The staff was instructed to put Mr. Pearson's request before the Planning Commission on .the September 25, 1969 meeting. ~3NKED CAR ORDINANCE Peterson moved and Andressen seconded a motion ORDINk CE NO. 255 AN ORDINANCE 2~ROHiBITiNG AB~d~DON~V~ENT OR PARKING OF JUN~ CARS ~ND OTHER VEHICLES; RESTRICTING THE KEEPING OF WRECKED, NON- OPERATING OR DISCARDED VEHICLES ON STREETS OR PRIVATE PROPERTY; PROVIDING FOR II~HPOUiqD- ING OF CERTAIN VEHICLES. The Village Council of the Village of Mound does hereby ordain: The Village Code is hereby amended to add Section 46.44 which shall read as follows: Section 46.44 (a) DECLARATION OF PUBLIC NUISDi~CE. The accumulation and storage of abandoned, wrecked, junked, partially dismantled or inoperative motor vehicles on private or public property is hereby found to create an un- sightly condition tending to reduce the value of private property, to invite plundering, to create fire hazards, and to constitute an attractive nuisance creating a hazard to the health and safety of minors. The accumulation and outside storage of such vehicles is further found to promote blight and deterioration in the con~uunity; to violate the zoning regulations of the village in many instances, it is further found that such wrecked, junked, abandoned or partially dis- mantled or inop~--~tive motor vehicles are in the nature of rubb/ litter, and unsightly debris and adversely affect the health, safety and general wel- fare of the community. Therefore, the acc~n~ulation and storage of such vehicles on.private property or public property, except as expressly hereinafter pe~aitted, is hereby declared to constitute a public nuisance which may be abated as such, which r~mady shall be in addition to any other remedy provided in this or other ordinances of this village or by state law. · DEFINITIONS. The following definitions shall apply in the interpretation and enforcement of this ordinance: (1) "Person~' shall mean any person, firm, partnership, association, corporation, company or organization of any (2) "Junk Car" means any motor vehicle which is not in operable condition, or which is partially dis- mantled, or which is used for sale of parts or as a source of repair or replacement parts for other vehicles, or which is kept for scrapping, dismantling, or salvage of any kind, or which is not properly licensed for operation within the State of Minnesota by the State of Minnesota. The Village Manager of the Village of Mound shall make provisions for receiving and safekeeping found property and money delivered to him and coming into his possession in the course of municipal opera- tions. A receipt shall be issued to the person de- livering such property or money to the village. Such property shall'be stored in a safe place and such money deposited with the Village Treasurer in a special ac- count for found money for a period of six (6) months, except vehicles which shall be governed by subsection f of this ordinance, unless claimed by the true owner. It shall then be subject to disposal under this ordinance as unclaimed property or money. b) CLAIMS BY OWNER. During such six (6) month period, or the period set out in subsection f of this ordinance, the Village Manager may deliver such property or order such money paid to the true owner upon proof of ownership satisfactory to the Village Manager after ten (10) days notice by mail to any person who has asserted a claim of ownership. No order for the disbursement of such money shall be made without the written order of the Village Manager. If o~nership cannot be determined to his satisfaction, the Village Manager may refuse to de- liver such property or order the payment of such money to anyone until ordered to do so by a court. c) CLAIM BY FINDER. If the true owner does not claim the property or money during this six (6) month period, the Villag~ Manager may deliver the property or order the money to be paid to the person who delivered it to the Village Manager if at the time of delivery such person indicated in writing that he wished to assert a claim to the property or money as a finder. d) TRANSFER TO GENERAL FUND. If any such money is not claimed by the true owner or finder within the six (6) month period, the Village Manager shall then notify the village Clerk and the money shall then be transferred to the general fund of the village. e) SALE OR D3PROPRIATE OF UNCLAIMED PROPERTY EXCEPT VEHICLES. After the six (6) month period, property not delivered to the true owner or finder shall be sold by the Village Manager at a public auction or appropriated to the use of the village. The vote was unan ously in favor, so carried. PARKING FOR BUSINESS AREA~' The council and the Mound Chamber of Commerce discussed problems of the business area, parking in particular. Councilman Andreasen outlined a proposal to solve parking and traffic. It was received with enthusiasm by both council and chamber.
