1973-05-22MINUTES OF THE COUNCIL MEETING OF MAY 22, 1973 st 8 P.M. st the SHIRLEY HILLS SCHOOL MOUND, MINNESOTA Present at roll call were: Acting Mayor John Andreasen; Councilmen Gordon Swenson, Orval Fenstad and Donald Ulrick; Attorney Curtis Pearson, Village Manager Leonard Kopp and Engineer Keith Englesby. MINUTES The minutes of the May 8, 1973 meeting were presented for consideration. Corrections were msde on Resolution 73-138 the vote read as being unanimously in favor and on this resolution dealing with Senate File 1246 on Elections Mayor Kotuls had voted nay; on Resolution 73-139 naming an Acting Manager the name was omitted, the name Barbara Heyman was added to the title of the Resolution. Fenstsd moved and Swenson seconded a motion to accept the minutes of the May 8, 1973 meeting as corrected. The vote was unanimously in favor. FLANNING COMMISSION RECOMMENDATIONS Swenson moved and Ulrick seconded a motion BE IT MOVED, by the Village ~ouncil that the appeal of Paul Peterson for a side yard variance be tabled. The vote was unanimously in favor. The appeal of Elder-Jones was set for the .meeting of June 12, 1973, to allow the attorney to prepare a resolution of denial and or allow the applicsnt to acquire additional property, ' NEW MUNICIPAL BUILDING Fir James O'Brien of the fimm of Williams/O'Brien ~,Associstes, Inc. Architectural firm designing the new Municipal Building in Mound, appeared before the council with the final plans for the building, all changes requested had been .made. ~enstad moved and Ulrick seconded a motion The vote was unanimously in favor RESOLUTION APPROVING PLANS ~ SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS (open June 21 and considered June 26, 1973) LAKE REGION FfOTUAL AID ASSOCIATION Manager stated that the present agreement contains~no cla. Swenson moved and Andreasen seconded a motion P~SOLUT~O~ 73- i4~ The vote was unanimously in favor RESOLUTION STATING THAT MOUND HAS NO OBJECTION TO CHASKA, VICTORIA AND ST BONIFACIUS BECOFLING'MEI~ERS OF THE LAKEREGION FIRE LEAGUE WATER-SEWERACCOUNT #i6-i586 Ulrick moved and Fenstad seconded a motion 76. The vote was unanimously in favor. COMMENTS AND SUGGESTIONS BY CITIZENS PRESENT Margaret Vanecek, ~72h Sunset Road Children~r¢ loitering around the stores, can they be tagged? ~fhy can't the police put them to work, cleaning up the parks and sweeping the streets? Attorney answered: They can be charged but the loitering law is very weak, a curfew ordinance for 16 year olds is 10 P.M. can be used but only a judge could impose a weking penalty and then only if the person had been arrested and befere the judge for sentencing. It is very difficult to name one person out'of a group when a window is broken these incidents are not witnessed by a police officer so no charge is made. Richard Catton, 6020 Chestnut Road James Carlson, 60h8 Chestnut Road Robert Whittaker, 6000 Chestnut Road Mr Catton spoke for the group and stated that in the summer of 1972 they were promised that their road would be sealed or black-topped ss it wes before the sewer was installed; but nothing was done after the council hsd promised it would be done in 1972. Engineer answered: The road was watched in 1972 but the weather prevented the work being done then; it is scheduled for June this year if it drys sufficiently for the work to be done. Richard Thomas, 28~8 Highland Blvd. Had heard about a clean-up project in Mound and wanted the corner of Highland and Bartlett Blvds cleaned up, the Mpls Star and Tribune use this as a drop for newspapers and it is never cleaned up. Manager answered: We will call the Mpls. Star and Tribune and they usually cooperate with us in getting areas cleaned. Francis Broich, Piggly Wiggly, 22h0 Commerce Blvd. Being too late for the agenda he used this section of the agenda to bring up a new location of the Burger Shoppe lh feet from the sidewalk instead o£ the or§inal 10 £eet~ wanted permission to proceed. Acting Mayor Andreasen answered: This should