F. Approve Public Gathering Permit for Liberty Triathlon (bike portion) on Saturday, June 8, 2013, with fees paid. 4C. Mark Wegsheid requested this item be removed for discussion and stated he would like more information from the LMCD on whether this program has been successful. Hanus stated permission was granted last year. Hanus said two where pointed out on his boat when he pulled it out and he found more when he removed it from storage. Hanus said that we would not want inspections to occur during the Spirit of the Lakes Festival. He asked what the noise level of the high pressure pumps were. Hanus invited Jay Green, Mound LMCD Representative, to provide his thoughts. Jay Green stated Surfside would have level 1 temporary hire inspectors and there would not be a level 2 wash station. Inspections would only occur on weekends. Wegscheid asked what the protocol was if AIS was found. Green stated they could give a temporary permit to go to a temporary wash station as it is against the law to transport AIS on roads. Level 1 inspectors are not able to stop infected craft from entering the water, but they are trained to call Level 2 inspectors, who are. Wegscheid asked to get together with Jay Green. Gillispie asked the typical inspection hours. Green estimated from 7:00 am — 4:00 pm. Salazar asked what AIS eat. Hanus stated the water clarity improves but keeping the eco- balance is the challenge. Salazar asked about impact on boats. Green stated zebra mussels get into the water intakes and cause problems and that the process to clean them out is difficult. Wegscheid asked if there are paints or metals that repel them. Green said studies are ongoing and that the results appear very situational. Hanus stated Lake Michigan is so clear the light infiltration is disturbing the plant life. Wegsheid stated that with the large duck population as potential spreaders of AIS, he questions whether the inspection effort is futile. Green recommended not focusing on zebra mussels and milfoil. Other threats are on the horizon and that with over 900K registered boats in Minnesota, relatively few lakes are infested, so he believes the program is having an impact. Ultimately, Green is concerned of a movement to privatize the lakes and he supports public access. The inspection process includes requiring boats to pull plugs when exiting lake, stickers were given out in the past, but now just logs are kept. Green is not aware of literature being handed out. Hanus asked how much is being spent on inspections and what percentage of boats are from the 4 patrolled launches in Lake Minnetonka compared to other lakes. Gillispie asked if the grants are renewed annually. Discussion ensued and Green stated MCWD covers '/2 the cost and that grants have been renewed. -1431- Mound City Council Minutes — May 28, 2013 Salazar asked how you get a fine? Green said an officer can pull you over for having plug in or having any AIS visible on the boat being trailered. MOTION by Wegscheid, seconded by Salazar, to table Item 4C until further information can be obtained. All voted in favor. Motion carried. 4D. Approve Vehicle Compliance Aqreement for Public Works Superintendent Rav Hanson Hanus explained history of policy and asked Hanson where he lives and what vehicle it is. The employee lives in Chanhassen and it is a Ford F150. Hanus pointed out agreement on Page 1349 last sentence. Hanus requested that sentence be clarified to tie de minimis use for only on the way to and from work. MOTION by Hanus, seconded by Salazar, to approve the Vehicle Compliance Agreement subject to the correction in the Language as stated. All voted in favor. Motion carried. 5. Comments and suggestions from citizens present on any item not on the agenda. Pamela Myers, President of the Westonka Historical Society Board, thanked Council and Staff for inviting them to reside at City Hall. Lindy Crawford introduced herself and stated she is working with the Fire Department updating policy and procedures. Hanus welcomed Crawford to the City. 6. Planning Commission Recommendation: A. Public Hearing — Planning Case No. 13 -18 Review of Conditional Use Permit Amendment - Local Government Buildings in R -1 District 2415 Wilshire Boulevard (PID No. 24- 117 -24 -21 -0034) (City Hall and Public Safety Campus) Recommendation: Approval with Conditions Smith provided an overview of the CUP Amendment. Smith stated the most significant change is that the Wilshire Boulevard parking will be changed from 3 parallel spaces to 7 angled parking spaces and an addition of canopy on north side that will be considered a secondary enterance. The Planning Commission reviewed the application at the May meeting. The Planning Commission questioned whether parking could be changed on Maywood Road. Staff recommends that be undertaken with the 2016 street improvement project if needed. Planning Commission noted that no bike rack is provided at either building. Planning Commission did recommend approval. Smith stated she has received no comments from public. Hanus asked for any discussion /questions from Council. -1432- Mound City Council Minutes — May 28, 2013 Mayor Hanus opened the public hearing at 7:59 p.m. and upon receiving no comment, closed the public hearing at 7:59 p.m. Hanus said the packet comments on signage were vague and he wants signage to be very clear. He likes the secondary access and angled parking. Gesch asked if the CUP covers changes on the interior. Smith stated CUP covers use. Moore stated all interior work quotes have been received. Hanson stated portions of the glass will be removed and grills will be added. Gesch stated at Police Commission meeting that the Police Chief was surprised that the City would remove barriers and that other cities are looking at adding security. Hanson stated other mitigating security measures have been added, including panic buttons and that staff is concerned about customer service. Hanus asked about bike racks. Hanson said other areas need to be evaluated like Surfside Park. Wegscheid asked about security with the lower level access. MOTION by Hanus, seconded by Gillispie, to approve the following resolution. All voted in favor. Motion carried. RESOLUTION NO. 13 -62: RESOLUTION APPROVING CONDITONAL USE PERMIT AMENDMENT FOR 2415 WILSHIRE BOULEVARD PID NO. 24- 117 -24 -21 -0034 Hanson gave Gene Hostettler credit for working as the architect on the project for mostly in -kind and his determination to get good pricing. Moving date is set for October 23rd and both locations will be closed. October 24th City Hall will be open in the new space. Hanson stated the move is being done by City personnel. receiving the same. Steve McDonald referred to the Management Letter and the required disclosures. The opinion was unqualified and there were no findings with regard to internal controls. Two new GASBs were implemented that dealt with terminology and summary classification of amounts. McDonald referenced General Fund fund balance. He stated the General Fund revenue is comprised of 81 % tax receipts, which is not very diverse. Peer Group per Capita comparisons of expenditures showed Public Safety was higher, but the rest were under. Ratio analysis shows the debt service coverage is less than 100°/x, which means other sources than cash are being used. Peer Group consists of cities with populations between 2,500 and 10,000. Hanus asked about if there was data on age and improvements on the cities. New accounting standards in 2014 will require some additional work for reporting on pensions. McDonald thanked the Council. MOTION by Hanus , seconded by Salazar, to receive the Annual Audit Report for 2012. All voted in favor. Motion carried. -1433- Mound City Council Minutes — May 28, 2013 Faulkner stated 5 bids were received and the low bidder asked to have his bid and bond removed due to significant errors in the bid. Options include rejecting all bids and to rebid in hopes for a low bid. Staff does not recommend that as they do not anticipate a lower bid. Second option would be to award to the low bid. The third option, which staff recommends, is to approve the request to return the low bid and award to the second low bidder. Hanus asked what the low bid was compared to the second low bid. Hanus asked why engineering estimate was below all the bids. Hanus is wondering if we have to rebid. Faulkner said it was across the board and that BMI used tower unit prices and that it is hard to find comparable projects. Hanus asked for impact on budget and Pausche stated it will be incorporated in the next rate increase discussion, but does not have an impact on the 2013 operating budget. Salazar asked about the mathematical error on the low bid. Hanus stated it appears we do not want to do business with this company. Moore stated the City is not able to negotiate the bid once received. Gesch said why engineers estimate is off $11 OK which is 30 %. Faulkner stated if they have to invest more time, it will cost the City more money. Hanus stated is it reasonable to expect bids to be lower or higher. Faulkner stated often higher. This is a free market and where the bids came in. There were savings in the street project to help offset. Hanus asked if the project was too small to interest bidders. Faulkner pointed out they got 5 bidders. MOTION by Hanus, seconded by Gesch, to adopt the following resolution. RESOLUTION NO. 63: RESOLUTION ACCEPTING