1981-05-2664 BOARD OF REVIEW OF THE CITY COUNCIL May 26, 1981 Pursuant to due call and notice thereoF, the Board oF Review convened at 7:30 p.m. in the Council Chambers of the City of Mound, 5341Maywood Road in said City on May 26, 1981. Those present were: Mayor Rock Lindlan, Councilmembers Gordon Swenson, Robert Polston, Pinky Charon and Donald Ulrick. Also present were Acting City Manager Marge Stutsman, Assistant City Attorney Jim Larson, Assistant City Engineer Lyle Swanson and City Clerk Mary H. Cronin. BOARD OF REVIEW The Mayor opened the Board of Review and the following responded to the call to be heard: Dr. H. P. Borg, 6221 Lynwood Blvd.; Priscilla Anderson, 5938 Idlewood; Beatrice Tangen, 5949 Bartlett Blvd.; Phillip Hasch, 4810 Northern Rd.; Leroy Jessen, 5189 Emerald Dr., 142' lakeshore; Robert E. Johnson, 5488 Tonkawood; Ed Stettin, 4833 Island View Dr.; Ronald Gehring, 3215 Charles Lane and Deloris Steen, 5415 Bartlett Blvd. Polston moved and Swenson seconded a motion to request the Assessor to review the above properties and to adjourn the Board of Review and to reconvene on June 9, 1981 at 7:00 p.m. The vote was unanimously in favor, so adjourned. COUNCIL MEETING MINUTES The minutes of the meeting of May 12, 1981 were presented for consideration. Swenson moved and Ulrick seconded a motion to approve the minutes of the meeting of May 12, 1981 with the correction on page 63; under OTHER ITEMS DISCUSSED insert the words "adjacent to the City Hall parking lot" between the words "pumps" and "and". The vote was unanimously in favor. PUBLIC HEARING COUNTY ROAD 110 STREET LIGHTS The City Clerk presented an affidavit of publication in the official newspaper of the notice of public hearing on said County Road 110 Street Lights. Said affidavit was then examined, approved and ordered filed in the office of the City Clerk. The Mayor then opened the public hearing for input on said County Road llO Street Lights and persons present to do so were afforded an opportunity to express their views thereon. The following persons offered comments or questions: Phil Hasch, 4810 Northern Rd. The Mayor then closed the public hearing. Polston moved and Charon seconded a motion RESOLUTION 81-177 RESOLUTION AUTHORIZING THE ENGINEER TO PREPARE FEASIBILITY REPORT FOR STREET LIGHTS FOR COMMERCE BOULEVARD FROM THREE POINTS TO SURFSlDE AS RECOMMENDED BY THE DOWNTOWN ADVISORY COMMITTEE The vote was unanimously in favor. Ulrick moved and Charon seconded a motion RESOLUTION 81-178 RESOLUTION PROVIDING FOR A PUBLIC HEARING REGARDING THE STREET LIGHTING ON COMMERCE BOULEVARD TO BE HEARD ON JUNE 23, 1981 AT 7:30 P.M. The vote was unanimously in favor. PUBLIC HEARING - SUBDIVISION OF LAND - REGISTERED LAND SURVEY The City Clerk presented an affidavit of publication in the official newspaper of the notice of public hearing on said Subdivision of Land - Registered Land Survey. Said affidavit was then examined, approved and ordered filed in the office of the City Clerk. The Mayor then opened the public hearing for input on said Sub- division of Land - Registered Land Survey and persons present to do so were afford- ed an opportunity to express their views thereon. No persons presented objections and the Mayor then closed the public hearing. Swenson moved and Charon seconded a motion RESOLUTION 81-179 RESOLUTION TO CONCUR WITH THE PLANNING COMMISSION RECOMMENDATION TO APPROVE THE SUBDIVISION AS RE- QUESTED - PID 19-117-23 34 0OO1 The vote was unanimously in favor. STREET CONSTRUCTION Bid Opening - Commerce Blvd. Watermain Polston moved and Charon seconded a motion RESOLUTION 81-180 RESOLUTION AWARDING CONSTRUCTION OF THE COMMERCE BOULEVARD WATERMAIN TO THE LOW BIDDER - F. JEDLICKI IN THE AMOUNT OF $116,221.00 The vote was unanimously in favor. Easement on Railroad