be brought up at a committee session and invited Mr Broich to attend a Committee session on May 29th at the Village Office. Attorney Pearson asked to have a layout of the number of parking spaces and the legal description of the property to be removed from the lease. Mr Broich stated he would call the surveyor, Gordon Coffin and see if he could do this work before the 29th. VILLAGE CLEAN UP Fenstad moved and Swenson seconded a motion RESOLUTION 73-128 The vote was unanimously in favor RESOLUTION ACCEPTING BIDS OF SCHOENING AND ILLIES TO PICK UP TRASH IN THE VILLAGE AND DIRECTING PUBLISHING NOTICE OF PICKUP REVENUE SHARING FUNDS Swenson moved and Ulrick seconded a motion ?7. RESOLUTION 73-150 The vote was unanimously in favor RESOLUTION AUTHORIZING AUCTION OF SURPLUS AND UNCLAIMED PROPERTY HELD BY THE VILLAGE DOCK LIST NUMBER TWO Ulrick moved and Fenstsd seconded s .motion RESOLUTION 73-151 RESOLUTION GRANTING DOCK LICENSES (List No. 2) The vote was unanimously in favor BINGO REQUEST The Northwest Tonka Lions Club requested permission to hold s Bingo on June 29-30 and July 1, 1973. No action was taken. BIKE HIKE PATH Swenson .moved and Ulrick seconded a .motion RESOLUTION 73-1~2 The vote was unanimously in favor RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEME~T FOR BIDS - Bike-Hike Paths Bids to be opened June 11 go to Council June 12, 1973 Gordon Swenson discussed the deplorable condition of the Island Park Hall, further discussion will be at the Committee session May 29th. Donald Ulrick suggested that the village council meet with the new school board and directed the Manager to contact the school superintendent to set up such .meeting. Orval Fenstad brought up the new law that will allow 18 year olds to drink hard liquor and discussed what they could do if a great .many were to avail themselves of the then lawful activity. Swenson ~moved and Fenstad seconded a motion to amend Chapter 5h of the Mound Code of Ordinances by changing the age from 16 years old to ~up to the 18th birthday's. ORDINANCE 3O6 AN ORDINANCE AMENDING SECTIONS 5h.lO, 5h.ll AND 5h. 12 OF THE VILLAGE CODE INCREASING THE THE AGE REQUIRLMENTS IN THE CURFEW PROVISIONS The Village of Mound does ordain: Section ~.10. Loiterin~ of Minors Prohibited It shall be un]awful for any minor under the age of eighteen years to loiter, idle, wander, stroll~ or play in or upon the public streets, highways, roads, alleys, parks, plAy- grounds, or other public grounds, public places and public buildings, places 78. Section ~.11 Responsibility of Parents It shall be unlawful for the parent, guardian, or other adult person having the care and custody of a minor under the age of eighteen years to knowingly permit such minor to loiter, idle, wander, stroll, or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places, between the hours of 10:00 P.M. of any day and ~:00 A.M. of the following day, official city time; provided, however, that~the provisions of this section do not apply when the minor is accompanied by his or her parent, guardian, or other person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of the minor. Each violation of the provisions of this section shall constitute a separate offense. Section 52.12 Responsibility of Proprietors; Operators and Employees It shall be unlawful for the proprietor~ operator or any employee of any commercial establishment to knowingly permit any minor under the age of eighteen years to loiter, idle, wander or in any way remain in or around and about his said establishment between the hours of 10:00 P.M. of any day and 5:00 A.M. of the following day, except when such .minor is accompanied by his or her parent, guardian or other adult person having the care and custody of such minor or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor. Each violation of the provision of this section shall constitute a separate offense. The roll call vote was unanimously in favor. BILLS The following bills were presented for consideration.
