a $2.00 fee payable to the Village~
was necessary to comply ~ith the law.

received. She request was tabled until they comply ~ th the Ordinance.
1961 AUDIT 0 F VI LLAGE BOOKS
The c?nsideration of an auditor for the Village Books was considered for 1961;
with~Mr. George Hansen of George M. Hanson Company and RoBert Kraft interested
in ~eW~ork. The matter was tabled until Ju~ 27, 1961.
BUILDING ~PERMIT REFUND
On July 26~. 1960, Francis Murphy applied for a building permit and ~aid a fee of
$52.00. I'o date he has not started building and has requested the refund of
his fee.

RESOLUTION ORDERING IMPROVEMENT
AND PREPARATION OF PLANS
WHEREAS, resolution of the Village Council adopted the 16th day of May, 1961,
fixed a date for a Council hearing on the proposed improvement of
Commerce Boulevard (County Road #ilO) between the: northerly section
line of Sections 13 and lb, Township llT, Range 2~, and the easterly
extension of the southerly line of Grand View Drive,
All of Wenonah Road, All of Jones Road, All of Smaber Blvd.,
All of Dissner Lane, All of Meadow Street, All of Ridgewood Avenue,
All of Beacon Road, All of Hillside Avenue, All of Elm Street,
All of Navajo Road, All of Minnetrista Road, All of Enchanted Lane,
All of Ferncroft Lane, All of Crestview Road, All of Idlewild Trail,
All of Paradise Square, All of Sumach Street,
All of Tonkaurora Lane (Lane 1), All of Tonkahata Lane (Lane 2),
All of Tecumseh Lane (Lane 3), All of Titonka Lane (Lane ~),
All of Tiskilwa Lane (Lane 5), All of Swastika Lane (Lane 6),
All of Minnetowande Avenue (Minnetowande Lane),
All of Shadywood Blvd. as lies within the limits of the Village of Mound,

by installation of water main thereon and by construction of wells, pumps,

AND WHEREAS, ten days' published notice of the hearing through two weekly publi-
cations of the required notice was given, and at least ten days advance notice
by mailing a copy thereof to all owners as shown per county treasurer's
lists as of June l, 1961, and the hearing was held thereon on the 20th day
of June, 1961, at which all persons desiring to be hear~ were given an
opportunity to be heard thereon,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAG~ OF MOUND, MINNESOTA:
1. Such improvement is hereby ordered as proposed in the, Council resolution
adopted May 16, 1961, and specifically by installation of mains and laterals,
installation of pum~p, pumphouse and well, ~nd connecting said system to the
existing Mound water system.
2. Schoel & Madson are hereby designated as the engineer for this improve-
ment. They shall prepare plans and specifications for the making of such
improvement.
Adopted by the Council this 2Oth day of June, 1961.
Publications of notice of this hearing were displayed; having been advertised
on June 1 and jT~me 8, 1961 in the 2v~innetonka Pilot. /kll owners of record Were
notified by mail of the hearing.
Engineer Wm. Schoell outlained the proposed installtion of water mains, construction
of wells, pumps, reservoirs, tanks, treatment plants and other appurtenances.
He answered questions during the outline.
He stated that this system is all that is needed to get a sufficient supply of water to
all developable land in this three points area.
