AUGUST 23, 2005
The Housing and Redevelopment Authority of and for the City of Mound, Minnesota,
met in regular session on Tuesday, August 23, 2005, at 7:20 p.m. in the council
chambers of city hall.
Members Present: Chairperson Pat Meisel; Commissioners Bob Brown, Mike Specht,
and John Beise.
Members Absent: David Osmek.
Others Present: City Attorney John Dean, Executive Director Kandis Hanson, City
Clerk Bonnie Ritter, Community Development Director Sarah Smith, Cindy Reiter

Chairperson Meisel called the meeting to order at 7:20 p.m.
2. Approve Aqenda
MOTION by Brown, seconded by Beise to approve the agenda.
Motion carried.
All voted in favor.
3. Approve Minutes
MOTION by Beise, seconded by Specht to approve the minutes of the July 26, 2005
meeting. All voted in favor. Motion carried.
4. Appoint Tenant Representative for Indian Knoll
MOTION by Specht, seconded by Brown to table this until the next meeting. All voted in
favor. Motion carried.
5. Management Report on Indian Knoll Manor
Cindy Reiter presented the management report as follows
A. July Bank Statement
B. June Income Statement
C. Review of Bills paid: MOTION by Brown, seconded by Specht to.approve
payment of the July bills. All voted in favor. Motion carried.
D. Manager's Report: Reiter stated that the new club room furniture has been
ordered.
Meisel stated that the received a letter from a tenant referencing large dogs living in the
building. Reiter knows of only one, which is a seeing-eye dog and will check on this.

RESOLUTION NO. 05- H
RESOLUTION MAKING A SELECTION NOT TO WAIVE THE STATUTORY TORT
LIMITS FOR LIABILITY INSURANCE PURPOSES
WHEREAS, pursuant to previous action taken, the League of Minnesota Cities
Insurance Trust has asked the Housing and Redevelopment Authority of and for the
City of Mound to make an election with regards to waiving or not waiving its tort liability
established by Minnesota Statutes 466.04; and
WHEREAS, the choices available are; to not waive the statutory limit, to waive the limit
but to keep insurance coverage at the statutory limit, and to waive the limit and to add
insurance to a new level;
NOW, THEREFORE BE IT RESOLVED by the Housing and Redevelopment Authority
of and for the City of Mound, Minnesota, to hereby elect not to waive the statutory tort
liability established by Minnesota Statutes 1466.04; and, that such election is effective
until amended by further resolution of the Mound HRA.

Re: Insurance Liability Coverage, Resolution not to waive statutory tort limits
The Housing and Redevelopment Authority of Mound (HRA) must decide if the HRA
does or does not waive the statutory tort limits.
In the past, on mn annual basis, the HRA has not waived the statutory tort limits. With this
resolution the HRA would elect not to waive the statutory tort liability established by
Minnesota Statutes 466.04. Such election would be effective until amended by further
resolution of the Mound HRA.
Administration recommends approval of this resolution and if you have questions on this

LMCIT LIABILTIY COVERAGE - WAIVER FORM
Cities obtaining liability coverage from the League of Minnesota Cities Insurance Trust must decide
whether or not to waive the statutory tort liability limits to the extent of the coverage purchased. The
decision to waive or not to waive the statutory limits has the following effects.
If the city does not waive the statutory tort limits, an individual claimant would be able to recover
no more than $300,000 on any claim to which the statutory tort limits apply. The total which all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply
would be limited to $1,000,000. These statutory tort limits would apply regardless of whether or not the
city purchases the optional excess liability coverage.
If the city waives the statutory tort limits and does not purchase excess liability coverage, a single
claimant could potentially recover up to $1,000,000 on a single occurrence. The total which all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply
would also be limited to $1,000,000, regardless of the number of claimants.
If the city waives the statutory tort limits and purchases excess 'liability coverage, a single claimant
could potentially recover an amount up to the limit of the coverage purchased. The total which all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply would
also be limited to the amount of coverage purchased, regardless of the number of claimants.
Claims to which .the statutory municipal tort limits do not apply are not affected by this decision.
The decision must be made by the city council. Cities purchasing coverage must complete and return
this form to the LMCIT before the effective date of the coverage. For further information, contact
LMCIT. You may also wish to discuss these issues with your city attorney.
The City of Housing and Redevelopment Authority of Mound accepts liability coverage limits of
$ 300,000/1,000,000 from the League of Minnesota Cities Insurance Trust (LMCIT).

RESOLUTION NO. 05-XXH
A RESOLUTION ESTABLISHING THE TAX LEVY FOR THE MOUND HOUSING AND
REDEVELOPMENT AUTHORITY FOR THE YEAR 2006
BE IT RESOLVED by the Housing and Redevelopment Authority of the City of Mound,
as follows:
Section 1: That there be and hereby is levied $153,720 for the year 2006 on all
taxable property, real and personal, situated within the corporate limits of the City of
Mound and not exempted by the Constitution of the State of Minnesota, for the
purposes of establishing an HRA Fund and conducting the operation of an HRA
pursuant to the provisions of MS 469.001 through 469.068.
Section 2: That the consent resolution by the City Council of the City of Mound to this
special tax for the operation of the Housing and Redevelopment Authority is attached to
this resolution and made a part hereof.
Section 3: That said tax levy shall be certified to the County Auditor of Hennepin
County on or before September 15, 2005.
Adopted by the Housing and Redevelopment Authority this 13th day of September,
2005.