THE WITHDRAWAL OF THE BID SUBMITTED BY NORTHDALE CONSTRUCTION COMPANY, INC. AND RETURNING THE BID BOND AND AWARDING THE CONTRACT TO THE SECOND LOWEST BIDDER, MINGER CONSTRUCTION, INC. Mr. Vogel owns the 4309 Wilshire property while Ms. Kolbeck has ownership in both properties. Boundary adjustments are eligible for administrative approval as provided by Sec. 121 -3 of the City Code. The applicants have also requested an expansion permit for both properties to allow for additions. The 4309 property is proposed to have a lakeside addition to accommodate a master bedroom and bathroom. The 4313 property is proposed to have a garage addition to accommodate a third stall and a building addition to include a connected workshop and utility room. Both lots have nonconforming lakehore setbacks. Details regarding the boundary adjustment and expansion permit applications are contained in the attached Planning Report. PLANNING COMMISSION MEETING REVIEW The boundary adjustment and expansion permit applications were reviewed by the Planning Commission at its June 4, 2013 meeting. In general, the Planning Commission was favorable to the submitted expansion permit applications. Discussion took place about the 40 percent hardcover allowance for the reconfigured lots. Presently, both lots are over the maximum allowed for a lot of record. As a result of the boundary adjustment, 570 SF of hardcover is being removed from the 4309 parcel. However, additional hardcover needs to be removed from the 4313 parcel to meet the 40 percent hardcover and was included as a condition of approval. Possible areas where hardcover can be reduced includes imperious pavers removal in the area of the driveway and front of the house and replacement with a pervious product. The applicant also inquired whether the inc'i444 -)f a rain garden, which is being contemplated, could be considered as alternative to the 40 percent allowance. Staff mentioned that the tool for such an evaluation would be a variance and would need to be done separately as it is not requested as part of the current applications. Based on its review, the Planning Commission unanimously voted to recommend approval of the requested expansion permit applications for 4309 and 4313 Wilshire Boulevard subject to conditions. Resolutions for approval of the expansion permit applications have been prepared for consideration by the City Council. -1445- MINUTE EXCERPT JUNE 4, 2013 Chair called the meeting to order at 7:01 pm. Smith indicated that there were two products approved by staff. They both provide 85% reduction and require inspections certifying as -built installation. Linkert asked about the minimum construction elevation. Smith said the new construction will meet the required 933 elevation. Gary Vogel (applicant) asked the commission if a rain garden straddling the property line between houses would work in lieu of the paver option. Smith indicated that such a swap was not a likely option in connection with the expansion permits under consideration. Linkert commented that he liked the idea of a rain garden but was concerned that a new property owner would not like it. Gawtry said it would likely be assured through a conservation easement. Retterath appreciated the idea of keeping the pavers as is since they are in good shape. -1446- MOTION by Bergquist, second by Wiechert, to approve the expansion permit for 4309 Wilshire Boulevard with conditions 1 through 13. MOTION carried unanimously. MOTION by Linkert, second by Bergquist, to recommend approval of the expansion permit for 4313 Wilshire Boulevard with conditions 1 through 13 and findings of fact 1 through 6. Minnesota Statutes 645.15 sets forth the procedures for determining "Day 1" for the purpose of application of the 120 -day rule. It was determined to be April 30, 2013. Therefore, the City's deadline for action on the expansion permit application is on or before August 26, 2013. BOUNDARY ADJUSTMENT The applicants are requesting a boundary adjustment that would move the existing lot line between the two structures generally northeast, or closer to the home at 4309. Rather than being straight, there will be a slight kink in the lot lines near the street -side corners of both structures. This kink is partly the result of the slightly different alignment to the street of the two homes on their properties. Review Criteria The adjustment of lot lines is governed by the regulations contained in City Code Section 121 Subdivision Regulations. Section 121 -33 specifically addresses minor boundary adjustments as follows: "The relocation of a boundary line between two abutting, existing parcels of property; such relocation not causing the creation of a new parcel or parcels and such relocation not violating the zoning ordinance set out in Chapter 129 may be administratively approved by the city and shall be submitted in a form so as to allow for recording at the county. At the discretion of the city, a survey may be required. Should the city determine that the relocation of a property boundary may have an adverse effect on either property or may circumvent applicable zoning requirements, the city may require the boundary adjustment to be processed as a subdivision exemption with Council approval as provided for in subsection (3) or as a minor subdivision in accordance with the process as set forth in Sec. 121 -61. Approval of a minor boundary adjustment shall not disqualify the involved parcels from "lot of record" status." Discussion The applicants are proposing to move the boundary line closer to the home on 4309. This will result in a transfer of approximately 863 square feet from the 4309 property to the 4313 property. Both properties will remain significantly larger than the minimum 6,000 square feet required in the R -1A zoning district and have lot widths greater than 40 feet. According to the survey, all sideyard setbacks related to the line being adjusted will remain sufficient in size. As a result of the boundary line adjustment, the amount of hardcover on each property will be modified. While not specifically identified, it is Staff's understanding based on the materials submitted that an examination of the boundary adjustment shows that the percent hardcover on the 4309 property will increase from 40.4% to 44.5% solely based on the lot line moving. At the same time, the percent hardcover on the 4313 property will decrease from 43.4% to 39.2 %. The applicant has indicated that 570 square feet of the hardcover on the 4309 property will be removed as part of the future projects. This will drop the hardcover percentage for the 4309 property to 40.0 %. -1457- As noted in the City Code citation above, the boundary line adjustment can be done administratively if it is determined that the proposed adjustment does not violate the Zoning Code. It is Staff determination that existing conditions, such as the reduced setback to the ordinary high water level, that do not change as a result of the boundary line adjustment are acceptable. However, any conditions that change as a result of the boundary line adjustment need to be in conformance of the Zoning Code. This includes both the sideyard setbacks and the percent hardcover for the sites. Staff is planning to approve this administratively as long as the applicants agree to eliminate the 570 square feet of hardcover on the site to bring the 4309 property into conformance with the 40% hardcover maximum. Staff is not requesting a motion from the Planning Commission at this time. See also "4313 Expansion Permit Application" section on Page 4 of the Planning Report for information regarding existing /proposed hardcover. 4309 Expansion Permit Application The applicant has requested the ability to add a 186 square foot addition onto the southeast corner of the house. The 11.9 by 15.6 foot, one -story addition will fill in the corner of the house and contain a master bedroom and bath. The request is an expansion permit as the existing home is already nonconforming as it is constructed within the 50 foot setback to the ordinary high water line. This addition will extend no further than the existing building line located 21.2 feet from the ordinary high water level. Review Criteria City Code Section 129 -40 (a) states that an expansion permit for a nonconforming structure may be issued when the City Code imposes practical difficulties for the property owner in the reasonable use of a property. The following are the criteria that should be satisfied: (1) the proposed expansion is a reasonable use of the property considering: a. function and aesthetics of the expansion. b. absence of adverse off -site impacts such as from traffic, noise, odors and dust. c. adequacy of off - street parking. (2) exceptional or extraordinary circumstances justifying the expansion are unique to the property and result from lot size or shape, topography, or other circumstances over which the owners of the property since enactment of this chapter have had no control. (3) the exceptional or extraordinary circumstances do not result from the actions of the applicant. (4) the expansion would not adversely affect or alter the essential character of the neighborhood. (5) the expansion requested is the minimum needed. -1458- PROPOSED DIMENSIONS* *dimensions after boundary adjustment complete Expansion Permit 28.8 feet DISCUSSION This property is a one- story, slab on grade home that