1968-08-20MINUTES OF ADJOURNED MEETING OF AUGUST 20, 1968 at 7:30 P.M. at the Island Park Halt, Mound, Minnesota Present: ~4ayor Fenstad, Councilmen Andreasen, Regan, Schmidt, Swen~on, Attorney Pearson and Village Manager Kopp HEARINGS: 1. Snowmobile Ordinance The question was mainly on setting the hours of operation and the age of the operator. There have been a number of complaints on noise from resi- dents on Cook's Bay where a number of snowmobiles congregate. The following spoke: Mr. MacCharles, Ski-Doc Dealer in Spring Park, Rick Little, President of the Lake Minnetonka Snowmobile Association, Nary Sinner, owner of Del-Mar Surfside, Marv Meridith of Wayzata, Gary Thomton and Dr. R. J. Segner of Mound, Dick Huff of Minnetrista and Mr. Edwin W. Elmer, attorney for North Central Marine Association who helped draw the State regulations for snowmobiles. Mr. Elmer said the State Laws were passed with the hope of a minimum of municipal laws for sake of uniformity and urged the Council to wait until the State Laws could have a chance to operate. He recommended the ordinance passed by Minne- tonka Village. Regan moved and Andreasen seconded to have our attorney draw up an ordinance with provisions as talked about tonight that could be submitted to the Lake Minnetonka Conservation District for their comments and sug- gestions and reque~t that they consider making an ordinance that would be uniform around the lake. Unanimously carried. 2. Spo~sCar Racing on Ice Again the problem was noise on Cook's Bay. The officers of the Metropoli- tan Sports Car Council were present. They said they had chosen Cook's Bay because of the favorable facilities of Del-Nar Surfside. Mr. Allan Moran of the Hennepin County Water Patrol was also present and explained how permits are issued to the Sports Car Council. 'Some thought was given to restricting the number of weekends races could be held, and Mr. ~llin agreed. It was later believed that the license fee would take care of this. Swenson moved and Schmidt seconded the motion: ORDINANCE NO. 242 AN ORDINANCE REQUIRING THE LICENSING OF ANY WATER CRAFT OR AUTOMOBILE RACE TRACK OR CO~-RSE WITHIN THE VILLAGE OF MOUND The Village Council of the Village of Mound do ordain: Part G, Section 38.64. License Required. No person shall establish or maintain any automobile or water craft race track, park, raceway, or course or conduct, have, or permit automobile or water craft racing at any such race track, park, raceway, or course, whether or not an admission fee is charged, without having been licensed under this ordinance. ' 38.65. Application for License. Application for license shall be made to the Village Manager or the Village Clerk. Such application shall contain, among other things, the name or names of the owners and operators and respective residents, an exact description of the premises to be used or the area of open water or any ice-covered body of water and the dates and hours when races will be held. The license must be approved by the Village Council 38.66. License Fee. The annual license fee shall be $250.00 ore,he applicant may make an individual..application for each race or per£ormance, and said fee shall be $25,.0~or each race or '~ performance. All licenses issued under this section shall expire on January 1 of each year. 38.67. Insurance Required. Each applicant for license for a water craft or au-~omOb~ie race-tra'61~, park, raceway, or course under this section shall submit with his application a policy of public liability insurance in at least the amount of $100,000 for death or injury to one person, $300,000 for deaths or injuries resulting from one accident or occurrence, and $25,000 property damage. Such policy of insurance shall be written by a company authorized to do business in the State of Minnesot~ and shall be approved as to form and execution by the Village Attorney. FENCE ORDINANCE Andreasen moved, Schmidt seconded the motion: ORD_~NANCE NO. 245 '~' ORDINANCE ANENDING SE~;~ION 55.17 OF THE ~..iJLAG~ CODE ESTABLISHING STANDARDS FOR FENCES LOCATED IN T~ "JILl,AGE OF MOUND AND REQUIRING ALL SW~NNII~G POOLS TO BE ENCLOSED BY A FENCE The Village Council o~ the Village of Mound do ordain: Section 55.17 is hereby amended to read as follows: Section 55.17. RESTRICTIONS - TYPE - HEIGHT OF FENCES: (a) No person, firm or corporation shall erect, construct or place any barbed wire fence or electric fence within the Village except that barbed wire may be used as an anti-vaulting measure on top of a fence, which equals or exceeds 6 feet in height, but then only in the industrial use districts. (b) No person, firm or corporation shall erect, construct or place any fence within the village exceeding 42 lnches in height'except that it must conform with Section 55.33 hereot or as allowed in Sections (c), (d) ahd (~) of this ordinance. ' (c) in Residential or Multiple Use Districts, wood or chain link fences are permitted subject to the tollowing height and setback restrictions: Front yard fences may he solid or open and not over 42 inches in height; Rear yard fences located behind the front Yard setback area may be solid or open and not over 72 inches in height. 3, Front yard shall be defined according to Section 23.31 of the zoning code and shall also include both frontages on double frontage lots, 4. Fence heights shall be measured from the adjoining natural ground. Where any fence connects to a building used as a dwelling, a 2 foot 6 inch minimum width gate shall be required to allow continuous access around the building. No fence shalibe permitted on the public right of way. 5 Fence heights and unusual lots sball be governed by standards obta{.ned from the City of Los Angeles and on file in the office of the Village Manager and marked "Exhibit A: - Ordinance No. 243 , Adopted by the Mound VillaSe Couno~l August 20, , (d) All swimming pools within the Village sh~l], bs e2c!osed by a solid wall or fence or chain link ffence not le~.taan ~Ive (5) ieet nor more than mi~ (C) ~eet in h~Igh~ so ~ to preven~ uninvited acce~. The Council may, upon a £1ndin~ o~ unusual hardship~or unusual circumstances waive or modify the terms of this ordinance ii it will not adversely affect the health, safety or general ~'elfare of ?he neighborhood. The council shall · specify such conditions in any v~riance~which will protect ~he enjoyment of the property rights of adjoining properties. Swenson seconded the motion and it was unanimously carried.
