1981-11-17 178 November 17, 1~81 REGULAR MEETING OF THE CITY COUNCIL Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Mound, Hennepin County, Minnesota, was held at 5341Maywood Road in said City on November 17, 1981, at 7:30 P.M. Those present were: Acting Mayor Robert Polston, Councilmembers Pinky Charon, Gordon Swenson and Donald Ulrick. Also present were City Manager, Jon Elam; Police Chief, Bruce Wold; Secretary, Fran Clark and the following interested citizens: Craig Henderson, Teresa Stewart (AAA). Mayor Lindlan was absent and excused. Acting Mayor Polston opened the meeting and welcomed the people in attendance. MINUTES The Minutes of the November 10, 1981, Regular Council Meeting were presented for consideration. Ulrick moved and Charon seconded a motion to approve the Minutes of November 10, 1981, Regular Council Meeting, as submitted. The vote was unanimously in favor. Motion carried. COUNTY ASSESSOR'S REPORT The City Manager presented a report from the County Assessor on all the property that has been sold in Mound in the past year. He explained that these figures and increases will be the basis for next years tax assessments by the County. AAA PEDESTRIAN SAFETY AWARD Ms. Teresa Stewart, representative from the Automobile Association of America, was present to present this award to the City of Mound for 21 years without a pedestrian fatality. There are only 276 of these awards nationwide yearly. Police Chief, Bruce Wold accepted the award for the City of Mound. SKELLY STATION AT THE CORNER OF WILSHIRE BLVD. AND TUXEDO BLVD. The City Manager explained in 1965 when this property was sold by the City restrictions and rights of re-entry from the City of Mound were attached to this property in order to deal with junk cars and unsightlyness. Since that time the City has passed ordinances to deal with junk cars and unsightlyness. Therefore these restrictions and rights of re-entry from the City of Mound are no longer necessary. Mr. Craig Henderson, a citizen of Mound, would like to purchase this property from the Getty Oil Co. but would like a Quitclaim Deed releasing the City restrictions and rights of re-entry. The City Manager recommended a Quitclaim Deed to release. Mr. Craig Henderson was present and assured the Council that he does not want junk cars around the station either. Swenson moved and Charon seconded the following resolution. RESOLUTION #81-376 RESOLUTION AUTHORIZING THE MAYOR TO SIGN A QUITCLAIM DEED TO RELEASE A DEED RESTRICTION AND RIGHT OF RE-ENTRY FROM THE CITY ON LOTS 1 AND 2, BLOCK 8, AVALON, PID #19-117-23 24 0020 The vote was unanimously in favor. Motion carried. 179 November 17, 1981 SET PUBLIC HEARING DATE - 5930 AND 5932 BEACHWOOD ROAD - DISCONTINUE WATER SERVICE Ulrick moved and Swenson seconded a motion to set a date for a Public Hearing to give certain property owners the opportunity to show case why the City water supply to 5930 and 5932 Beachwood Road should not be discontinued be set for December 8, 1981, at 7:30 P.M. The vote was unanimously in favor. Motion carried. COMMENTS AND SUGGESTIONS BY CITIZENS PRESENT Mr. Jim Whitesell, 4916 Edgewater Drive, Mound, MN. - Commented that he felt the Minutes from November 3, 1981, should reflect that the Sheikh attended the Minnegasco portion of the Meeting. PAYMENT OF BILLS Swenson moved and Charon seconded a motion to approve the payment of the bills as presented in the amount of $234,O41.28, when funds are available. Roll call voted was unanimously in favor with Mayor Lindlan absent and excused. Motion carried. Mayor Lindlan arrived at 7:47 P.M. INFORMATION/MISCELLANEOUS - CITY MANAGER'S REPORTS There was brief discussion on the following items: 1. Sports Arena - The spinkler system is just about finished. 2. Bay Point Apartments - Since the City has no condo conversion ordinance we will be going by the State Laws. 3. Downtown Advisory. Committee - reminder of the meeting 11-18-81 at 7:00 P.M. in the Community Service Center. 4. Street Project - This is winding down and should soon be finished. 5. Leave of Absence - The City Policy on pregnancy leave of absence will be: a. up to six months unpaid leave of absence b. use of accrued sick leave or vacation will be allowed c. there will be no accrual of sick leave or vacation while on leave of absence d. the City will continue to pays it portion of the employees insurance premiums and the employee will be responsible for their share of these premiums. 6. Cost Breakdown for Phase II - a report from the Planner outlining the cost breakdown for the Group Workshop/Public Input was submitted. BAY POINT CONDO CONVERSIONS Mayor Lindlan brought up the Bay Point Condo conversions and discussion followed on the following: 1. Zoning 2. Protection of existing tenants 3. Variances that past Councils have passed in regard to parking spaces and garages. 4. Sprinkler systems. The City Manager and the City Attorney were asked to check into other cities condominimum conversion laws. 180 November ]7, ]981 ANDERSON BUILDING The City Manager reported that the Highway State Aid person he contacted is still checking on whether the City can do anything with this building because it was purchased with MSA Funds. He will report when he gets an answer. Charon moved and Ulrick seconded a motion to adjourn at 8:20 P.M. The vote was unanimously in favor. Motion carried.