has a foundation 1,760 square feet in size including a two -car garage. As noted previously, the existing hardcover percentage of 43.4% was proposed to be reduced to 39.2% as a result of the boundary adjustment. It is Staff's recommendation that the hardcover percentage for the site should remain at or below 40 %, particularly since construction is already taking place within the 50 foot shoreline setback area. There are areas of impervious surfaces, particularly in the front of the property, which could be modified so as to reduce the site's overall hardcover percentage. Bringing the hardcover within the 40 percent on the 4313 property was discussed with the applicant. Hardcover Analysis The applicant has subsequently indicated that there will be some modifications to the grading and drainage between the properties. There is approximately a one foot difference between the grades of the two properties, with the 4309 property being slightly higher. With the movement of the property lines and the proposed additions, the applicants are in the process of determining how best to handle drainage on the site into the future. Under consideration are a swale, raingarden, or underground drainage line. The City Engineer has been informed of these plans and requested as a condition of approval that all grading and drainage plans be approved by the City prior to construction. It will be up to the Planning Commission and City Council to determine whether they are in agreement with that assessment. In recommending approval for the expansion permit, Staff recommends that the following conditions be included: 1. The boundary adjustment is approved. 2. Applicant shall be responsible for payment of all costs associated with the land use request. 3. No future approval of any development plans and /or building permits is included as part of this action. 4. Applicant shall provide all required information upon submittal of the building permit application. 5. Approval of grading and drainage plans by the City Engineer. -1463- 6. Applicant is directed to contact the MCWD related to the new regulations and applicable permits that may be needed to undertake the proposed project. Evidence from the MCWD in the form of a permit or waiver must be provided before release of any future building permit. In recommending Staff approval, the following findings of fact are offered: 1. The criteria of City Code Section 129 -40 (a) are being met. The proposed expansion of the home is a reasonable use of the property. 3. The expansion permit is requested due to existing site characteristics that were not created by the applicant, including but not limited to the size and shape of the lot. 4. The expansion of the residential home will be in character with the surrounding neighborhood. . lt , A significant portion of the property is located within the 50 foot setback to the ordinary high water level (OHWL). Contractor Amount Bid Michels Corporation $196,663.00 Insituform Tech USA $218,920.00 Lametti and Sons, Inc. $224,700.00 Veit & Company, Inc. $242,700.00 This project has been approved by Metropolitan Council Environmental Services (MCES) as part of their Municipal Inflow and Infiltration Reduction Grant Program. The approved grant covers 25 percent of the construction cost up to the maximum approved grant amount of $74,301. This amount was determined from our initial grant submittal request for this project estimated to cost $303,720. Since the low bid is well below this amount, staff will identify additional sanitary sewer pipe that is in need of lining and add it to this project, subject to the approval of MCES. This will allow the City to take full advantage of the approved grant amount, The contractor, Michels Corporation, out of Brownsville, WI, has successfully completed several similar projects including the 2011/2012 Mound Pipe Lining project. At this time, the contractor has indicated this will be a Fall season construction project. At that time, all affected residents will receive notice of the impending work. It is our recommendation that the Council approve the attached resolution awarding the 2013 Sanitary Sewer Rehabilitation project: to Michels Corporation in amount of $196,663.00. T `t n;11 1 -1514- June 4, 2013 Kandis Hanson Mound City Manager 5431 Maywood Road Mound, MN 55365 -1687 Kandis, The following is the additional information regarding the LMCD's watercraft inspection program requested by the city council at the May 28th council meeting. (Watercraft Inspection Program) The 2013 watercraft inspection program is virtually identical the 2012 program. The LMCD coordinates the staffing of inspectors at four public accesses (Carsons, Cooks, Halsteads and Wayzata) from Memorial Day through Labor Day. The coverage times will be 11am - 7pm on Fridays, and 6am - 6pm on Saturdays, Sundays and Holidays. I have attached a chart of the coverage matrix for these accesses. You will notice that there are no hours scheduled for the Cooks Bay access during the Spirit of the Lakes Festival. The program costs for 2013 break down as follows: Level 1 Inspectors $34,524.00 Supervision $2,016.00 Training $1,575.00 Other $5,000.00 Total $43,115.00 These costs are the same as 2012 with the exception of the additional $5000. This would be used to purchase tablets that the inspectors would use during the inspection process. The DNR has eliminated the use of the older PDA devices. They have developed a new dynamic tablet application which asks specific questions of the boater, and based on the answers given, additional questions may be asked. The data collected in the tablet is automatically uploaded to a secure server once the tablet is within Wi- Fi range. The goal is to be able to collate all the DNR inspection data along with the data collected from inspection programs such as ours so that we can get a more accurate picture of inspection coverage and compliance rates statewide. However, after much discussion, the LMCD Board has chosen not to purchase these tablets at this time and will continue to collect data on paper forms and have those keyed into the DNR system. The program funding currently is as follows: MCWD Grant $21,577.50 DNR Grant $7,750.00 LMCD $13,807.50 Total $43,115.00 1515- The final amount of the MCWD grant would be 50% of the actual program costs. If we do not purchase tablets, the program cost would drop back to $38,115, thus the MCWD grant would drop to $19,507.50 and the LMCD portion to $11,307.50 1 have also included the 2012 Lake Minnetonka Watercraft Inspection Program Summary Report. In it, you will see the breakdown of the DNR's inspection coverage around the lake. It also includes information on what duties the inspectors may perform. For Cooks Bay, the DNR provided additional level 1 and level 2 inspectors at times not covered by the LMCD program. The presence of the decontamination unit last year would have occurred when level 2 inspectors were on duty. Given that the LMCD is only contracting for level 1 inspectors, no decontamination unit would be used at Cooks Bay, however, the DNR may choose to cover that access on occasion as it did last year. Based on the council's concern over the noise from the decontamination unit, I have asked the DNR how we can officially request to not have it used at that access. [Boat Launches through Public Access] In 2010, the DNR conducted a study to determine how many boats were launched at each public access. Of the 62,112 records launches, 2,799 occurred at the Cooks Bay access, or about 5 %. 1 have attached the complete study results for your perusal. [My thoughts on the inspection program] The current cornerstone of the DNR's AIS prevention strategy is its watercraft inspection program. The LMCD was one of the first local government units to conduct its own program to augment the DNRs coverage. This model is being replicated and encouraged across the state. I see the inspection process as a means of hands -on education. It creates awareness for those who are "unaware" and it helps to reinforce good boat "hygiene" practices. While there are those who would rather resort to more draconian measures (gates at accesses, watercraft confiscations, quarantine, etc), I think we'll achieve better compliance and change in boater behavior with emphasis on education rather than enforcement. As an angler who fishes Minnetonka and many other bodies of water, some infested, some not, I wouldn't be much of a sportsman if I didn't care about the health of our lakes and rivers. Many anglers find milfoil to be great fish habitat but other lake users (sailors and skiers for instance) may have a different opinion. Now the concern turns to zebra mussels and what the long time effects will be. We don't know that answer yet, and we'll learn to adapt to their presence, but like milfoil, we may find the management costs to our communities significant. We've spent over a half million dollars just in the past 5 years on milfoil management alone. And that doesn't include what individual residents have invested in vegetation control. Not getting an infestation in the first place should be the priority. And while it may be too late for Minnetonka for these two invasives, let's not get complacent and just not care anymore. We also have a responsibility to the environment and we don't need to be facilitating the dissemination of invasives out of Minnetonka. The only real way