1978-05-23May 23, 1978 088 REGULAR MEETING OF THE CITY COUNCIL Pursuant to due call and notice thereof a regular meeting of the City Council of the City of Mound, Hennepin County, Minnesota was held at 5341Maywood Road in said City on May 23, 1978 at 7:30 P.M. Those present were: Mayor Tim Lovaasen, Councilmembers Gordon Swenson, Orval Fenstad and Robert Polston. Councilman Benjamin Withhart was out of town and excused. Also present was City Manager Leonard L. Kopp, City Attorney Curtis A. Pearson, Assistant City Engineer Lyle Swanson and Acting City Clerk Marjorie Stutsman. MINUTES The minutes of the meeting of May 16, 1978 were presented for consideration. Fenstad moved and Polston seconded a motion to approve the minutes of the meeting of May 16, 1978 as submitted. The vote was unanimously Tn favor. PARK IN WOODCREST Lovaasen moved and Fenstad seconded a motion RESOLUTION 78-253 RESOLUTION ACCEPTING THE PARK DEDICATION OF $9,460.00 FROM THE DEVELOPER OF WOODCREST IN LIEU OF A DRY PARK. The vote was unanimously in favor. 1979 Street Program - Council Memorandum 78-169 The 1979 Street Porgram was discussed~ criteria and feasibility of making Bradford Road an MSA street and what streets should be included in the 1979 program. Polston moved and Swenson seconded a motion RESOLUTION 78-254 ADOPT A RESOLUTION TO ORDER A PRELIMINARY RE- PORT ON STREETS SUGGESTED FOR 1979 CONSTRUCT- ION WITH THE ADDITION OF BRADFORD TO LESLIE LANE (MSA) AND BARTLETT BOULEVARD FROM WILSHIRE BOULEVARD TO FAIRVIEW LANE (MSA) AND ELM ROAD- IRONWOOD LANE-SUNSET ROAD-SYCAMORE LANE WITH WATERMAIN REPLACEMENT AS NEEDED The vote was unanimously in favor. COMMENTS AND SUGGESTIONS BY CITIZENS PRESENT No one present wished to be heard BIDS FOR CITY WIDE PICKUP Fenstad moved and Swenson seconded a motion RESOLUTION 78-255 RESOLUTION ACCEPTING THE BIDS FOR CITY WIDE PICKUP AND AWARDING THE BID TO THE LOW BIDDER, ILLIES & SON The vote was unanimously in favor DOCK PERMIT REFUNDS Polston moved and Swenson seconded a motion RESOLUTION 78-256 RESOLUTION AUTHORIZING PAYMENT OF DOCK PERMIT REFUNDS - Second List The vote was unanimously in favor. 090 May 23, 1978 Council: requested a survey be made of costs of time spent on docks and fees charged by other cities; would like to have a recommendation from the Park Commission on fees charged. WEED CUTTING ORDINANCE Fenstad moved and Polston seconded a motion to ordain the following ordinance: ORDINANCE NO. 380 AN ORDINANCE AMENDING SECTION 60.02 SUBDIVISION (d) OF THE CITY CODE, DEFINING AS A NUISANCE GRASS AND NOXIOUS WEEDS ON PUBLIC BOULEVARDS AND ON PRIVATE PROPERTY AND ESTABLISH- ING REGULATIONS RELATING TO THEIR CONTROL The City of Mound does ordain: Section 60.02 Subd. (d) of the City Code is amended to read as follows: (d.) All excessive growth of weeds, and any noxious weeds as defined in Sec. 18.171, Subdivision 5 Minnesota Statutes shall be considered a nuisance and controlled or destroyed by the City's weed inspector pursuant to this ordinance and Chapter 18 of the Minnesota Statutes. The regulatory pro- visions of Minnesota Statutes 1976, Sections 18.171 to 18.272 are hereby adopted for the control of noxious weeds within the City of Mound and three copies of said sections of the Minnesota Statutes are on file in the office of the City Clerk and marked "City of Mound Official Copy." Said state regulations are incorporated in and made a part of this ordinance as completely as if set out here in full. In addition to the aforedescribed regulations, it shall be the duty of every owner of private property abutting on any public street or alley to cause the grass and weeds to be kept cut to the center of such platted street or alley. If the grass or weeds in such a place are 12 inches or more in height it shall be prima facia evidence of a violation of this section. The City weed inspector is authorized and directed to abate said nuisance on private property in the manner set forth in Section 18.271 of the Minnesota Statutes. It shall be his duty to cut all grass and eliminate weeds when the same are not cut by the property owners as required in this section. It shall likewise be the duty of the weed inspector to keep an accurate account of the cost of such cutting opposite each lot and certify the same to the City Council to be specially assessed against the abutting property in accordance with the authority established by M.S.A. 429.101 and 18.271 Subd. 4. The vote was unanimously in favor; whereupon said Ordinance 380 is hereby ordained. WYCHWOOD BRIDGE Swenson moved and Fenstad seconded a motion RESOLUTION 78-260 RESOLUTION REQUESTING THAT WYCHWOOD BRIDGE BE CLOSED TO BOAT TRAFFIC MONDAY THROUGH FRI- DAY IN ORDER THAT CONSTRUCTION WORK MAY BE EXPEDITED SAFELY The vote was unanimously in favor.
