AMENDING CHAPTER 23 Andreasen mov ~d and Schmidt seconded a motion to moved the following ordinance ORDINANCE NUMBER 286 · OF THE ZONING AN ORDINANCE ~'IENDING e~ 23 50 SUBD C, CODE AND ADDING SUBDIVISIONS e, f; and g TO SEC. ~23.50 OF THE ZONING CODE ESTABLISHING FEES FOR WAIVERS~ VARIA'~CES, REZONINGS AND SPECIAL USE PE~ITS The Village Council of the Village of .Mound do ordain: Sec. 23.50, Subd. c, of the Zoning Code is amended ~o read as follows: c. Where action is initiated by petition, such petition shall be accompanied by a certified check or bank draft naming the Village as payee, in the amount of ~50v80 $75.00, to indemnify and reimburse the Village for costs of pu~l-l-~ation of the notice and cost of legal and engineering fees in review of said petition. Also, where action is in- itiated by petition, and it appears to the Council that ownership is sufficiently in doubt as to raise bona fide question concerning the sufficiency of the petition, the Council may require the submission by petitioners of a "stub abstract" or of a memorandum of the owners of registered property, or both, recently certified by an abstracting company, and showing record owners of the property affected by the proposed change and of properties within 300 feet of the proposed change. Section 23.50, Subd. e is hereby added to the Village Code and shall read as follows: e. Special Use Permits. All applications that require special use permits under the provisions of the ~Zoning Code shall require the applicant to pay a fee of $75.00 upon a filing of an a.p~_~ication and before the matter is -referred to the Planning Commission for its advice and recommendation. Section 23.50, Subd. f is hereby added to the Village Code and shall read as follows: f. Waivers or Variances. Any application for waivers or variances under the provisions of the Zoning Code shall require the applicant to pay a fee of $15.00 upon a filing of an application and before the matter is referred to the Planning Conunission for its advice and recommendation. . 'Section 23.50, Subd. g .is hereby added to the Village Code and shall read as follows: g. All petitions for amendments to the Zoning Code 'under Subd. c, special use permits under Subd. e, or waivers or variances under Subd. f shall be char~ed a full fee as set forth above, except that if the petition ~.application is voluntarily withdrawn prior to consideration by the qillage Council, there shall be a refund of 50% of the fee charged. Section 5.02 (d) is amended to read as follows~~ '' ~"(d) The term "approved outside container'' shall mean a burial vault of material, construction and design approved by the Village Manager. Section 5.033 is' amended to read as follows: 127 Upon payment in full of the purchase price of a lot, t~e"'cemetery will issue a deed conveying the lot executed by the Mayor and the Clerk, and the deed shall be recorded in the records of the Village. An interim receipt may be issued at that time which may be exchanged for the com- pleted deed which will be ready for delivery within ten days. Lots may be purchased on a deferred payment contract. Such'contract shall be signed by the Purchaser and approved by the Village Manager. This contract shall stipulate the amount paid and the terms for payment of the balance. De- ferred payments shall bear interest at the rate of 6% peri annum from the date of execution of the Contract.. Before a burial is permitted, an amount equal to the actual space used plus the interment and disinterment charges must be paid. No memorial may be installed on the lots purchased on. de- ferred payments until the f~ll purchase price has been paid. . ~,.. Section 5.035 is amended to read as follows: No lots shall be subdivided by the owner. No transfer, resale, ; reassignment, or other disposition may be made by a lot owner of any interest in his lot, except by will under the governing laws of tbs State of Minnesota, without securing the written consent of the Village Manager. and the Village reserves the first option to repurchase the lot or. fractional lot at the original sale price. No lot will be permitted to be resold, disposed of, or otherwise, used until the purchase price and all unpaid charges, includin, g charges for permanent or special care have been paid in full. Section 5.11 (d) is amended to read as follows: d. No interment of two or more bodies shall be made in one grave except in the case of mother and child or two infants buried in one casket, and except that where cremation bas taken place the ashes of ~ either the husband or wife or a child may be interred so that any two ~ of said persons may be interred in the same grave lot or the remains of. one spouse and the ashes of the other spouse may be located on one grave lot.. ;' Section 5.90 'Penalty provisions shall be in accordance with Sec. 71.09 of the Village Code. - . -- .. -. .?'. Note: It is now August ll, 1971 CAR REDUCTION CENTER Swenson moved and Andreasen secorded a motion BE IT MOVED, by the Village Council of the Village that the staff be directed to refer to the Planning Commission a request to review the ordinance for car reduction use and rezoning of Section 23 Plat 61223 and tbat part of Parcel 300 lying north of the railroad tracks for use as an auto reductmon area.~ The vote was unanimously in favor so carried. ~NUTES July 27, 1971 meeting The minutes of the July 27, 1971 meeting were read. Councilman Swenson requested that the annual salary of the Police Chief be included in Resolution 71-226 ($11,783.00). Schmidt moved and Ulrick seconded a motion to acceot the minutes of July 27, 1971 with the annual salary of the Police Chief of $11,783.00 included on resolution 71-226. The vote was unanimously in favor, so carried and approved.