we'll ever prevent invasives from being transferred is through education and personal responsibility. This means we have to change people's attitudes and behaviors when they enter and leave the lake. It's not that hard to pick off weeds and pull the plug. The alternative will be that some lake associations and communities will attempt use the threat of AIS infestations to move toward privatization of our lakes and that simply cannot be allowed to happen. -1516- I launch all over the state about 80+ times are year. Having someone ask me the same questions and look over my boat is rarely an inconvenience. And for someone, that inspection experience did make a difference! Respectfully submitted, Jay Green LMCD Board Representative - Mound (612) 817 -6388 -1517- 01 1 Inspection F' Summary Report Partner Organizations: October 10, 2012 fil El N Prepared By: Greg Nybeck, Executive Director Lake Minnetonka Conservation District 23505 Smithtown Road (Suite 120) Shorewood, MN 55331 7 f1 ,' il '7 PARK DISTRICT INTRODUCTION The Lake Minnetonka Conservation District (LMCD) coordinated a watercraft inspection program on Lake Minnetonka during the 2012 boating season. The two primary goals of this program were to: 1) inspect incoming watercraft/trailers, as well as educate watercraft owners and operators, to assist in preventing the introduction of new aquatic invasive species (AIS) into Lake Minnetonka, and 2) inspect outgoing watercraft/trailers, as well as educate watercraft owners and operators, to assist in preventing the spread of zebra mussels from Lake Minnetonka. This was a cooperative effort of the LMCD, Minnehaha Creek Watershed District (MCWD), Minnesota Department of Natural Resources (MN DNR), and Three Rivers Park District (TRPD). METHODOLOGY Nine of the 11 designated public accesses on Lake Minnetonka were covered as part of this program. The remaining two designated public accesses were not covered for the following reasons: 1) City of Minnetrista- Phelps Bay (there are only 4 designated car /trailer spaces), and 2) City of Tonka Bay- Echo Bay (there is no parking lot and on- street parking of car /trailer spaces is prohibited east of County Road 19). The following nine designated public accesses were covered in 2012: 1. City of Deephaven (Carsons Bay); 2. City of Minnetonka (Grays Bay); 3. City of Minnetrista (Halstead Bay); 4. City of Mound (Cooks Bay); 5. City of Wayzata (Wayzata Bay); 6. Hennepin County (North Arm); 7. Hennepin County (Spring Park Bay); 8. MN DNR (Maxwell Bay); and 9. TRPD- W. Upper Lake (Lake Minnetonka Regional Park). There were three different watercraft inspection components. These included: 1) MN DNR, 2) LMCD, and 3) TRPD. Further background of each component is detailed below. WATERCRAFT INSPECTION COMPONENTS MN DNR: In 2012, the MN DNR conducted Level 1 and 2 watercraft inspections on Lake Minnetonka (at no cost to the Lake Minnetonka community). In general, these Level I and 2 watercraft inspectors may: 1) inspect watercraft for plants, other aquatic invasive species (AIS), and water; 2) notify a licensed peace officer of alleged AIS violations; 3) deny a launch or use of Lake Minnetonka when deemed appropriate; and 4) require actions for problematic watercraft (i.e., remove plants, remove other AIS, or drain water). However, there are two additional authorities provided to Level 2 inspectors. First, Level 2 inspectors may visually and tactilely inspect the inside and outside of a watercraft (Level 1 inspectors may only inspect the outside of a Page 2 of 5 -1519- watercraft). Second, only Level 2 inspectors may conduct decontamination efforts when deemed necessary and appropriate. Level 1 and 2 inspections conducted by the MN DNR during peak times generally focused on the Grays Bay, Maxwell Bay, North Arm, and Spring Park Bay public accesses. Inspections conducted during non -park times included coverage at the majority of all Lake Minnetonka public accesses. Level 1 and 2 watercraft inspection hours conducted on Lake Minnetonka in 2012, as reported by the MN DNR to date, are as follows: Public Access Level 1 Level 2 Total Hours Carsons Bay 80.50 26.75 107.25 Cooks Bay 214.00 111.25 325.25 Grays Bay 975.25 977.75 1,953.00 Halstead Drive 60.00 0.00 60.00 Lake Mtka Regional Park 236.75 118.00 354.75 Maxwell Bay 702.00 834.25 1,536.25 North Arm 720.25 540.00 1,260.25 Phelps Bay 42.75 0.00 42.75 Spring Park Bay 825.00 588.50 1,413.50 Wayzata Bay 92.50 0.00 92.50 Total Hours: 3,949.00 3,196.50 7,145.50 ( *) The MN DNR has also reported an additional 836.50 hours for travel time for Level 1 and 2 inspectors. LMCD. The LMCD contracted with Volt Workforce Solutions (Volt), from Memorial Day weekend through Labor Day, to conduct watercraft inspections at four public accesses on Fridays (11 a.m. to 7 p.m.) and Saturdays, Sundays, and Holidays (6 a.m. to 6 p.m.). These public accesses included: • City of Deephaven (Carson Bay); • City of Minnetrista (Halstead Bay); • City of Mound (Cooks Bay); • City of Wayzata (Wayzata Bay); and • As a substitute to the North Arm and Spring Park Bay public accesses when the MN DNR was unable to provide inspector coverage. Total contracted hours with Volt was 2,420, with 2,192 hours for inspections and the remaining 228 hours for training and supervision. Volt has invoiced the LMCD for 2,464 hours. There were two situations where Volt provided watercraft inspectors outside of the contract duration. First, Ron Schara hosted a Crappie Fishing Tournament on May 5th. During this event, 36 hours of watercraft inspections were conducted by Volt at the contracted public accesses for incoming and outgoing watercraft. This effort was complimented by Minnesota B.A.S.S. Federation volunteers and the MN DNR. Second, watercraft inspections were expanded after Labor Day to Page 3 of 5 -1520- include September 8th, 9`h, 15th, and 16th. This resulted in 192 hours of additional watercraft inspections. In 2012, there was an approved joint powers agreement (JPA) between the LMCD and MN DNR that authorized Volt watercraft inspectors. The JPA authorized Volt watercraft inspectors as Level 1 inspectors, whereas, Volt inspectors in 2010 and 2011 were classified as "volunteers ". The MN DNR provided a series of training sessions and 13 Volt inspectors were approved as Level 1 inspectors in 2012. TRPD: The TRPD provided an in -kind contribution to this program through gate attendants inspecting incoming watercraft/trailers at the Lake Minnetonka Regional Park. Weekends were covered from 9 a.m. to 5 p.m. prior to the Memorial Day weekend, with seven day a week coverage from Memorial Day weekend through Labor Day. These gate attendants were conducting inspections similar to the MN DNR and LMCD, which included educational and inspection components. Estimated in -kind hours contributed to this program were 1,000. This partnership has worked well and the LMCD hopes that it can continue in the future. FUNDING SOURCES There were three primary funding sources for this program in 2012. First, the MCWD provided a contribution of $7,500. Second, the MN DNR provided $7,750 of grant funds. Third, the LMCD budgeted $30,000 of AIS Management Funds. The LMCD greatly appreciates the financial contribution to this program by the MCWD and the MN DNR, as well as the in -kind contribution by the TRPD. SUMMARY A number of initiatives took place in 2012 relating to education and other AIS efforts. A summary of these initiatives include: Prior to the 2012 boating season, the MN DNR and Minnesota Waters educated and trained lake service providers as required by state legislation adopted in 2011. Training sessions were coordinated locally at the University of Minnesota Landscape Arboretum and Tonka Bay Marina. A database of local lake service providers, which the LMCD established in 2010, was a key contributing factor to this project. Joint educational press releases of the LMCD, MCWD, and MN DNR were coordinated in the spring and fall educating the general public on this new legislation and urging residents to use MN DNR certified lake service providers. Prior to the 2012 boating season, the LMCD introduced the Volt watercraft inspector arrangement with other public sector organizations. In 2012, Volt expanded its watercraft inspection services to Carver County, the Cities of Chanhassen and Eden Prairie, Lake Pulaski Improvement District, Minneapolis Park Board, and MCWD. Page 4 of 5 -1521- The inspection of incoming and outgoing watercraft should continue in 2013 on Lake Minnetonka. However, the LMCD Board of Directors needs to discuss the future role of the agency in how these inspections are funded. Two possible options include the following: 1. The LMCD could continue to take the lead on this project. Since the early 2000's, the LMCD has partnered with the MCWD, MN DNR and TRPD. All totaled, the LMCD has invested over $250,000 on watercraft inspections. One possible funding source in the adopted 2013 LMCD Budget is a $30,000 line -item for unspecified AIS management and prevention projects. 