1981-03-24 EGUEA HEET NG OF THE C~TY COUNCIL March 24, 1981 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Mound, Hennepin County, Minnesota was held at 5341Maywood Road in said City on March 24, 1981 at 7:30 p.m. Those present were: Acting Mayor Robert Polston, Councilmembers Gordon Swenson, Pinky Charon and Donald Ulrick. Also present were City Manager Leonard L. Kopp, Assistant City Attorney Jim Larson, Assistant City Engineer John Cameron and City Clerk Mary H. Cronin. MINUTES The minutes of the meeting of March 10, 1981 were presented for consideration. Swenson moved and Charon seconded a motion to approve the minutes of the meeting of March 10, 1981 with a correction on page 31: under Prosecuting Attorney - "the motion was seconded by Councilmember Swenson.I' The vote was unanimously in favor. PUBLIC HEARINGS County Road IlO/Commerce Boulevard The City Clerk presented an affidavit of publication in the official newspaper of the notice of public hearing on said County Road IlO/Commerce Boulevard. Said affidavit was then examined, approved and ordered filed in the office of the City Clerk. The Mayor then opened the public hearing for input on said County Road 110/ Commerce Boulevard and persons present to do so were afforded an opportunity to express their views thereon. The following persons offered comments or questions: Willard Hillier, 1551 Canary; Ron Gehring, 3125 Charles; Jerry Longpre, 2300 Commerce; Roy O'Donnell, 3207 Charles Lane; Marge Rines, Commerce; Paul Ford, 5598 Sherwood Dr.; George Eugster, 5748 Lynwood; Gene Johnson, 2601 Commerce; Richard Hawks, 2068 Commerce. The Mayor then closed the public hearing. Ulrick moved and Charon seconded a motion to continue this hearing to the meeting of April 28, 1981. The vote was unanimously in favor. Revenue Sharing The City Clerk presented an affidavit of publication in the official newspaper of the notice of public hearing on said Revenue Sharing. Said affidavit was then examined, approved and ordered filed in the office of the City Clerk. The Mayor then opened the public hearing for input on said Revenue Sharing and persons present to do so were afforded an opportunity to express their views thereon. The following persons offered comments or questions: Ben Withhart. The Mayor then closed the public hear- ing. Ulrick moved and Charon seconded a motion RESOLUTION 81-93 RESOLUTION ADOPTING THE 1981 REVENUE SHARING BUDGET The vote was unanimously in favor. 34 March 24, 1981 Delinquent Utility Bills The Mayor then opened the public hearing for input on said Delinquent Utility Bills and persons present to do so were afforded an opportunity to express their views thereon. Charon moved and Swenson seconded a motion RESOLUTION 81-94 RESOLUTION AUTHORIZING THE CITY STAFF TO TURN OFF WATER SERVICE TO DELINQUENT UTILITY ACCOUNTS The vote was unanimously in favor. BIDS - TELEVISING COUNTY ROAD 110 SEWER Swenson moved and Polston seconded a motion to table this item. The vote was unanimously in favor. PARK COMMISSION MINUTES Ulrick moved and Swenson seconded a motion RESOLUTION 81-95 RESOLUTION TO CONCUR WITH THE PARK COMMISSION RECOMMENDATION WITH AN ADDITIONAL STIPULATION REGARDING CONSTRUCTION OF A BARRIER FOUR FEET EAST OF MOST EASTERLY DOCK FROM GROUND LEVEL TO FOUR FEET ABOVE WATER LEVEL AT TIME OF CONSTRUCTION The vote was three in favor with Polston voting nay. COMMENTS AND SUGGESTIONS FROM CITIZENS PRESENT A1Wiggin asked about the street sweeping. Pinky Charon commented about her experience of a ride-along with the Police Department. PORTABLE BREATH TESTING UNIT Polston moved and Charon seconded a motion RESOLUTION 81-96 RESOLUTION AUTHORIZING THE CITY TO RECEIVE A PORTABLE BREATH TEST UNIT FROM THE STATE The vote was three in favor with Swenson voting nay. CHANGE OF MEETING DATE Ulrick moved and Swenson seconded a motion March 24, 1981 RESOLUTION 81-97 RESOLUTION OFFICIALLY CHANGING THE MEETING DATE FROM APRIL 14, 1981 TO APRIL 21, 1981 The vote was unanimously in favor. CIGARETTE LICENSES Ulrick moved and Charon seconded a motion RESOLUTION 81-98 RESOLUTION AUTHORIZING THE ISSUANCE OF CIGARETTE LICENSES TO MOUND SUPER VALU AND SUPER AMERICA STATION The vote was three in favor with Charon voting nay. DELINQUENT UTILITY BILLS Swenson moved and Ulrick seconded a motion RESOLUTION 81-99 RESOLUTION PROVIDING FOR A PUBLIC HEARING REGARD- ING DELINQUENT UTILITY BILLS TO BE HEARD ON APRIL 21, 1981 AT 7:30 P.M. The vote was unanimously in favor. RUSTIC RIDGE Polston moved and Swenson seconded a motion RESOLUTION 81-100 RESOLUTION AUTHORIZING THE MAYOR AND MANAGER TO ENTER INTO A PURCHASE AGREEMENT WITH JIM DAVIS FOR A LOT IN RUSTIC RIDGE FOR $10,000 The vote was unanimously in favor. TAX FORFEIT LAND - LOTS 22 & 23, BLOCK 12, WYCHWOOD Ulrick moved and Swenson seconded a motion RESOLUTION 81-101 RESOLUTION AUTHORIZING THE REMOVAL OF LOTS 22 & 23, BLOCK 12, WYCHWOOD FROM PUBLIC SALE The vote was unanimously in favor. Polston moved and Swenson seconded a motion RESOLUTION 81-102 RESOLUTION AUTHORIZING ACQUIRING LOTS 22 & 23, BLOCK 12, WYCHWOOD FOR WETLANDS The vote was unanimously in favor. FEDERAL SURPLUS MERCHANDISE Ulrick moved and Charon seconded a motion RESOLUTION 81-103 RESOLUTION AUTHORIZING CERTAIN MOUND STAFF PERSONS TO PURCHASE FEDERAL SURPLUS MERCHANDISE The vote was unanimously in favor. 35 36 March 24, 1981 SEVERANCE PAY - R. THARALSON Swenson moved and Polston seconded a motion RESOLUTION 81-104 RESOLUTION AUTHORIZING THE SEVERANCE PAY FOR OFFICER RAY THARALSON BE HANDLED AS STIPULATED IN ARTICLE XVll, SECTION 17.7 THRU 17.9 The vote was unanimously in favor. PAYMENT OF BILLS Swenson moved and Ulrick seconded a motion to approve payment of the bills as presented on the prelist in the amount of $154,340.80 when funds are available. Roll call vote was unanimously in favor. TRANSFER OF CEMETERY LOTS Polston moved and Swenson seconded a motion RESOLUTION 81-105 RESOLUTION AUTHORIZING THE TRANSFER OF GRAVES 1, 2 AND 5, LOT 46, SECTION A OF MOUND CEMETERY FROM THE ELIJAH BOWERS FAMILY TO LEIGHTON LINDLAN AND THE AMERICAN LEGION The vote was unanimously in favor. FIRE STATION ADDITION Ulrick moved and Polston seconded a motion to approve payment of $5,298.70 to Earl Weikle & Sons retaining $5,000.00 until acceptable completion of the total project. The vote was unanimously in favor.
