ORDINANCE NO. 248
AN ORDINANCE AMENDING THE BUILDING CODE
OF THE VILLAGE OF 5IOUAqD, PROHIBIT ING THE
ISSUANCE OF BUILDING PERMITS IN AREAS
SUBJECT TO FLOODING
The Village Council of th~ Village of Mound does ordain:
Section 26.06 of the Building Code is hereby amended to add
Subdivision (d) and shall read as follows:
Section 26.05 d.) Building Permits in Areas Subject
to Flooding.
1.) Purpose. It is hereby determined that
the construction of any structure within the Village
of Mound,upon lands which are subject to flooding or
on lands which which will create flooding conditions
on other lands which were not previously affected,
will create danger to life and/or property and will
adversely affect the health, safety, and general
welfare of the residents of the village.
2.) The village engineer shall prepare a map of
the village showing areas which have been or are sub-
ject to flooding and establishing minimum building
elevations and a copy of said map shall be on file in
the office of the building inspector. Said map shall
be marked "Official Map - Flood Plains - Village of
Mound."
3.) It shall be the duty of the building in-
spector to review each application for a building
permit. He shall review the application and if the
location of said proposed structure is within an
area designated by the aforementioned Flood Plains
~Iap as an area subject to flooding, or if said con-
struction will create flooding on abutting properties,
he shall refuse to issue a building permit.
4.) The building inspector may also establish
minimum floor elevation levels in areas which abut or
are adjacent to areas subject to flooding, or upon
premises likely to cause financial loss to persons
purchasing or using said premises.
5.) Any applicant who is denied a building permit
for the reasons set forth in this ordinance may appeal said
denial to the village council. The council may approve or
deny said application or it may require the applicant to
file a certification from a registered professional en-
gineer certifying that the location and elevation of the
proposed structure will not be subject to flooding or
cause the flooding of abutting properties. The council
may condition said approval based on reasonable require-
ments to protect the health, safety and general welfare
of the applicant, abutting properties or subsequent
owners of the subject property.
6.) Neither the building inspector or t~e village
council shall approve any permit or establish floor ele-
vation which is less than one foot above the 1965
high water level or the design flood elevation.