1 The LMCD could allow another public sector agency to take the lead on watercraft inspections in 2013. In particular, since the primary goal of the LMCD's efforts was to prevent the introduction of zebra mussels. One alternative for the $30,000 line -item is to spend all (or part) of these funds on whole bay or large scale herbicide treatment projects. Page 5 of 5 -1522- Boat launches through public accesses on Lake Minnetonka from mid -April to mid - November, 2010 This study was a cooperative effort of the Lake Minnetonka Conservation District and the Minnesota Department of Natural Resources Report prepared by: Tim Kelly MN DNR, OMBS Draft—November 23, 2010 -1523- Purpose The propose of the study is to measure the use of Lake Minnetonka public accesses during the full open -water boating season, extending from mid -April to mid - November. In the past, public access use was measured by aerial observation on a limited number of days, and the observations covered only summer afternoons. This study extends the seasonal coverage to the spring and fall, and extends the time of day coverage from afternoons to the full day (7 AM to 8 PM). Study results will be useful for allocating the effort of on -site access personnel, who work to minimize the movement of exotic species into and out of Lake Minnetonka. Methodology The study covered the open -water boating season from mid -April (April 17, a Saturday) to mid - November (November 14, a Sunday). The study involved counts by a field person of boats launched at 9 of the 10 public access sites; one small access site (Code A09) was excluded. At an access site, the field person counted the number of empty trailers, and trailerless car - toppers /pickups that appear to have launched a boat. Boats on trailers (or on car - toppers /pickups) were not counted as a launched boat. A01 Carsons Bay Access (City of Deephaven) A02 Cooks Bay Access (City of Mound) A03 Grays Bay Access (DNR / City of Minnetonka) A04 Halstead Drive Access (City of Minnetrista) A05 Lake Mika. Regional Park Access (Three Rivers Park Dist.) A06 Maxwell Bay Access (DNR) A07 North Arm Access (Hennepin County) A08 Spring Park Access (Hennepin County) A09 EXCLUDED: Tuxedo Blvd. Access (City of Minnetrista) A10 Wayzata Bay Access (City of Wayzata) During each week of the study, one sample weekday and one sample weekend day were chosen at random for counting the 9 public accesses. On each sample day, one time of day was chosen at random for the counts; the times of day are: early (7 to I I am), mid -day (I I am to 4 pm), and late (4pm to 8pm). The sequence of counting the accesses was varied at random to ensure that an access site was not always counted first or last. In the Fall, the early and late time periods were shortened for the later sunrises and earlier sunsets. Draft— November 23, 2010 -1524- A total of 61 counts were made at each access site during the study. This level of sampling is designed to produce a 95% confidence interval that is within +/- 20% of the overall estimated value, a common design criterion for MN Department of Natural Resource studies of this type. For example, if the overall estimated value is 100, +/- 20% is the interval from 80 to 120. Results Lake Minnetonka Conservation District staff conducted the field work for this study. Staff carried out all 61 counts on the date and time of day that are specified in the sampling plan. The estimated number of public access launches for the open -water boating season is 62,112 (Table 1). Most of the launches (68 %) occur during the summer, followed by the fall (20 %), and spring (12 %). Fall has more launches than spring simply because fall is longer. Note that the fall and spring have a similar number of launches per day (173 to 180). The summer has more than double the daily launches of the spring and fall. Weekend /holidays account for just over half of the launches (53 %). On a daily basis, weekend/ holidays have 2.5 times as many launches. The access with the most launches is Grays Bay (33% of total), followed by Maxwell Bay (22 %), North Aim (10 %), and Spring Park (9 %). The other five accesses account for 25 percent of launches. As noted above, the sampling level was designed to produce a 95% confidence interval within +/ - 20% for the overall launch estimate for the open -water season. The actual 95% confidence was +/- 21 %, which means the design criterion was roughly met. The variability in access use was underestimated going into the study. In the past, public access use was measured by aerial observation on summer afternoons. From these aerial observations, estimates were made of total summer launches by access. Those summer estimates are not that far off from estimates in this study, which provides some confidence to the extrapolation techniques used in earlier years (Table 2). The extreme closeness of total summer launches for the two estimates (bottom of Table 2) should be considered fortuitous, and should not be expected to occur regularly. Nybeck, EXECUTIVE DIRECTOR Ms. Kandis Hanson City of Mound 5341 Maywood Road Mound, MN 55364 Dear Ms. Hanson: During the 2013 boating season, the Lake Minnetonka Conservation District (LMCD) will be coordinating watercraft inspections at selected public accesses on Lake Minnetonka. This program, which commenced in the early 2000's, has been used to prevent the introduction of new aquatic invasive species (AIS) into Lake Minnetonka by inspecting incoming watercraft. More recently, the program has diversified into also targeting outgoing watercraft to prevent the spread of AIS (in particular zebra mussels) from Lake Minnetonka. Similar to the past boating seasons, the LMCD has contracted with Volt Workforce Solutions (Volt) to conduct these watercraft inspections from Memorial Day weekend through Labor Day. Inspections will be conducted Friday through Sunday and on holidays. See the attachment for further details on this project. One of the public accesses targeted for watercraft inspection is Cooks Bay. Therefore, the LMCD is requesting your signature on both copies of the attached Right of Entry Authorization for Watercraft Inspections form for the purpose of allowing Volt employees to conduct the inspections. Would you please sign both copies and forward one original to the LMCD office in the self- addressed, stamp envelope provided. As always, the LMCD appreciates your effort in this regard. As part of the public hearing, discussion took place on a number of issues including but not limited to, the height of the West Area Maintenance Building, exterior storage, typical site operations and buffering the adjacent residential uses. The Council tabled action to an upcoming meeting to allow the applicant to respond to questions and comments heard at the public hearing. Staff was also requested tc research and respond to the questions brought up about maintenance activities in the street related to pumping into manholes and the future reconstruction on Westedge Boulevard. ADDITIONAL INFORMATION Modified Plan. A modified elevation drawing of the West Area Maintenance Building was submitted to the City on May 21, 2013 and shows removal of the clearstory and the addition of dormers on the west and east elevations. The submitted graphic shows the total height of the building at 35 FT from the 944.0 elevation to the building top. According to Mound's code, the building height on a hipped roof is measured from average grade to the mid -point of the highest roof. -1531- MCES Response to Comments from May 14th meeting. A detailed memorandum in a Q &A format was prepared by the MCES to respond to comments heard at the May 14`h public hearing. The applicant has indicated that the proposed elevation of the building has been lowered 11/5 feet which was a suggestion heard at the meeting. The original site plan included the planting of 16 evergreen trees. The MCES has not submitted a revised landscaping plan but has expressed their interest in working with City staff for development of an appropriate screening /fencing program to mitigate visual impacts including the the possible use of a berm and are also open to the type of fence to be installed (i.e. privacy fence, chain link with slats, etc.) Maintenance Activities and Schedule for Future Westedge Improvements. See below comments from Public Works Director Carlton Moore related to maintenance activities and the tentative schedule for reconstruction of Westedge Boulevard: • The City of Mound has a vacuum truck, commonly referred to as a vac truck, for cleaning out storm sewer catch basins, sewer manholes and sanitary sewer lift stations when needed. The machine vacuums out the material and puts it into the holding tank on the truck. When the holding tank is full the sanitary material is dumped into the sanitary sewer at the manhole in front of the MCES facility on Westedge Boulevard. • City staff contacted the supervisor of the MCES sewage transfer station on Westedge Boulevard about the usage of the manhole in the street for dumping. The MCES crews have not used the manhole for two years or more and no other cities use this location for dumping except Mound. Mound crews use this approved location approximately one to three times per week when we are in our heavy cleaning season. During this time we are using it during work hours. There have been a few times when we have had late night sewer backups that we have dumped into this manhole. According to the supervisor, the current plans do not include relocation of the dump manhole. The MCES also has a delivery once a month from a semi truck which unloads chemicals for odor control. This truck typically takes two hours to unload and it is only done during normal working hours. MCES staff must be at the facility at all times when these deliveries are made. • The proposed facility plans do not include any construction in the street. The reconstruction of Westedge Boulevard is tentatively schedule on the City plans for 2017. The City has intentionally left this as one of the last street projects in order to coordinate street construction with MCES plans for the reconstruction of their forcemain from their facility south to Bartlett / County Road 110. • Residents also asked for a contact person during the project. At this time the MCES has not indicated who that might be. We did inform them they need to be proactive in informing the area residents about the project, timing and contact information. MCES has agreed with our request. -1532- Neighbor Correspondence. See attached letter and email that were received following the May 14`h public hearing. RESPONSE — THIS FACILITY SERVES AS A BASE OF OPERATIONS FOR A CREW THAT PERFORMS MAINTENANCE ON THE LIFT STATIONS, PIPES AND OTHER FACILITIES PROVIDING SANITARY SEWER SERVICE TO THE LAKE MINNETONKA AREA. THIS SERVES AS AN OFFICE /LOCKER/SHOWER AREA, LIGHT MAINTENANCE OF COLLECTION SYSTEM COMPONENTS, MINOR VEHICLE AND SMALL ENGINE AND -1534- OTHER EQUIPMENT MAINTENANCE. IT ALSO FUNCTIONS AS A STORAGE AREA FOR VARIOUS EQUIPMENT ITEMS NEEDED FOR SYSTEM MAINTENANCE. 