1973-09-25MINUTES OF THE COUNCIL MEETING OF SEPTEMBER 25, 1973 at 8:00 P.M. at SHIRLEY HILLS SCHOOL, MOUND, MINNESOTA PRESENT AT ROLL CALL WERE: Acting Mayor John Andreasen, Councilman Donald Ulrick, Orval Fenstad and Gordon Swanson, Engineer Englesby, Attorney Curtis Pearson Acting Village Manager Barbara Heyman and Building Inspector Henry Truelsen. The Mayor arrived later in the meeting. MINUTES The minutes of September ll, 1973 meeting were presented for consideration. Fenstad moved and Swenson seconded a motion to accept the minutes of September ll, 1973 meeting as presented. The vote was unanimously in favor. The minutes of the special meeting of September 18, 1973 were presented for consideration. Ulrick moved and Fenstad seconded a motion to accept the minutes of the September 18, 1973 meeting as presented. The vote was unanimously in favor. EEARING ON CBD 1973 MAINTENANCE Engineer Engleeby outlined the project. Swanson moved and Fenstad seconded. RESOEUTION NO. 73-300 RESOLUTION APPROVING THE SPECIAL ASSESSmeNT (CBD 1973 Maintenance from June l, 1972 to May 3i, 1973 - One year at 8%) Passed unanimously. SECURITY LIGHT The Youth Commission has suggested a night light near the school tennis court on Alder Road. Fenstad moved and Swenson seconded a motion RESOLUTION NO. 73-301 RESOLUTION ORDERING INSTALLATION OF SECURITY LIGHT ON ALDER ROAD Passed.unanimously. POLICE RIDE-ALONG PROGRAM The Youth Commission has recommended that a Police Ride-along Program be estab- lished. A proposed policy and application form have been reviewed by the Council but Frank Philbrookwas present and requested that the guide lines be sent to the Youth Commission for reviewal before arAy action be taken on it. Yenstad moved and Swenson seconded to defer action to October 23, 1973. Passed unanimously. BLACKTOP CURB & BLACKTOP STREET - Beachwood A petition has been received from the residents along Beachwood Road from Rosewood to Westedge for blacktop street and blacktop curb. Ulrick moved and Fenstad seconded a motion . RESOLUTION NO. 73-302 RESOLUTION ORDERING PREPARATION OF REPORT ON IMPROVEMENT - Project 73-43 Beachwood Street Passed unanimously. LIQUOR STORE STORAGE Swanson moved and Ulrick seconded a motion. RESOLUTION NO. 73-3O3 RESOLUTION AUTHORIZING THE MAYOR AND MANAGER TO ENTER INTO AGBRRMENT FOR ADDITIONAL STORAGE SPACE FOR THE MOUND LIQUOR STORE Passed unanimously. M~yor Kotula arrived at 8:25. SIREN - Reconsideration of Location At the September 11 meeting the Council decided that the new siren should be located at the Fire Station. It has been suggested that it may be worth con- sidering placing the new siren on the existing tower and moving the present siren to Island Park. Fenstad moved and Kotula seconded the motion RESOLUTION NO. 73-304 Roll call vote: Swenson Aye Ulrick Aye Andreasen Aye Fenstad Aye Kotula Aye So resolved. RESOLUTIGN DIRECTING TEAT THE NEW SIREN BE PLACED ON THE EXISTING TOWER AND THAT THE EXISTING SIREN BE MOVED TO ISLAND PARK WITH CONTROLS IN TEE FIRE STATION AND THE VILLAGE OFFICE. COMMENTS AND SUGGESTIONS BY CITIZENS PRESENT Frank Philbrook reported he would have the Curfew Report from the Youth Commission read~ for the next meeting. He liked Councilman And_reasen's recommendation that it be presented to the school also. David Harrison expressed the thanks of the Shirley Hills residents for recon- sidering the placing of the mire. Jeanette Gelman questioned if 14-year olds would be covered by insurance in the Police Ride-AlongProg~am. The mayor answered they were. TRANSFER OF GRAVES IN LOT 52, ~IVISION A Andresen moved and S~enson seconded a motion RESOLUTION NO. 73-305 RESOLUTION AUTHORIZING TRANSFE~ OF GRAVES IN LOT 52, DIVISION A Paesed unanimously. LMCD Fenstad moved and Kotula seconded a motion. RESOLUTION NO. 73-306 RESOLUTION OPPOSING RESOLUTION SUGGESTED BY ORONO CONCERNING LEGISLATION FOR THE LAKE MINNETONKA CONSERVATION DISTRICT AND/ OR MINNEHAHA C~E~K WATERSHED DISTRICT TO REGULATE LAKE MINNETONEA' S SHORELINE AND ITS DEVELOPMENT Passed ~uanimously. TORRENCE STIPULATION ON SPRUCE ROAD Andreasen moved and Ulrick seconded and it was unanimously carried to defer action on a torrence stipulation on Spruce Road. NSF CHECK Swenson moved and Andreasen seconded a motion RESOLUTION NO. 73-307 RESOLUTION DIRECTING THE MANAGER TO TAKE NSF CHECK ~1416 MADE BY NORTHSHORE DRIVE MARINA ON JULY 28, 1973 to CONCILIATION COURT Passed unanimously. ON SALE LIQUOR LICENSE HEARING - S~rfside, Inc. Andreasen moved and S~enson seconded a motion. RESOLUTION NO. 73-308 Passed unanimously. REFUND OF BUILDING PERMIT NO. RESOLUTION ESTABLISHING THE HEARING DATE FOR A PRIVATE ON SALE LIQUOR LICENSE (Surfside, Inc.) AS OCTOBER 9, 1975. 3188 Swenson moved and Andreasen seconded a motion. RESOLUTION NO. 73-309 RESOLUTION AUTHORIZING REFUND OF $15.00 ON BUILDING PERMIT NO. 3188. Passed unanimously. Andreasen moved, Fenstad seconded, and it was unanimously caz~ied to adjourn to October 9, 1973 at 8:00 P.M. at the Shirley Hills School.
