The .minutes of the February 22, 1972 .meeting were presented. On Resolution 73-60
The maker of the motion, Orval Fenstad and the seconding party, Gordon Swenson were
omitted. Fenstad moved and Swenson seconded a .motion to accept the minutes of the
February 22, 1973 meeting as corrected. The vote was unanimously in favor, so
accepted.

46.125 IMPOSING WEIGHT RESTRICTIONS FOR
VEHICLES OPERATING ON VILLAGE STREETS AND
HIGHWAYS
The Village of Mound does ordain=
Sections 46.12 through 46.12[ are hereby added to the viklage
Code and shall read as follows=
Section 46.12. Definitions.
Subd. 1. A "Vehicle" as used in this chapter is defined aa
including all motor vehicles, house trailers and trailers
of all kinds or any objects or contrivances being moved on
wheels of any kind.
Subd. 2. A "Single Axle" as used in this chapter is de-
fined as including all wheels whose centers may be included
within two parallel transverse vertical planes 40 inches
apart.
Section 46.121. Weight Restrictions. No vehicles or combina-
tion of vehicles equipped with pneumatic 'tires shall be operated upon
the streets or highways of the Village when the gross weight of any
single wheel exceeds 9,000'pounds, or when the gross weight of any
single axle exceeds 18,000 pounds. The Village Engineer may prohibit
the operation of vehicles upon any public streets or impose further
restrictions as to the weight of vehicles to be operated upon said
street, whenever such s~reet by reason of deterioration, rain, snow,
or other climate conditions will be seriously damaged or destroyed
unless the use of vehicles thereon is prohibited, or the permissible
weights thereon are reduced.
The Village Engineer is hereby authorized t? erect and maintain
or cause to be erected and maintained, signs plainly indicating the
prohibition or restriction at each end of'that portion of any street
affected thereby, and the prohibition or restriction shall not be
effective unless and until such signs are erected and maintained.
The Village Engineer is authorized to issue a permit to school
buses, garbage trucks, Village owned .street repair equipment or for
emergency vehicles needed to protect the public health, safety and
general welfare to operate on streets subject to these weight restric-
tions. Said permits shall be issued only if there is no other
feasible way to protect the public health, safety and general welfare.

Section 46.122. No Pneumatic Tires. A vehicle or combination of
vehicles not equipped with pneumatic ti~es shall be governed by the
foregoing provisions, except that the gross weight limitations shall
be reduced by 40%.
Section 46.123. Weighing. Any police officer or duly authorized
person having reason to believe that the weight of a vehicle and load
is unlawful, is authorized to require the driver to stop and submit
to a weighing of the same, either by means of a portable or stationary
scale and may require that such vehicles be driven to the nearest
public scale. For purpose of weighing, vehicles shall not be taken a
greater distance than two (2) miles, except in such cases where scales
of sufficient capacity are not available within such limits.
Section 46.124. Load RemoVal. Whenever an officer upon weighing
a vehicle and load, as above provided, determines that the weight is
unlawful, such officer may require the driver to stop the vehicle in
a suitable place and remain standing until such portion of the load
is removed as may be necessary to reduce the gross weight to such
limit as permitted under this chapter. Ail material so unloaded shall
be cared for by the owner or driver of such vehicle at the risk of
9uch owner or driver.
Section 46.125. Emergenc~ Waiver. .In case of emergency or
necessity any person may make ~r'Itten application to the Village
Engineer for a waiver of any weight restrictions or any regulation
imposed hereunder and the Engineer may in his sound discretion grant
such waivers under terms and conditions as he may deem advisable.