7. What materials are stored at this facility? RESPONSE - MAINTENANCE EQUIPMENT AND SPARE PARTS FOR THE WASTEWATER CONVEYANCE FACILITIES IN THE WEST METRO AREA. NORMAL MAINTENANCE MATERIALS SUCH AS CLEANING SUPPLIES, SMALL QUANTITIES OF MOTOR OIL, ANTIFREEZE, LAWN CARE MATERIALS, FILTERS, LIGHT BULBS, ETC. NON -TOXIC CHEMICAL USED TO CONTROL LIFT STATION ODORS IS ALSO STORED AND DISPENSED AT THIS LOCATION. a. Will they be stored outside on the site? RESPONSE — THIS FACILITY IS DESIGNED AND INTENDED TO PROVIDE INSIDE STORAGE FOR ESSENTIALLY ALL MATERIALS AND EQUIPMENT NEEDED FOR THIS FACILITY. ANY LIMITED OUTSIDE STORAGE WILL BE ADEQUATELY SCREENED. 8. What is the traffic generated by this facility? RESPONSE — ULTIMATELY, UP TO 16 STAFF MAY BE BASED HERE. THE TRAFFIC COULD INCLUDE 16 PEOPLE ARRIVING FOR WORK EACH MORNING AND DEPARTING AT THE END OF EACH DAY. IN ADDITION, MOST OF THESE PERSONNEL WILL DEPART THE SITE IN THE MORNING IN AN MCES TRUCK FOR THEIR JOB DUTIES, AND RETURN TO THE SITE AT THE END OF THE DAY. SANITARY SEWER MAINTENANCE IS 24 HOUR, 7 DAY A WEEK ACTIVITY AND THERE WILL BE A LIMITED AMOUNT OF OFF HOUR AND WEEKEND TRAFFIC TO AND FROM THE SITE. THERE WILL ALSO BE MINOR TRAFFIC EACH DAY RELATED TO DELIVERIES OF EQUIPMENT OR MATERIALS, TYPICALLY SEVERAL DELIVERIES PER WEEK. 9. What type of trucks and vehicles will beat this site? RESPONSE — MCES VEHICLES STORED AT THE SITE WILL INCLUDE THE FOLLOWING: a. APPROXIMATELY FIVE SERVICE TRUCKS. THESE ARE THE TYPE CURRENTLY STORED AT THE EXISTING MAINTENACE FACILITY. b. SEVERAL UTILITY TRAILERS CONTAINING SERVICE AND EMERGENCY EQUIPMENT. c. FOUR TO SIX TRAILER- MOUNTED GENERATORS OF THE TYPE CURRENTLY SEEN AT THE EXISTING MAINTENANCE FACILITY. d. MCES MAY BASE A VACTOR TRUCK AT THE SITE. THIS IS A LARGE, TANDEM AXLE VEHICLE USED TO CLEAN DEBRIS FROM MANHOLES AND LIFT STATIONS. THESE VEHICLES WILL BE STORED INSIDE THE PROPOSED MAINTENANCE FACILITY OR THE PROPOSED UNHEATED STORAGE BUILDING. -1535- 10. Why does the building need to be so high? RESPONSE - THE BUILDING HEIGHT IS DICTATED BY THREE FEATURES; THE DOOR HEIGHT, OVERALL SHOP HEIGHT AND THE NEED TO MAXIMIZE INTERIOR SPACE USING A MEZZANINE LEVEL. ACCESS TO THE GARAGE SPACE WITH TRUCKS CONTAINING LARGE SIZE MATERIAL OR EQUIPMENT AND VEHICLES SUCH AS THE VACTOR TRUCK. IT IS ALSO NECESSARY TO HAVE ADEQUATE INSIDE HEIGHT THE SHOP AREA TO LIFT LARGE EQUIPMENT OFF A TRAILER. THE 16 FOOT DOORS AND THE SPACE REQUIRED ABOVE THE DOORS IN ORDER FOR THEM TO OPERATE RESULT IN THE SILL HEIGHT OF THE BUILDING BEING 20 FEET. THE DESIGN OF THE BERMUDA ROOF INCLUDES A 4 TO 12 SLOPE ON THE ROOF, WHICH IS CONSIDERED MORE ATTRACTIVE THAN A FLATTER ROOF; THESE PARAMETERS SET THE BUILDING HEIGHT, AS SHOWN. 11. Why do the doors need to be so tall? RESPONSE - THE 16 FOOT DOORS ARE NEEDED TO ALLOW ACCESS FOR A RELATIVELY TALL MAINTENANCE VEHICLE, SUCH AS THE VACTOR TRUCK OR A TRAILER WITH LARGE PIPE OR VALVE COMPONENTS. 12. Can some of the door heights be reduced? RESPONSE - SEE ABOVE. UNIFORM DOOR HEIGHTS ALLOW FOR A FULL FUNCTIONING BUILDING AND A CONSISTENT APPEARANCE. 13. Eliminate clearstory, use skylights or dormers (or windows at top of walls). RESPONSE - THE COUNCIL WILL ADOPT THIS SUGGESTION AND UTILIZE DORMERS AND HIGH ELEVATION WINDOWS ON THE WALLS TO ACHIEVE ENHANCED NATURAL LIGHTING. 14. Can building grade be lowered by pushing it further north? RESPONSE - WE HAVE LOWERED THE BUILDING GRADE BY 1.5 FEET IN RESPONSE TO CITY CONCERNS. ITS NOT FEASIBLE FOR THE COUNCIL TO LOWER THE BUILDING GRADE FURTHER BY MOVING IT NORTH. THIS WOULD RESULT IN A LOSS OF TREES, AND A GREATER AMOUNT OF IMPORTED FILL SINCE THE AREA TO THE NORTH IS LOWER. 15. What will we do to achieve "beautification" for the site? RESPONSE - THE COUNCIL IS WORKING WITH THE CITY TO MITIGATE VISUAL IMPACTS AND DEVELOP AN ACCEPTABLE DESIGN. THE COUNCIL ALSO WILL SCREEN THE SITE WITH PLANTINGS AND POSSIBLY A BERM, BASED ON RECOMMENDATIONS PROVIDED BY CITY STAFF. 16. How do we mitigate "stress on the neighborhood" from the enlarged facility? O^ Z= T Ln Q City of Mound City Council Metropolitan Council Environmental Services Wastewater Treatment Facility 6270 Westedge Boulevard Essential Services Building Planning Case No.03 -07 I am a property owner very near to the current wastewater treatment plant. I have some concerns about what was proposed at the public hearing before the Mound City Council on May 14, 2013 regarding this facility. This facility is located deep within a large residential neighborhood. This fact requires that the buildings and site be as visually compatible as possible. 2. Visual screening with berms and pine trees as shown in the site plan is a must. The current pine trees left on the property and the large pine trees that were removed last winter have all had there lower branches removed negating the visual screening effect. Removing the lower branches on the pine trees should be prohibited to ensure the visual screening effect remains in effect for the future. 3. As stated by a representative from the Metropolitan council the L -38 building will have a generator inside of it. The exhaust needs to point towards the north towards the existing trees and wetland area. When the generator is in operation the total volume of noise should not exceed 85 decibels. 4. The large "steel barn" maintenance building needs to be at a lower site elevation to help reduce its visual impact on the adjoining residents. At the public hearing no drawing was shown of the L -38 building, but approval of this structure is included in the existing permit. If permit is granted the Metropolitan Council could build anything, regardless of appearance and physical height and this was the closest proposed building to residential homes. Could part of this structure be located within the ground to further reduce the visual impact on the neighboring residents? 6. Please include the "witch's hat" into a building design to help soften the industrial look within the property. As a nearby resident to this property I fully understand the importance of this facility to life in our modern society. That being said I also want the Metropolitan Council to be a much better neighbor in the future than they have been in the past. Ronald Headley 2611 Setter Circle Mound MN 55364 -1538- Sarah Smith Subject: Wastewater Treatment Facility Dear Sarah, I was unable to attend the meeting re: the Wastewater Treatment Facility, which is across the street from where I reside. My address is 2601 Setter Circle, which is on the corner of the cul de sac across the street from the facility. I, too, am concerned that the plan for building will detract from this residential area. I am an older single person and am planning to sell my home within the next five years, so 1 am concerned about the appeal of living in my home for re -sale purposes. Most immediately, I am obviously concerned about my own view from my property. I am also against the building of a high structure, so please take into consideration my concerns re: this. I agree with my neighbors that having a lower building towards the back of the property or having a building partially below ground would be best. I hope you will also take into consideration the landscaping of this facility and make it appealing since this is a residential area. In addition, the Council discussed the relationship of serving time and closing time. Staff was directed to prepare language to amend the code to follow state law, which is included in the attached Ordinance. Entity Mon — Sat Begin Mon — Sat End Sun Begin Sun End Mound (Current) 8:00 a.m. 1:00 a.m. 11:00 a.m. 12:00 a.m. State Statute 8:00 a.m. 1:00 a.m. / 2:00 a.m. with permit 10:00 a.m. 1:00 a.m. / 2:00 a.m. with permit The 2003 omnibus liquor bill moved back from 1:00 a.m. to 2:00 a.m. the hour at which on -sale of intoxicating liquor and 3.2 beer must cease, subject to obtaining a special permit from the state. The same change is made for the hour at which establishments with "consumption and display" permits (bottle clubs or set -ups) must stop consumption on the premises. Although