Conforming Uses In the Multinle ~<oiling Use District, unless otherwise provided in in this ordinance, no building or premises shall be used, and no building shall hereafter be erected or structurally altered except for one or more of the following uses nor shall any building be erected to a building height of more than three stories or 55 fee~. Sections l, 2, 5 and 4~of said Sub-Section to remain the same and in full force and effect. Section 25.061 Sub-Section d is amended to add section 5't° said Sub- Section and to read as follows: 2~.061 Sub. d, ~ Townhouses may be permitted upon securing a Special Use Permit from the Village Council upon recommendation of the planning Commission and subject to the following standards: aa) Townhouses are defined as a single structure consisting of not less than three or more than six dwelling units having the first story at the ground level, with no other dwelling or portions of other dwell- ings directly above or below, with each dwelling unit connected to the . other dwelling by a single party wall with no opening. Each dwelling unit shall have a front and rear entrance. bb) cc) Townhouses shall not exceed two stories in height. The required land area for each townhouse unit shall be: 5 units - 5000 square feet of land per unit. 4 units - 4~00 square feet of land per unit. ,~' 5 units - 4000 square feet of land per unit. / 6 units - 4000 square feet of land per unit. d6) The minimum required floor area per to¥~nhouse unit shall be as /follows: 1 Bedroom 2 Bedroom 5 Bedroom -i~ch Add'l Bedroom · 1 1~- Story 760 sq. ft. above grade 880 sq. ft. above grade 960 sq. ft. above grade (add 120 sq. ft.) 600 sq. ft. per floor 690 sq. ft. per floor 780 sq. ft. per floor (add 90 .-~c. ft. per floor) All townhouses shall have at least one bedroom. e) Townhouses shall have the foll0wingrequired setbacks and off treet parking: font yard - 25 feet - tee strusture may project 2 feet into front yard above first floor ceiling level. ide yard - at least 15 feet on each side of the main structure. ear yard - at least 20 feet. cfr street parking - 2 per unit, at least one of which shall be indoors. f the indoor parking is a part of the main structure and is set back t least 25 feet, and has an individual driveway for each unit, one off street parking space may be credited for the portion of the driveway which shall be set back at least 5 feet from the public right of way. ~o individual driveway shall be any closer than 2 feet from another iadividual driveway. Any off street parking located other than within the front yard area described above and serving more than one dwelldng uait shall not be located.closer than l0 feet from the principal structure. f£) Specific site plans, drawn to scale, showing building size and location and plans showing the individual units shall be required. site plan shall be filed with the council showing off-street parking, driveways, walls, fences, patios, all set-backs and the landscaping of aL1 open areas with grass, shrubs or other acceptable vegetation or t~eZtment generally used in landscaping. All plans shall be reviewed b~ the Council and filed with the Village and shall bectme a part of the s[e~ial permit. g~) No more than one townhouse shall be located on anylone platted lot, i~ more than one platted lot is used for said construction the owner S~all be required to replat said lots in accordance wit~ Chapter 22 of ti~elVillage Code. The Council may waive said replatting requirements ul,on recommendation of the Planning Commission and uponireceipt of a sg~ed statement from the owners combining said lots into one buildable p~rCel, said combination to be filed with the County Auditor and taxed a ene parcel. ~ ~ Individual townhouse units may be conveyed or ownership transferred i~ ~opies of articles of incorporation, association by-~aws, or other c~ ~nants are presented to the Village Council and saididocuments setting f~rth conditions for transfer are approved by the Village Council.
