ORDINANCE NO. 266
AN ORDINANCE AMENDING CHAPTER 22 OF THE
VILLAGE CODE RELATING TO THE DIVISION OF
PROPERTY AND THE NEED FOR PUBLIC HEARINGS
The Village Council of the Village of Mound do ordain:
Section 22.00 is hereby amended to read as follows:.
Sec. 22.00. Platting Authority to Approve Plats. The Village
Council shall serve as the platting authority of the Village of Mound
in accordance with Minnesota Laws of 1965, Chapter 670, Sec. 8 (Minn.
Sta~s. Sec. 462.558). No plat, replat, or subdivision of land in the
village shall be filed or accepted for filing by the Hennepin County
Register of Deeds or Registrar of Titles unless it is approved by a
certified copy of a resolution adopted by the favorable vote of a
majority of the members of the Village Council approving said plat,
replat, or subdivsion. -
The Planning Commission, with the assistance of the village staff,
shall examine such plat and report and make a recommendation thereon
in writing to the Village Council. The grounds for recommending re-
fusal to approve a plat shall be set forth in writing and~ referred to
the Council and to the persons applying for such approval.~
After receipt of the' recommendations of the Planning Commission, the
Village Council shall hold a public hearing thereon after notice of
the time and place thereof has been published once in the official
newspaper at least ten days before the date of the hearing. At such
public hearing, all persons interested in the plat shall be heard,
,and the Village ~ouncil may thereafter approve or disapprove the plat,
but failure ~f the Council to act on the application within 60 days
after the date of the public hearing shall be deemed as approval of
the plat. The grounds for refusal to approve a plat shall be set
forth by the Council in writing and reported to the applicant. After
approval, the plat may be filed or recorded as otherwise provided by
law. S~id plat shall be recorded within one year of the Council's
approval; otherwise such approval shall expire.
The public hearing referred~to in the foregoing paragraph may be waived
by the Village Council if the purpose of said division or conveyance by
metes and bounds description is within the exceptions contained in Sec-
tion 22.03 of this Chapter and/or if a waiver is granted under the pro-
visions of Section 22.04 of this Chapter. All plats or replats shall
have a public hearing in accordance with the provisions of Minnesota
Statutes 462.358, Subd. 5.
Section 22.05 is hereby amended to read as follows:
Section 22.05. Exceptions.
a. Nothing in this ordinance shall prohibit the subdivision, re-
platting, or conveyance by metes and bounds descriptions of
any parcel of land less than the size, width or length require-
ments as provided in SeStion 22.55 hereof or to the minimum
lot size required for the zoning use district wherein such
properties are located, if such parcel is added to, and combined
with, and becomes a part of an adjacent lot or area used for
residential purposes so .as to increase the size of such adjacent
tract or parcel of land; provided that the remaining portion
of such tract being so divided shall not be less than the
size, width, and length as required by Section 22,5°5 hereof,
unless such remaining tract is also added to and combined
with and becomes a part of some other adjoining tract.
This ordinance shall apply only to laDds in the areas zoned
for residential uses by any zoning ordinance of the Village
of Mound.

LAKE ACCESS ASSESSMENTS

BE IT MOVED, by the Village Council of the Village of Mound that the matter of
lake ac,ss assment criteria on Sunrise Landing be tabled until
the March 31, 1970 committee meeting.
Information Memo 70-29 was discussed
Minutes of March 10, 1970 were read, several corrections were made, Peterson moved
and Schmidt seconded a motion to accept the minutes as corrected. The vote was
unanimously in favor, so carried.
Fire Service to Minnetonka Beach were discussed.
Schmidtmoved and Swanson seconded a motion to adjourn until April 14, 1970 at
7:30 P.M. at the Island Park Hall. The vote was unanimously in favor so adjourned.

BE IT MOVED, by the Village Council sitting as a Canvassing Board, of the Village
of Mound, that the Tally of the Split Liquor and Sunday Liquor Sales
be accepted, and the question of Split Liquor be accepted ,
and the questiom of Sunday Sales be accepted, both in the
affirmative.