the hour set in law is often referred to as the "closing hour," state law does not require establishments to close their doors at that hour but only to stop selling alcohol. A requirement to actually close may be included in local ordinances. The Mound ordinance does address the serving time and closing time, and, therefore, the proposed amendment also addresses allowing another %2 hour after selling time for closing time. This Ordinance is lengthy, so it will be published by summary, which requires the separate resolution. Please let me know if you have any questions. -1544- CITY OF MOUND ORDINANCE NO. -2013 AN ORDINANCE AMENDING CHAPTER 6 OF THE MOUND CITY CODE AS IT RELATES TO ALCOHOLIC BEVERAGES The City Council of Mound does ordain: That Article II, Intoxicating Liquor, Division 2, License, Section 6 -46, be hereby amended as follows: (b) On -sale Sunday Liquor. While it looks probable that the City will receive some LGA, I request the Council approve the extension of the period for the Sunset Clause for the following reasons: • Uncertainty with the 2014 Budget exists at this point in the planning process and we should keep all option on the table. • Levy limits may be put in place for 2014. • The City will be challenged to eliminate the General Fund 2013 budgeted use of reserves of $204K. • The City tax capacity is projected to decrease another 3% for 2013, which will drive our tax rate over 60 %. • Gas and electric franchise fees provide diversity in our General Fund revenue streams. The Auditor noted our high percentage of revenue from property taxes. Monthly and quarterly receipts help provide cash flow between the semi - annual tax settlements. • The Mediacom cable franchise fees should also be considered as they are not as evenly distributed across the population, but rather generated only by Mediacom subscribers. • LGA has proven to be unreliable as the formulas change or state budget pressures cause it to be revoked. When uncertainty exists, it is more prudent to use these funds for one -time capital expenditures or projects thereby reducing the need for bonding. Electric franchise fees generate $147,000, gas franchise fees $125,000, and cable franchise fees $105,000, a portion of which is given to the LMCC for programming and services. Staff recommends the approval of the attached ordinances to extend the sunset dates until December 31, 2016, recognizing the fees cannot be totally eliminated in the near future. The amount of the fees for 2014 will be discussed and can be amended during the 2014 budget discussions that will take place in September. Please feel free to contact me with any questions. Lost Lake Slip Fees for Non - Residents or Lost Lake Residents for Second Slip The weather coupled with a significant fee increase for non -Mound residents has shrunk demand for the Lost Lake Slips requiring further consideration. Advertising efforts to date include: Craig's List, classified ads in The Laker and Lakeshore Weekly, Lakeshore Weekly "Back on the Water" Section advertisement, sandwich board sign on CR15 & CR44, posted flyers at Westonka Public Library , Caribou, Dock and Lift, Jubilee, Harbor Wine, and information on the City website. Mound residents are still showing demand and therefore Staff recommends keeping the rate at $1,950, but decreased demand from non -Mound residents suggests the rate should be lowered. Staff's recommendation is to lower the Non -Mound Resident Rate from $2,600 to $2,050. This way Mound residents can help recruit friends /family with boats. Staff believes too large of a differential (> $100) would deter that. Please note this is the first time a rate differential existed between residents and non - residents for Lost Lake slips. The purpose of a regional scenic byway system is to tie together all of our communities' historic, scenic, and cultural amenities that are connected through various historic roadways' around Lake Minnetonka to create an important marketing and branding opportunity for this area. The City of Wayzata became aware of the opportunities that a scenic byway system may provide through the work of a few dedicated citizens who were interested in preserving the important scenic qualities of Bushaway Road/ County Road 101, which is part of a Hennepin County project in 2014. As a result of this work, we created a local scenic byway designation for the historic roadways that connect Wayzata to the lake, similar to what Orono and Minnetonka Beach did a few years ago. In addition, we are conducting a community engagement process to better understand the desires of our residents and business owners as it relates to enhancing our waterfront presence. We view a regional scenic byway system throughout the Lake Minnetonka area as a low cost way of repurposing existing assets to draw business and tourism to region as a whole. We have started a conversation with other Lake Minnetonka communities and the Three Rivers Park District about the potential of an area scenic byway. I have attached a packet of information to give you some perspective on the scenic byway concept, I would like to schedule a meeting with you in the coming weeks to discuss this opportunity with you further. To Protect Resources: An official byway makes it easier to argue for preserving natural, scenic and historical resources. To Enhance Community Recognition: State and National byways increase the visibility of a road corridor, the communities connected, and the resources available. To Enhance Community Pride and Vision: Byways connect communities and promote the importance of historical sites, and the richness of natural, scenic and recreation resources, To Encourage Partnering: Not only do byways bring communities together, but also they suggest reasons for cooperative activities involving businesses, nonprofit organizations, and voluntary groups. A sense of common good may emerge and help to guide improvements in the lives of all residents in the byway corridor. To Boost Economic Development: Perhaps the most tangible benefit from byway designation comes from economic development. This results from booth tourism and increased use of business services by residents within the byway corridor. This can result in more community pride and vitality. Slight increases in traffic are a small price to pay for improving the image of the Lake as a whole and appreciation of its resources. For example, have you been to Gale Woods or the Excelsior Museum or the Burwell House? Read down the list in Table 1, which contains about 140 °attractions" around the lake to see how many of these pieces you have not experienced. Think also about the future. If we do not do more now to preserve natural and historical resources, they may be lost to future generations. What is a scenic byway? A "scenic byway" is a transportation corridor recognized for one or more archeological, cultural, historic, natural, recreational and scenic qualities. If can be designated as such nationally, by a State, or by a local unit of government. We seek official recognition of a Lake Minnetonka Scenic Byway by the State of Minnesota. Minnesota's Scenic Byways Program has so far approved 22 scenic byways in the State. Funds can be awarded by the state or national scenic byway programs for planning, conservation, preservation and marketing activities of potential byways, The National Scenic Byways Program administered by the U.S. Department of Transportation is a grass-roots collaborative effort established to help preserve and -1556- enhance selected roads throughout the United States. The National Scenic Byways Program has funded 2,926 projects for state and nationally designated byway routes. What is Proposed for a Lake Minnetonka Scenic Byway? The Lake area has been divided into four scenic routes in the two maps below. The first map shows the Eastern portion of the Lake as the main scenic byway with a side or auxiliary route from Wayzata to Minnetonka Mills, which in the early days before the Gray's Bay Dam was part of Lake Minnetonka. On the first map, the main scenic byway route is shown in pink and the Minnetonka Mills side route is marked in green. The starting point of each route is marked as mile 0 (zero) and the other numbers along the route are the distances in miles from the starting points. The second map (Neap 2), gives the western end or the lake including not only the Upper Lake but also the headwaters area to St. Bonifacius. This Western route is marked in blue. A side or auxiliary route along North Shore Drive is marked in purple. Each of the two main routes adds up to about 20 miles in length for a total of 41 miles. The side (auxiliary) routes add an additional 11 miles, The scenic byway plan as now conceived involves the following 14 communities: Excelsior Orono Oeephaven Shorewood Greenwood Spring Park Minnetonka St. BornTacius Minnetonka Beach Tonka Bay Minnetrista Wayzata Mound Woodland However, there are only four principal Chambers of Commerce and six Historical Societies. (See Table 2 for a list.) Thus, the organization work will be less demanding than it might seem. Among the many pieces of this project that remain to be completed is a complete listing of the key historical sites around the lake. A preliminary list of about 50 historical sites is embedded in both Tables 1 and 2 However, this list is not complete. Note that no current residences are included