1968-03-12 MINUTES OF MEETING OF MARCH 12, 1968 7:30 P.M., Village Hall dn Island Park Pre sent: Mayor Fenstad, Councilmen Regan, Andreasen, Swenson, Schmidt, Attorney Pearson, Village Manager Kopp, and Engineers Leer of Schoell & Madson, Fredrickson of K. M. Clark, and Wm. Mills. Also Attorney Ploetz. Schmidt moved and Regan seconded and it was unanimously carried to accept the minutes of February 27, 1968. BAYPORT ROAD, PROJECT 67-5 Schmidt moved, and Regan seconded the motion. RESOLUTION 68-54 Roll Call Vote Andreasen Aye Regan Aye Schmidt Aye Swenson Aye Fenstad Aye So resolved. RESOLUTION APPROVING SPECIAL ASSESSMENT - (Bayport Road, Project 67-5) BLOCK 9, AVALON REZONING AND GLAMORGAN ROAD VACATING Swenson moved, Schmidt seconded, and it was unanimously carried to continue the hear to March 26. PLANNING COMMISSION RECOMMENDATIONS 1. W. R. Netka, Lots l0 & ll, Auditor's Sub #170 Request to dredge and fill in Lost Lake area Mr. Netka appeared and said he had applied to the State Conservation De- partment and the Mdnnehaha Creek Watershed District for permission to dredge and fill in Lots l0 and ll, Auditor's Subdivision #170, and he would also like permission from the Village. Anderson moved, Regan seconded, and it was unanimously carried that in- asmuch as Mr. Netka's plans conform with the Central Business District Plan, there would be no objection to his plans. There was no Council action on Items 2, 3 and 5 because their proponents were not present. 6. Hans Melgaard Setback Variance - Blocks 9 & 10, Avalon Regan moved and Andreasen seconded the motion RESOLUTION 68-55 RESOLUTION GRANTING SETBACK VARIANCE Roll Call Vote (Plat 37850, Parcel 2290) Regan Aye Andreasen Aye Swenson Aye Schmidt Aye Fenstad Aye So resolved. MAYWOOD-FAIRVIEW STREET IMPROVEMENT - Project # 67-10 Mr. Leer of Schoell & Madson presented final plans for approval. Andreasen moved and Regan seconded the motion RESOLUTION 68-56 Roi1 Call Vote Regan Aye Andreasen Aye Swenson Nay Schmidt Aye Fenstad Aye So resolved. RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS (Maywood- Fairview Street Improvement - Project 67-10) Councilman Swenson felt a visual inspection should be made before passing the resolution. WATER TRANSMISSION LINE AND LOOPS - Project 67-14 Mr. Fredrickson of K. M. Clark Engineering presented final plans for approval. He reported Hennepin County Highway Department would l~ke to see the trans- mission line placed in the road right-of-way and not on Highway #110 proper on Commerce Boulevard. Regan moved, Schmidt seconded the motions. RESOLUTION 68-57 Roll Call Vote Regan Aye Andreasen Aye Swenson Nay Sc~idt Aye Fenstad Aye So resolved. RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS (Project 67-14) Councilman Swenson objected to the five-foot depth on Commerce Boulevard. STREET PROJECTS - Projects 67-3, 67-4, 67-9 Mr. Mills of Wm. T. Mills Engineering presented final plans on the three street projects: Project 67-3 Basswood Lane 67-4 Enchanted Road and 67-9 Piper Road. ' Andreasen moved, Schmidt seconded the motion. RESOLUTION COMBINING IMPROVEMENT PROJECTS 67-3,4,9 and APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS At this point the floor was given over to residents of Pembroke, Wychwood and Avalon. Questions and answers were given on various improvement projects, Tuxedo Boulevard in particular, and administration. The following spoke: Harold Miller Mrs. Edward M. Andreasen seconded, and it was unanimously carried. CIGARETTE LICENSES Schmidt moved, Swenson seconded, and it was unanimously carried to gr~nt cigarette licenses to Superamerica and Qik & Ezy. BICYCLE LICENSE OVERPAYMENT Swenson moved, Schmidt seconded, and it was unanimously carried to refund $1.50 to Jule J. Falque for overpayment of bicycle license. GORDON SWENSON SEWER & WATER APPEAL Mr. Ploetz reported Mr. Swenson's attorney had proposed cutting the assess- ment in half on Lot 10, Bloc~ 18, Wychwood. Mr. Ploetz wondered if he should continue the court case or accept an offer. He felt the assessment met the criteria set up. Because the Council did not have enough information, he was asked to chec~ with them later. LOTS 25, 35 and 37, Auditor's Sub #170 Regan moved and Andreasenseconded the motion RESOLUTION 68-59 RESOLUTION AUTHORIZING MAYOR ANDMANAGER Roll Call Vote Andreasen Aye Swenson Aye Schmidt Aye Regan Aye Fenstad Aye So resolved. TO MAKE APPLICATION TO CONSERVATION DE- PARTMENT FOR FILLING IN LOTS 25, 35 and 37 of AUDITOR's SUB #170 ADJUSTMENT ON SEWER BILL Swenso~ moved, Regan sec~.nded, and it was unanimously carried to grant an adjustment of 45,000 gallons on George Pierce's sewer bill. This is the quarter which establishes sewer usage for the year. While softening water Mr. Pierce let 45,000 gallons of water run through the meter. MANAGER AND ATTORNEY TO ACQUIRE NECESSARY SLOPE AND STREET EASE- MENTS (Improvements 67-3,4,9) BEACHWOOD SANITARY SEWER A petition signed by a majority of property owners abutting Beachwood Road between Rosewood Lane and Westedge Boulevard asking for sanitary sewer and bringing the road to grade was received.
