1965-07-19MINUTES OF THE HEARING OF JULY 19~ 1965 at 8:00 P.M. at the Mound High School, Mound, Minnesota Present were: Mayor R. C. Koehn, Trustees Richard DeGuise, James Scruton, Del Pfeifer and Verno~ Brandenburg; Attorr~ey Raymond Ploetz, Manager Leonard Kopp, ~',~gineers William Schoell and Clarence Leer; Fiscal Consul- tant, ~rnie Clark Opening remarks by Mayor R. C. Koehn William Schoell s~oke on the cost of the project, outlining the the cause of the increase in the cost Clarence Leer explained the method of assessment Ernie Clark spoke about the financing of the project R~y Ploetz spoke of the rules and the rights of assessment Pfeifer moved and Brandenburg seconded the motion BE IT MOVED, the Village Council of the Village of Mound adopt the following rules: This meeting will remain in session until all complaints have benn heard. Either written or oral complaints may be filed All complaints shall be filed by the end of this session. All complaints written and oral will be taken under advisement and will be acted upon by August 9, 1965, at which time they may be reviewed by the public. On August 12, 1965 the Council will hold its final session bo accept the assessment roles. People will be heard in rotation, one row at a time, right to left. The vote was unanimously in favor so carried and adopted. The mayor set the rules of the meeting procedure: Anyone who would rather file a written compalint may at this time or throughout the evening do so at tables in the hall. An officer of the Village will accept the complaint. There will be no moving into rows ahead once we begin hearing complaints. ~Je will use police as Sargeat-at-arms to maintain order. We ask that others respect the person talking and refrain from ~uunecessary noise. Harry Eide Lots 6,7,8,9, and 10, Block 29, Wychwood Question: I have five lots. The units were reduced to two, but I am left with a strip of land 60 feet wide and 157 feet long. I am assessed along long side. I would like the 60 foot side to be the front. I have offered land to the Village for street purposes on front of 60 foot width. Council advised him to check with'Village Office after August 9th. Has filed written grievance. Fred Bethke Part Lot l, Sub 1-52 Skarp & Lindquist's Ravenswood I am assessed for 60 feet and the sewer does not come within 80 feet of my lot. (When Council asked if he would be served by a sewer, he said he would.) Council told him this was why he was assessed. Has filed written grievance. W. ~. Russell Lots 1,2,5, Halstead Park Has filed written grievance. Mrs. John Naab Lots 1-6, Block 10, Avalon Has filed written grievance. Frank B. Matachek Lots 6 & ?, Rearrangement of Block 7, S.H. "B" We were assessed for 55? feet because it goes in a circle. Has filed written grievance. Margaret Doyle Lots 1,2,5, Block l, Linden Heights I have three lots. I am charged $452.00 on Lot l, $452.00 on Lot 2 and a service charge of $64.05. Lot 5 is only 29.4 feet wide, yet I am charged $542.40 plus a service charge of $64.05. The two ~ervices are on the middle lot. If I were to build three houses, would I have permission? Has filed written grievance. Romeo Cloutier Prt Lot 10, ll, 12, 15 & 14, Block 5, Pembroke Water on wrong lot. Council referred him to Engineer for later study. Question: How would he be assessed for Lot 15, a corner lot? Engineer answered. Grivance filed. H. F. Conkey Lots 15-19, Block ll, Arden Question: I have 146 feet on the road, but the road runs northeast. This makes it 55 feet where it should be 50 feet; 146 feet where it should be 90 feet across. I am charged for feet. I am wondering if this is correct. On Lot "B" I am charged with 75 feet frontage. Across the street on Lot 19 in Block ll is swamp. The only solid ground there is what the Village has for right-of-way. I am charged with 120.8 feet and no place to put a sewer. Also, on Lots 12,15,14, Block ll, I am charged for 50 feet more than I bought. They charged me for three stubs when they only put in two. Grievance filed. Charles Sahmel Lots 5 & 12, Block 3, Shadywood Assessed for 120 feet - 60 feet on each lot. Objected to minimum, saying some states have outlawed it. Jack 0stvig Lots 22, 23, 24, 38, 39, ~0, Block 10, Pembroke House and garage on two ajacent lots and not enough room to build, so they put an extra service in the front. Also, shouldn't work be com- pleted? Has f~led written grievance. 