MINUTES OF JULY 8, 1992
The meeting was called to order by chairperson, Eldo Schmidt at
7:OOPM in the director's office at 2020 Commerce Boulevard. In
attendance were the following: Gary Paulsen, Pat Meisel, Gordy
Tulberg, Ken Smith, Chester Norman, Gundy Anderson and Pinky
Charon.
Ken Smith was given the oath of office and was reappointed for a
five year term expiring August, 1997.
Election of officers will be held at the next meeting. Eldo will
has asked to be excused from the August 12th meeting as he will be
on vacation.
The minutes of June 3, 1992 were reviewed, a motion to approve
after the removal of Gary Paulsen's name from the attendance was
made by Pat and seconded by Ken. The motion was called and passed
unanimously.
The next item of business was the payment of bills, a list totaling
$ 10,087.66 was presented. A motion to pay was made by Gordy and
seconded by Pat. The motion was called and passed unanimously.
After discussion it was decided that next month the director will
take 20% of the balance of the checking account out and put it into
the Levy saving account at Norwest bank. A motion to do so was
made by Ken and seconded by Gordy. The motion was called and
passed unanimously.
A motion to immediately remove Mary Sandra Woytcke's name from the
savings account at the Norwest was made by Ken and seconded by
Gordy. The motion was called and passed unanimously.
The board reviewed the Bylaws of the Mound HRA and made some
changes that will be incorporated and brought back at the next
meeting on August 12, 1992 for approval.
A motion to accept the insurance bid from State Farm for Multi -
peril and Workers Compensation was made by Ken and seconded by Pat.
The motion was called and passed unanimously.
The board reviewed the job description of the Executive Director
and there were no additions. It was recommended that a review of
the salaries of other HRA Executive Directors at similar sized
Housing Authorities and apartment buildings be done to better
evaluate the director's salary. Pinky was commended for doing a
great job this passed year in spite of the very difficult
circumstances this Housing Authority has found itself in.
A motion asking the City of Mound for the Levy money collected in
1992 was made by Gordy and seconded by Pat. The motion was called
and passed unanimously.
A motion to ask the City of Mound to again levy next year for Levy
money for this Housing Authority was made by Gary and seconded by
Gordy. The motion was called and passed unanimously.
A motion to adjourn was made by Gordy and seconded by Ken. The
motion was called and passed unanimously. The meeting adjourned at
8:30PM.

Section 2. CHAIRPERSON. The Chairperson shall preside at all
meeting of the Authority. Except as otherwise authorized by

Section 3. VICE -CHAIRPERSON. The Vice -Chairperson shall
perform the duties of the Chairperson in the absence or incapacity
of the Chairperson; and in case of the resignation or death of the
Chairperson, the Vice -Chairperson shall perform such duties as are
imposed on the Chairperson until such time as the Authority shall
select a new Chairperson.
Section 4. EXECUTIVE DIRECTOR. The Authority shall employ an
Executive Director who shall have general supervision over the
administration of its business and affairs, subject to the
direction of the Authority. S/he shall be charged with the
management of the housing projects of Authority.

Authority, shall act as recorder of the meetings of the Authority
and record all votes, and shall keep a record of the proceedings of
the Authority in a journal of proceedings to be kept for such

S/he shall keep in safe custody the seal of the authority and shall
power to affix such seal to all contracts and instruments
authorized to be executed by the Authority.
S/he shall have the care and custody of all funds of the
Authority and shall deposit the same in the name of the Authority
in such bank or banks as the Authority may select. the �Vfce_=

money and shall pay out and disburse such moneys under the
direction of the Authority. Except as otherwise authorized by
resolution of the Authority, all such orders and checks shall be

