1976-09-28129 MINUTES OF THE COUNCIL ~dETING OF SEPTEMBER 28, 1976 AT 7:30 P.M. AT THE MOUND CITY HALL Present were: ~Myor Donald Ulrick; Councilmen Cordon Swenson, Tim Lovaasen, Orval Fenstad and Frank Philbrook (who arrived at 7:50 P.M.); Attorney Curtis Pearson and Acting City ~nager. Barbara Hey~an. MINUTES The minutes of the meetings of September 15, 21 and 22 were presented. Swenson moved and Lovaasen seconded a motion that the minutes of these meetings be con- sidered at the October 5th meeting. The vote to continue was unanimously approved. BIDS FOR T~P~EE POINTS STREET IMPROVEMENT PROJECT (Gull, Heron, Crestview and Jennings) William McCombs presented a bid tabulation for the bids and recommended the low bidder, C.S. McCrossan, be awarded the bid. Weather permitting, completion date will be in November. Lovaasen moved and Swenson seconded a mot±on RESOLUTION 76-375 RESOLUTION ACCEPTING THE BIDS AND AWARDING THE BID TO C. S. McCROSSAN, INC. FOR $78,433.25. The vote was unanimously in favor. RIDGEWOOD ROAD STORM SEWER ASSESSMENT HEARING William McCombs stated that the Priest Lane area had been checked and it was his opinion that the area should be included based on criteria used for assess- ing storm sewer drainage. Cost of project $28,624.81. A group of citizens living on Priest Lane protested that their land did not benefit from this storm sewer. Speaking were: John Carrier Bob 0lander Sue Carrier Ed Linn Marie Clifford Councilman Philbrook arrived. Mr. 01ander questioned whether the opinion of an independent surveyor should be gotten. Discussed benefit credit being granted on future project. City land should be assessed. Council was polled on feelings on double assessment: Swenson - Opposed, once assessed that should be it. Lovaasen - Like to see it that way, but ~ust assess to benefited properties; it would be best to do whole total project. Fenstad - Double assessment not fair; some credit should be worked out. Philbrook Double benefit can't actually exist; should be no need for second assessment; should look at whole criteria. Ulrick - Feel that people here can't be taxed again for second assessment; only benefit is what is assessed today. ~enson moved and Fenstad seconded a motion RESOLUTION 76-~76 RESOLUTION ADOPTING RESOLUTION REGARDING FUTURE STORM S~ER ASSESSMENTS. The vote Philbrook Nay; all others aye - so approved. Lovaasen moved and Ulrick seconded a motion RESOLUTION 76-377 RESOLUTION TO ACCEPT TI-bi REVISED ASSESS~.fENT ROLL AND APPROVE TI~E SPECIAL ASSESSMJENT FOR RIDGAA~00D ROAD STOR2,I SEWER (8~ - 15 years - pay within 30 days at no interest charge) Roll Call Vote.' Fenstad - Aye Philbrook - Nay; not proven fact that Priest Lane properties benefited. Ulrick - Aye Lovaasen - Aye Swens on ~ - ~ye The mayor recognized ~ary Willis, candidate for the State Senate from the 42nd Senatorial District. Mary Willis spoke briefly. Donald Drive Comments: Bill Smith - driveway not complete yet; roots of tree cut endangering power lines - should be removed (Will contact NSP) Donald Gehrke - driveway patched, ridges in - not acceptable; ~'rade on bank too steep, should have been sloped back. Lovaasen moved and Ulrick seconded a motion RESOLUTION 76-378 RESOLUTION TO ORDER A CHANGE ORDER FOR GRADE ON Lots ll and 12, Block 12, Pembroke, REDO THE ASSESSF~NT ROLL AND CONTLNVJE DONALD DRIVE ASSESS- ME~ HF~ARING UNTIL OCTOBER 5, 1976. The vote was unanimously in favor. No comments from citizens present. CETA C 0NTRACT Fenstad moved and Philbrook seconded a motion RESOLUTION 76-379 RESOLUTION AUTHORIZING THE MAYOR AND FF~.NA. GER TO -' SIGN NEW AGREEMENT BETWEEN THE COUNTY OF HENNE- PIN AND THE CITY OF MOUND REGARDING CETA FUNDS. The vote was unanimously in favor. DONALD DRIVE STREET SLOPE RATIO William McCombs requested Council to set a slope ratio on Lots ll and 12, Block 12, Pembroke. Philbrook moved and Swenson seconded a motion RESOLUTION 76-380 RESOLUTION SETTING A SLOPE RATIO OF 2 TO 1. The vote was unanimously in favor. DRIVEWAY STANDARDS Fenstad moved and Ulrick seconded a motion to table the discussion on "Driveway Standards". The vote was Lovaasen nay; all others aye - so tabled. ISLAND PARK GRADING AND DRAINAGE Lovaasen moved and Fenstad seconded a motion RESOLUTION 76-381 RESOLUTION TO ORDER THE PLANS AND SPECIFICATIONS FOR ISLAND PARE GRADING AND DRAINAGE (HUD Funds available ) The vote was unanimously in favor. DISCUSSED: HUD Grant Water & Sewer Account 310-3021 - No action taken. Seahorse Condominium - No action needed Lot 17, Block 21, Wychwood Problem of Island Park residents with new construction project on Monmouth. Attorney reported status of Roelof vs City of Mound - Court hearing continued to Novemberl6th. Lovaasen moved and Ulrick seconded a motion to adjourn. Vote was unanimously in favor; so adjourned.