21. Roger Nelson Block 10, Pembroke, Lots 31, 32, 33, 34 Is State-owned land assessed at the time it is sold? Council answered. 22. Edwin Ess Lots 2d & 25, Block 26, Wychwood ~e are buying the lot next to ours. We are charged two 80-foot minimums. Council told them to show prbof of ownership; has filed written grievance. 23. B. J. Malcheski Lots 23 & 24; 28-32, Aud. ~b. No. 168. Lot 28 is too small to build on. I paid'the unit charge of $292.00 on it but I don't think I should pay for the lateral. This is only a 35- foot lot and I am assessed for 40 feet. Alse, Lot 29 I am assessed as a separate lot. The only access to my house is on this lot. I would like to have someone come up and look at it. Has filed written grievance. Fred 01son - Odden & Co. Lot 29, Mound Shores I have a 50-foot lot on Dutch ~ke. Why should I pay for 80 feet. I am buying a service, but at this rate I am paying $15.00 a front foot. Has filed written grd. evance. 25. Chester Carleon Plat 61223, Parcel 1175 Question: Why did you go across the property? Mayor answered that in f~ture years the services would be used. Carlson said no plans to subdivide property. I am being charged for six services for one snmmer cottage. I am assessed for 475 feet when it would have been sufficient to rmn up to the line. Comncil said we are an expanding community and must look ahead~ Carlso said he is the sole owner (or hopes to be) and no one else needs to be served. Has filed written grievance. 26. Harry W. Olson Lots 13, 14, 15, 16, 17, 18, 19, 20, Block 10, Wychwood I am the fee owner of this property. Roger Riffe lives here and is buying the property. Lots 17, 18, 19, 20, which are 40 feet by 80- foot lots are back of Lots 13, 14, 15, 16 and should not be assessed. This is a swamp. The access to the premises comes through a driveway on Lot 19. The house sets on Lots 14 & 15. These people cannot possibly pay this assessment. The Council told him that there are f our buildable lots in the rear. Has filed written grievance. 27. Robert Byrnes Lot 10, Block 38, Wychwood Question: How is the Council justified in charging $5.5 million against $3.3 million estimated in 19627 I know it was explained at the beginning of this meeting. The Engineer explained as he had done in his opening 'remarks. 28. Eugene Hodge Koehler's 2nd Addition Front footage times the depth gives the square footage for the lot. Then 65 by 100 makes a total of 6,500. How can this lot be based on 10,000 square footage and charged on 80 feet? If perchance something should happen, can he get a variance? Council re-assured him on basis of Planning Commission recommendation he could. Has filed written grievance. 29. John Rosch Lots 13, 14, 15, 16, 17, 20, 21, 22, 23, Block 26, Wychwood I am charged for four units but it permits only three. When pipes were laid by Northern Construction they took my retaining wall. Has written grievance 30. 31. 32. Lee Greenslit Lot 5, Block I Halstead Acres There is a strip of land 30 feet wide (Outlot #l) which was assessed for one sewer unit. This was a mistake but we didn't find it. Now it is assessed for 80 feet. Has filed written grievance.' George Gerberding for Phil Gerberding Lot 6, Block 6, Woodland Point This property is land-locked - no road - no lateral. We paid for an easement for water over Lot 31. Now property has changed hands and we cannot get an easement for sewer, yet we have been assessed for one unit and for lateral of 60 feet. My home is 33. William Dixon Lots 15-18, Block 5, Pembroke My lot is 120 x 160. I have one house. I realize it can be split. I am charged for three services and need only two. 34. Gordon Tulberg Outlot #l in Halstead Acres This lot is owned by property owners in Halstead Acres. The Council asked him to turn in a copy of the deed for the Council to examine.
