Ulrick seconded, a motion to move Ordinance 296 ORDINANCE NO. ~96 AN ORDINANCE AMENDING SECTION ]5.O7 EX~ERDZNG THE TIME FOR EXCAVATION PERMITS AND E~TABLISHINO THE FEE The Village Counct~ o~ the ¥illags of Mound does hereby ordain as follows! Section }5.07 is amended to read as follows~ Section }5.07 ~inir~ - Excavation - Permits, applications, re.p., ' terms! re~ewa!. Application for the permit as required by 'Sections }~.0~ and }5.06 shall be made to the ¥illage Council, in writing, and filed with the ¥illage Clerk together with the fee therefor in the amount of $~0.00. Such application shall state the name and address of the applicant, and if such applicant is a corporation, the names and addresses of the officers thereof. Such application shallalso state the common desJription of the property to be excavated, or dug upon, together with the legal description thereof, a diagram of the proposed excavation showing the relation thereof to lot lines, existing and proposed streets, natural water courses and exist- lng buildings. In such cases as seem appropriate or where required by the council, the application shall also include an~ one, or a combination of the following~ togographic map of the area to be excavated together with the surrounding area, name and address of the supervising engineer, name and address of the hydrological engineer, destination of any soil, earth, sand gravel or other such material as is being removed from the site, explanation of what efforts were made to dispose of or sell the same locally, name and address of the fee owner of such property, all outstanding interests in the property together with the nature of each and the name and address of holder thereof, and ~uch other information as may seem appropriate or necessax~. 'Such application shall be signed by the applicant and verified before some officer authorized to administer such oath. If granted, such permit shall be valid for a period of one year froa the date of issuance. If the permit is denied, the appli- cation fee shall.be refunded. The Council shall establish a time period for compliance with ar~y provisions which are suspended. Said license shall be effective upon issuance, but may be revoked for failure of the licensee to comply with the time schedule so established. The licensee of any license granted pursuant to this subsection shall be deemed to have waived his right to a public hearing prior to revocation under this subsection. 11.50 Subdivision 11 amended to read as follows: (4) No 'on-sale' license shall be granted for a~ restaurant which does not comply in all respects with the definition of a restaurant as contained in Subdivision 1 of this section, nor to any restaurant which does not have a total market value, including land, building and equipment, of at least $155,000.00 as appraised by the village assessor. The foregoing valuation provision shall not apply to the existing municipal on-sale liquor dispensary or to the terms established by the Council under the a=thority established by Section 11.50, Subdivision 9, Subsection ~ of this Ordinance. 11.50 Subdivision 11 of the Village Code is amended to add Sub- s~tion 7 which shall read as follows: (7) Any club as defined~- M.S.A. 340.07, Subdivision 15, or any licensee who discriminates or excludes any person from fall and equal enjoyment of the licensed establishment on account of race, color, national origin, sex or religion. This provision shall also apply to any club or licensee which by its Articles of Incorporation, National Charter, State Charter or By-Laws excludes or discriminates against persons for the reasons stated herein. Passed unanimously, so adjourned. ~a~bara Heyman~ Villag~lerk 68 MINUTES OF THE MOUND COUNCIL MEETING SITTING AS A BOARD OF P~VI~' at 7:30 P.M. at SHIRLEY HILLS SCHOOL, MOUND, MINNESOTA Present were: Mayor John D. Kotula, Councilmen John Andreasen, Gordon Swenson, Eldo Schmidt and Donald Ulrick; Village Manager Leonard Kopp, Assessor Helen Newell and Hennepin County representative Robert Martin. The Mayor explained the tax base and showed projections of the division of the tax dollar, real estate sales for 1970 and 1971 and the history of five selected houses with the Assessor's appraised valuation and the selling prices. Mr Martin answered questions of a general nature about assessed valuations and market values. Note: Numbered questionaires were passed out and each number when called in turn came up and sat down with the council, the assessor and the county represent- atives, and discussed their particular problem.