in the list of historical sites because of privacy considerations. The current list of sites is not yet completed, as most of the existing historical commercial buildings in Excelsior and Wayzata are not yet included. The historical societies will be solicited for help in making a complete list. The workshop on June 21, led by Bill Neuman, will begin to clarify the remaining work to be done and how best to organize to get all of the cities and organizations around the lake to work together. -1557- >7 ww jlcmsl' 0 i I ba un 15158- I "A J MG < .... . . . APPROVAL OF MARCH 14, 2013 MINUTES MOTION by Nettle, seconded by Peterson, to approve the March 14, 2013 minutes as submitted. MOTION carried unanimously. PUBLIC COMMENTS AND SUGGESTIONS — None DISCUSS: DOG PARK Roath queried the commission as to their role in the development of the park. He introduced a 4 Phase approach including: Phase 1 Build Support / Assess Interest / Establish a Task Force Phase 2 Research Other Communities and Set Requirements Phase 3 Identify Locations and Explore Partnerships Phase 4 Propose Options and Estimate Cost Peterson thought that all phases could be accomplished by the commission and then bring results and recommendations to the City Council. -1566- Nettle jumped to Phase 3 as she knows there is a lot of support in the community. Discussion ensued about properties in Mound and found it lacking. Roath was to contact Three Rivers but felt he needed further direction. He will contact them to see if one is in the plans. Other discussion included the WRA Park in Minnetrista, Dog Days committee involvement, funding, survey at Dog Days (interest, demand, willingness to pay fee, emails of interested persons), small dog vs. big dog park, funding, formation of an interest group, newsletter, posting signs at key parks, animal hospital and Jubilee. Carlton recommended checking with Heidi regarding setting up the interest group, newsletter and posting signs. Brian will draft some examples and communicate with Heidi. Questions arose regarding the meeting outside of a regular POSC meeting. Commissioners were unclear what the policy is and the reasons behind it. DISCUSS: PARK TOUR PLANNING Discussion included funding for repairs, a rating sheet for use and top priority parks. Jill is directed to email rating sheet and commissioners will visit their assigned parks before the next meeting. Staff present: Community Development Director Sarah Smith and Planning Commission Secretary Jill Norlander. Others present: Sheryl Martin (resident); Keith Anderson (HR Green); Ellen Luken (architect) APPROVAL OF AGENDA MOTION by Ward, second by Goode, to approve the agenda as presented. MOTION carried unanimously. APPROVAL OF MINUTES MOTION by Wiechert, second by Goode, to approve the April 2nd and April 16`h minutes as presented. MOTION carried unanimously. BOARD OF APPEALS A. PLANNING CASE NO. 13 -07 CONDITIONAL USE PERMIT 6270 WESTEDGE BOULEVARD APPLICANT: MET COUNCIL ENVIRONMENTAL SERVICES REVIEW OF BUILDING HEIGHT Smith indicated that the building height for the West Area Maintenance Facility building is considered to be within approved limits according to City Code, but it was felt that additional information and clarification would be helpful for the Commission. She explained that the "clear story" portion and the main roof functions together as one unit. Ellen Luken (architect for the MCES project team) assisted with explanation of details. Retterath indicated that this is a stretch for him. Code is fairly consistent and clear. Are we setting a precedent? He disagrees strongly with the interpretation that this is one roof. Penner inquired as to the height of the "clear story" feature. Luken stated that it was approximately 6 feet 8 inches. Keith Anderson (HR Green) explained that this facility was going to be a west metro hub for the MCES utility crews. -1568- Linkert understands the importance of the standards and really likes how visually creative the proposed building is. He commented that it is set back off the road quite a bit and is much more interesting than the existing building. This is clearly a utility use. Wiechert said that it is visually appealing and an effort to match the design that Mound is trying to encourage in the commercial district. Not sure where the impact would come for the residential area. It's a benefit to the community. Goode asked the architect what affect it would have to lower the roof. Luken replied that this is the lowest pitch that one would want. It won't have the "barn" look without it. Ward asked if the MCES considered other areas as the new hub. Anderson said that the focus was on Mound. Whether they went somewhere else they would still maintain this site because they need the lift station here. Smith gave direction to the Commission for amendment or rescinding of the original recommendation to the Commission. She complemented the MCES staff for their cooperation and for providing the additional information which provides transparency for the process. MOTION by Linkert, second by Wiechert, to amend the previous recommendation to include the new information. Voting for: Wiechert, Linkert; Voting against: Goode, Penner, Ward, Retterath. Discussion Retterath does not believe this is a single roof and we are not measuring to the highest point. He disagrees with this approach and believes this opens the door for future precedent to other projects in the City to the point that our building height requirement becomes irrelevant. Wiechert asked if they have an idea about what the plan would be if this design wouldn't go through. Luken indicated that they would lower it to where it needed to be and all it would affect would be the aesthetics of the building. MOTION by Ward, second by Goode, to rescind the previous motion approving the plans. MOTION carried. Voting for: Goode, Penner, Ward, Retterath; Voting against: Wiechert, Linkert. MOTION by Ward, second by Retterath, to recommend denial of the Conditional Use Permit with findings as discussed including the height of the West Area Maintenance Facility building which exceeds the City height regulations Discussion Retterath understands the hours that have gone into this plan. His concern is the precedent that may be set for future projects. He didn't want them to abandon the clear story. -1569- Ward talked about modifying the design for conformity and bringing a revised plan to the Council. He also complimented the MCES on their partnership with the City. Smith stated that it appears the Planning Commission's concern is that current design is inconsistent with the height regulations and requires modification and that another option could be a variance. MOTION carried. Voting for: Retterath, Ward, Penner, Goode; Voting against: Linkert, Wiechert. B. PLANNING CASE NO. 03-18 CONDITIONAL USE PERMIT AMENDMENT 2415 WILSHIRE BOULEVARD CITY HALL AND PUBLIC SAFETY CAMPUS Smith introduced the plan to move City Hall into the Public Safety Building and subsequent exterior remodeling including the parking modifications along Wilshire Boulevard, relocation of landscaping, changing out of signage and canopy on the north side entrance door. Relocation will occur in October. Parking modifications will begin sometime in June. The discussion included the location of the crosswalk, maintenance and use of the outside stairway and the plan for handicapped parking. Linkert brought up the idea of reverse angle parking MOTION by Goode, second by Penner, to recommend approval of the CUP amendment. MOTION carried unanimously. OLD /NEW BUSINESS Sarah indicated a need for a second meeting in May. MOTION by Ward, second by Linkert, to schedule an additional commission meeting on May 21, 2013. MOTION carried unanimously. Retterath wants the accessory building discussion at the next meeting. Staff Update: Smith reported the following: Lost Lake Villas are progressing; Downtown marketing study results coming shortly (real planning stuff); a couple of applications are being reviewed. At the request of Linkert, Smith reviewed the results of the Sojourn application. ADJOURNMENT MOTION by Ward, second by Goode, to adjourn at 8:35 p.m. MOTION carried unanimously. Submitted by Jill Noriander -1570- MINUTES May 21, 2013 Chair Ward called the meeting to order at 7:00 p.m. ROLL CALL Members present: Chair Stephen Ward, Commissioners Jeffrey Bergquist, Douglas Gawtry, David Goode, George Linkert, Cindy Penner, Pete Wiechert and Councilmember Mark Wegscheid. Members absent: Retterath. Staff present: Community Development Director Sarah Smith. BOARD OF APPEALS Review of the City's parking regulations was included on the Planning Commission's work list for 2013. Smith provided an overview of the some of the topics she suggests be reviewed as part of the study including possible reductions for non - useable space, shared parking and day /night. Also, review of existing sites that are not changing in size or intensifying the use. Discussion of the public /private parking supply and how the overall parking system functions also took place. Smith mentioned the downtown parking study that was done by Walker Parking and it was suggested that copies be provided to the Planning Commission. Staff will begin reviewing parking regulations for communities with similar characteristics. ADJOURNMENT MOTION by Penner, second by Linkert, to adjourn at 7:50 p.m. MOTION carried unanimously.
