AT THE MOUND VILLAGE OFFICE Present: Mayor Lsrson, Trustee Koehn, Trustee Heikkila, Trustee Pfeifer, Attorney Ploetz and Village Manager Kopp HOMESTEAD ORDINANCE Koehn moved and Heikkila seconded a motion ORDINANCE NO. 163 AN ORDINANCE PROVIDING FOR ANNUAL DECLARATION OF HOMESTEAD EXEMPTION THE VII.I.&GE COUNCIL OF MOUND, MINNESOTA, ORDAINS: 0 That the Mound Code of Ordinances be amended by adding thereto Chapter 18, entitled "Village Assessor". That the Mound Code of Ordinances be amended by adding thereto Section 18.05, as follows, to-wit: Section 18.05 Annual Declaration of Homestead Exemption. No person owning real property within the Village of Mound may claim "homestead" tax classification therefor for any year in which such owner has not filed proof by affidavit setting forth the facts entitling such owner to such homestead classification. Said proofs shall be filed with the assessor from January 1 to, and in- cluding May i for each year in which such homestead classification is claimed. The assessor shall provide suitable forms for the making of such proof. It shall be the duty of the owner claiming homestead classification to make timely filing, annually, of such proof. The assessor shall send forms for such proof to each owner having claimed homestead classification in the preceding year, to the address of said owner as shown on the County Treasurer's records. No further duty shall be on the assessor to see to the actual delivery of such forms. de The assessor shall remove from home- stead classification any property for which such proof is not filed for the subject tax year· 3. FRONT YARD SET-BACK REQUIREMENTS Heikkila moved and Koehn seconded a motion ORDINANCE NO. 16h AN ORDINANCE AMENDING CHAPTER 23, OF THE MOUND CODE OF ORDINANCES, ENTITLED "ZONING" THE VILLAGE COUNCIL OF MOUND, MINNESOTA ORDAINS: That Chapter 23, of the Mound Code of Ordinances entitled "Zoning" be amended by amending section 23.31 thereof to read as follows, to-wit: Section 23.31. Front Yard Set Back Requirements. In a block in the residential or multiple dwelling districts in which less than twenty five per cent of the total number of lots have permanent build- ings ~rected upon the% no building shall be erected which is set back from the front lot line less than a distance equal to thirty percent of the depth of the lot. If more than twenty-five percent of the lots in the block are built upmn, no building shall be erected which is set back from the front lot line less than a distance which shall be the average of the set back observed by the adjoining houses on either side. Reference to a "block" in this para- graph shall be construed to mean any one side of a street between two intersecting streets. a. In cases of lake shore frontage, the lake shall be considered as a front lot line in additicm to the front lot line established by the principal street. b. In no case shall a~set back of more than 60 feet be required unless specifically ordered by the Village Council. c. In the case of the corner lot, or any lot abutt- ing two or,more streets, or any lot situated on lake shore, the requirements hereof shall be construed to require a set back from the street lines on those sides of such lot upon which the adjoining buildings front, or upon which lots have been platted, and, the lake front. d. Garages may be excepted from the provision here- of by the building inspector provided: 1) the location of such garage does not create a blind corner for traffic upon the road, 2) the garage doors open to the side yard or the garage be set back a minimum of 20 feet if the garage doors open to the road, 3) increased off-street parking is provided, 4) such location does not block the view of the lake from neighboring property, 5) such location of the garage does not unnecessarily block angle of view, and 6) the requirements of section 26.06 sub. c have been met. SHOW GARAGE LOCATION ON BUILDING PERMIT ]~PPLICATION Heikkila moved and Koehn seconded a motion ORDINANCE NO. 165 AN ORDINANCE AMENDING CHAPTER 26, PART "A" OF THE MOUND CODE OF ORDINANCES ENTITLED "REGULATION OF ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSTION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS AND STRUCTURES." THE VILLAGE COUNCIL OF MOUND, MINNESOTA ORDAINS: That Chapter 26, Part "A", of the Mound Code of Ordinances, entitled "Regulation of erection, con- struction, enlargement, alteration, r~p~r, moving, removal, demolition, cony,ration, occupancy, equip- ment, use, height, area and maintenance of all buildings and structures" is hereby amended by adding to the provisions of section 26.06 sub-section "c" as follows, to-wit: Section 26.06, Building Permit, Application c Plat plan~ to show location of garage Every applicatimn for building permit in the residential or multiple dwelling district shall show on the accompanying plat plan or survey the location of any existing garage or the location of the garage proposed to be constructed by t~subject application. If no garage exists and no garage is proposed in the subject application, or, if the existing garage is proposed to be removed or demolished and not be~¢placed in the subject application, then the plat plan shall show the location reserved for the construction of any garage for which subsequent application may be made.