Property Swenson moved and Ulrick seconded a motion to table this item. The vote was unanimously in favor. Easement on Sulgrove Ulrick moved and Polston seconded a motion to direct the engineer to construct Sulgrove from Tuxedo to Warner at 28' without a retaining wall or at 24' with no parking on either side of the street with a ten day deadline for obtaining neceSsary easements. The vote was unanimously in favor. Northern Lane Ulrick moved and Polston seconded a motion to direct letters to the L.M.C.D. and the Hennepin County Water Patrol to encourage their increase of patroling of the area. The vote was four in favor with Swenson voting nay. 66 May 26, 1981 Polston moved and Charon seconded a motion to instruct the staff to obtain information on the legality and expense of constructing a fence. The vote was unanimously in favor. Boat Landing - Dutch Lake Lane Swenson moved and Ulrick seconded a motion RESOLUTION 81-181 RESOLUTION AUTHORIZING THE DUTCH LANE ACCESS BE BLACKTOPPED AT ITS PRESENT WIDTH The vote was unanimously in favor. SUBDIVISION OF LAND - LOTS 7 & 8, BLOCK 2, HIGHLANDS ~,~ No action was taken on this item at this time. USE OF DEPOT BUILDING Swenson moved and Charon seconded a motion to concur with the Park and Planning Commission recommendation to allow Tonka Alano to use the Depot for ninety days at $100 per month. Roll call vote was two in favor with Polston, Charon and Ulrick voting nay, motion failed. HAZARD TREES AT 3115 DONALD DR. Polston moved and Charon seconded a motion to request the engineer submit an estimate of the cost of a survey for the properties. The vote was unanimously in favor. Ulrick moved and Polston seconded a motion to accept Mr. Elig's offer to remove the hazardous trees immediately and the cost will be assessed to the responsible owner. The vote was unanimously in favor. LICENSE RENEWALS Swenson moved and Ulrick seconded a motion RESOLUTION 81-182 RESOLUTION TO APPROVE ISSUANCE OF A CLUB LICENSE TO THE V.F.W.; A WINE LICENSE TO AL & ALMA'S AND A CIGARETTE LICENSE TO BOB'S BAIT SHOP The vote was unanimously in favor. 1981 DOCK PERMITS Ulrick moved and Polston seconded a motion RESOLUTION 81-183 RESOLUTION AUTHORIZING ISSUANCE OF DOCK PERMITS AS PRESENTED ON LIST #2 The vote was unanimously in favor. May 26, 1981 3.2 BEER LICENSE - FISH FRY Polston moved and Ulrick seconded a motion RESOLUTION 81-184 RESOLUTION AUTHORIZING THE ISSUANCE OF A 3.2 BEER LICENSE FOR THE MOUND FIRE DEPARTMENT FISH FRY ON dUNE 13TH & 14TH The vote was unanimously in favor. DELINQUENT UTILITY ACCOUNTS Swenson moved and Charon seconded a motion RESOLUTION 81-185 RESOLUTION PROVIDING FOR A PUBLIC HEARING REGARDING DELINQUENT UTILITY ACCOUNTS TO BE HEARD ON JUNE 9, 1981 AT 7:30 P.M. The vote was unanimously in favor. SEWER CHARGES TO COMMERCIAL ACCOUNTS Swenson moved and Polston seconded a motion RESOLUTION 81-186 RESOLUTION ESTABLISHING THE MONTHLY COMMERCIAL ACCOUNTS BE BILLED FOR SEWER BASED ON ACTUAL WATER CONSUMPTION FOR THE CURRENT MONTH BILLING The vote was unanimously in favor. RENT SUBSIDY PLAN Swenson moved and Polston seconded a motion to table this item. The vote was unanimously in favor. PUBLIC HEARING DATES Swenson moved and Ulrick seconded a motion RESOLUTION 81-187 RESOLUTION AMENDING RESOLUTION 81-139 TO CHANGE THE DATE FROM dUNE 7, 1981 TO JUNE 9, 1981 The vote was unanimously in favor. CLERICAL RESIGNATIONS Swenson moved and Polston seconded a motion RESOLUTION 81-188 RESOLUTION AUTHORIZING REPLACEMENT OF THE TWO VACANT CLERICAL POSITIONS AND AMEND THE JOB DESCRIPTIONS AND SALARY SCHEDULE The vote was four in favor with Ulrick voting nay. PAYMENT OF BILLS Swenson moved and Charon seconded a motion to approve payment of the bills as presented on the prelist in the amount of $74,701.51 when funds are available.