The compensation of the Executive Director shall be determined

Section 5. Additional Duties. Ther officers of the Authority
shall perform such other duties and functions as may from time to
time be required by the Authority or the bylaws or rules and
regulations of the Authority.
Section 6. Election or Appointment. The first Chairperson
shall, pursuant to his/her appointment, serve in the capacity of
Chairperson until the expiration of his/her term of office as
Commissioner. The Vice -Chairperson shall be elected at the annual
meeting of the Authority, and shall hold office for one year or
until his/her successor is elected and qualified.
The Executive Director shall be appointed by the Authority.
Any person appointed to fill the office of Executive Director, or
any vacancy therein, shall have such term as the Authority fixes,
but no Commissioner of the Authority shall be eligible to this
office.
Section 7. Vacancies. Should the office of Chairperson or
Vice Chairperson become vacant, the Authority shall a successor
from its membership a the next regular meeting, and such election
shall be for the unexpired term of said office. When the office of
Executive Director becomes vacant, the Authority shall appoint a
successor, as aforesaid.
Section 8. Additional Personnel. The Authority may from time
to time employ such personnel as it deems necessary to exercise its
powers, duties and functions as prescribed by the Municipal Housing
and Redevelopment Law of Minnesota applicable thereto. The
selection and compensation of such personnel (including the
Executive Director) shall be determined by the Authority subject to
the laws of the State of Minnesota.

Section 3. Special Meetings. Special meetings of the
Authority may be call by the Chairperson, or two members of the
Authority for the purpose of transacting any business designated in
the call. The call for a special meeting may be delivered at any
time prior to the time of the proposed meeting to each member of
the Authority or may be mailed to the business or home address of
each member of the Authority at lease two (2) days prior to the

Section 4. ouorum. The powers of the Authority shall be
vested in the Commissioners thereof in office from time to time.
Three Commissioners shall constitute a quorum for the purpose of
conducting its business and exercising its powers and a for all
other purposes, but a smaller number may adjourn from time to time
until a quorum is obtained. When a quorum is in attendance, action
may be taken by the Authority upon a vote of a majority of the
Commissioners present.
Section 5. Order of Business. At the regular meetings of the
Authority the following shall be the order of business:
1. Roll Call.
2. Reading and approval of minutes of the previous
meeting.

Section 6. Manner of Voting. The voting on all questions
coming before the Authority shall be by roll call, and the Yeas and

Amendments to Bylaws. The bylaws of the Authority shall be
amended only with the approval of at least three of the members of
the Authority at a regular or special meeting.

Please accept this letter as my resignation as chairperson of the
Mound Housing and Redevelopment authority as of August 12, 1992.
Since the beginning of by commission (Nov 1973) there have been
four commissioned Executive Directors. The business procedures
were traditionally passed on from one director to the next.
Unfortunately these procedures were recently proven to be an
ineffective way to manage this commission.
However, at this time I can report that there have been numerous
operational changes that should safeguard the operation of the
Mound HRA in the future.
All in all Ed, I feel that it has been an honor to serve on the
Mound Planning Commission, City Council and the Mound HRA.
There seems to be a time in a person's life that you feel enough is
enough and I feel that time has now arrived.

Wednesday, July 15, 1992
MINNEAPOLIS, MINNESOTA - United States Attorney Tom Heffelfinger announced
that the former executive director for an organization that provides assisted housing for elderly
and handicapped people, was charged today was embezzling over $50,000 in funds from the
program.
Mary Sandra Woytcke, 51, of Mound, was charged with embezzling money from the
Mound Housing and Redevelopment Authority (MHRA) from April 1988 to April 1991. During
that three year period, Woytcke allegedly wrote checks to herself from two checking accounts
established by MHRA. Woytcke was executive director of MHRA from March 1986 to July
1991.
MHRA received approximately $50,000 per year in financial support from the
Department of Housing and Urban Development (HUD) and an additional $24,000 per year from
the City of Mound for operational expenses not covered by HUD
fine.
Woytcke faces a maximum potential penalty of ten years in prison and/or a $250,000
The case is the result of an investigation by the U.S. Department of Housing and Urban
Development and is being prosecuted by Assistant United States Attorney Frank J. Magill.

