1976-11-09148 MINUTES OF THE COUNCIL MEETING OF NOVEMBER 9, ~976 at 7:30 P.M. at the MOUND COUNCIL CHAMBERS Present were: Mayor Donald Ulrick; Councilmen Gordon Swenson, Tim Lovaasen, Orval Fenstad and Frank Phi lbrook (who arrived, at 9:10 P.M. ); Attorney Curtis Pearson and City Manager Leonard L. Kopp. MINUTES The minutes of the council meeting of Nov ember were presented for consideration. Fenstad moved and Swenson second(e~i a motion to accept the minutes of the November 3, 1976 meeting as presented. The vote was unanimously in favor, so carried and accepted. PLANNING COMMISSION RECOMMENDATIONS Item 1 Phoenix Builders Lot 5, Block 8, Dreamwood Request Lot Size Variance MarkSolstad, attorney represented Phoenix Builders. He stated that if the variance was not granted it wou! d constitute a taking of property without compensation. This property is under a purchase agreement at this time. Fenstad moved and Swenson seconded a motion RESOLUTION 76-424 RESOLUTION WAIVING REQUIREMENTS OF CHAPTER 22 OF THE CITY CODE REGARD- ING THE DIVISION OF PROPERTY- Part of Lot 6, Lot 7,~lock 9, The Highlands - Stipulations attached include a lateral sewer waiver of $904.00 The vote was unanimously in favor PROBLEMS WITH CORNER LOTS Lovaasen moved and Fenstad seconded a motion BE IT MOVED, by the City Council that the Planning Commission be requested to study Section 23.31 of the Zoning Ordinance; and the staff is direi~ted to arrange a meeting of the City Council, the Planning Commission and the Building Inspector, in regards to this portion of the Zoning Ordinance. The vote was unanimously in favor. DOG SLED RACES Bernie Bauhof appeared before the council and. requested, their approval of sled dog races to be held January 22 and. 23, 197', on Cook's Bay. Swenson moved and Lovaasen seconded a motion RESOLUTION 76-425 The vote was unanimously in favor RESOLUTION GRANTING PERMISSION TO THE SIBERIAN HUSKY CLUB TO HOLD DOG SLED RACES JANUARY 22 and 23, 1977 ON COOK'S BAY, LAKE MINNETONKA. CITY HALL ROOF Mr. J. O'Brien, the architect for City Hall, appeared before the council in regards to the roof which has leaked, from June of 1974; he requested, the council to authorize bids on the roof. He assured the council that if during the work it was discovered that the leak was the fault of the architect thru design of the structure they will accept that res ponsibility. Fenstad moved and Ulrick seconded a motion RESOLUTION 76-426 The vote was unanimously in favor RESOLUTION APPROVING THE PLANS AND SPECS FOR THE REPAIR OF THE CITY HALL AND CALL FOR BIDS NOT TO EXCEED $8,000.00. WESTONKA ACTIVITY CENTER Ron Kullberg, president of the Westonka Chamber of Commerce appeared before the council to discuss the status of the lease on the Westonka Activity Center. He stated that they have debts of $3,046. 14 for work on the building and now do not have any insurance for this building. NOTE: Councilman Frank Phitbr'ook arrived at 9:10 P.M. 151 Butch Essig wants the council to wait for the new board of the Chamber of Commerce to take office in January. Attorney Curt Pearson stated that the Chamber of Commerce is now in default of the lease, for not carrying insurance and not notifying the council of their intention to renew the lease before August 1975. Fenstad moved and Lovaasen seconded a motion RES OLU TION '/b-427 The vote was unanimously i,n tavor BICENTENNIAL COMMITTEE RESOLUTION TERMINATING THE LEASE OF THE WESTONKA CHAMBER OF COMMERCE FOR THE WESTONKA ACTIVITY CENTER Charley Jackson appeared before the council to report on the final activities of the Bicentennial Committee, theiiburial of the capsule on November 12th and. request $200.00 from the City of Mound as their share of the burial expense.