THE UNITED STATES GRAND JURY CHARGES THAT:
INTRODUCTION
1. At all times material to this indictment, the Mound
Housing and Redevelopment Authority ("MHRA") was an organization
and agency of the City of Mound, Minnesota that developed,
administered, and otherwise provided assisted housing for lower
income elderly and handicapped persons within the City of Mound.
Five commissioners appointed by the Mayor of Mound oversaw MHRA's
operations. The commissioners appointed an Executive Director to
carry out MHRA's policies and programs.
2. For the period 1987 to date, the United States Department
of Housing and Urban Development ("HUD") provided financial support
and assistance.to MHRA in the amount of approximately $50,800.00
per year. In .addition, MHRA received grant money from the City of
Mound for operational expenses not covered by HUD. For the period
1987 to date, MHRA received approximately $24,000.00 per year from
the City of Mound.
3. MHRA received federal assistance from HUD in excess of
$10,000.00 during any one-year period between April 7, 1987 and
April 11, 1992.
4. Defendant Mary Sandra Woytcke a/k/a Sandra Woytcke
(hereinafter referred to as Sandra Woytcke) was the Executive
Director of AH RA from approximately March 1986 to July 1991- As
Executive Director, Sandra Woytcke was authorized to act on behalf
of MHRA.
5. At.all times material to this indictment, MHRA utilized
two separate bank accounts to transact business. One account was
with the State Bank of Mound, Mound, Minnesota, Account Number 999-
888. The second account was with First Minnesota, Mound,
Minnesota, Account Number 009805616014. In July 1990, the funds in
the First Minnesota account were transferred to the State Bank of
Mound account. From July 1990 forward, all MHRA transactions were
through the State Bank of Mound account.
6. At all times material to this indictment, Sandra Woytcke
had check writing authority with respect to both checking accounts
described in paragraph 5 above.
COUNT I
7. The Grand Jury realleges all of the allegations within
paragraphs 1 through 6 of this indictment.
8. From on or about April 7, 1988, to on or about April 11,
1991, in the State and District of Minnesota, the defendant,
SANDRA WOYTCKE,
being an agent of MHRA, pursuant to a scheme and plan, did
knowingly embezzle, steal, obtain by fraud, and otherwise without
authority convert to her own use property with an aggregate value
of $5,000 or more, namely approximately $50,053.33, owned by and
under the care, custody, and control of MHRA.
9. In furtherance of the scheme and plan; Sandra Woytcke
wrote checks out to herself on MHRA's checking accounts at First
Minnesota and State Bank of Mound knowing she was not entitled to
the checks. Woytcke either cashed the checks, deposited them into
her personal checking account, or otherwise took the money.
Attached hereto as Exhibit A, and incorporated by reference, is a
list of the subject checks by checking account.
All in violation of Title 18, United States Code, Section
666(a)(1)(A).

The appeal of the employer duly came on for hearing before the undersigned on

Jobs and Training in Brooklyn Park, Minnesota. The claimant was not served.

FINDINGS OF FACT: (1) The claimant was employed by the above-named employer
for five years through July 17, 1991, most recently as an executive director,
with a final wage rate of $940.33 per month.
(2) The claimant was indefinitely suspended from employment on July 17, 1991.
The claimant remains on suspension as of the date of this hearing.
(3) The claimant filed an initial claim for unemployment insurance benefits
effective October 20, 1991. On November 8, 1991 the Department of Jobs and
Training issued a determination of separation from employment finding that
the claimant was involuntarily separated from employment and charging the
employer's reimbursing account. The employer did not appeal.

(4) On January 21, 1992 the Department of Jobs and Training issued a notice
of benefits chargeable charging the employer's reimbursing account $520.00 of
benefits paid to the claimant. The employer did not contest the wages upon
which the benefits were based, the percentage of benefits chargeable or the
calculation of actual benefits paid to the claimant.
(5) The employer duly protested the notice of benefits chargeable on
February 4, 1992. The Department issued a letter of affirmation on
February 26, 1992. The employer appealed this in a timely manner of March 3,
1992.
(6) At the time the claimant was separated from employment, the employer was
aware of certain discrepancies in the manner in which she handled funds,
revealed in an auditor's report. Subsequently, the employer's witness
reported that the claimant was indicted for a federal offense involving more
than $50,000.00 arising out of the activities occurring during her employ-
ment.
REASONS FOR DECISION: The Minnesota jobs and training law at Section 268.06,
Subd. 25 provides that,
"In lieu of contributions required of employers under this law, the state
of Minnesota or its political subdivisions governed by this law shall pay
into the unemployment compensation fund an amount equivalent to the amount
of benefits charged, and as to weeks of unemployment beginning after
January 1, 1979, all of the extended benefits paid based on wages paid by
the state of Minnesota or such political subdivisions. If benefits paid
an individual are based on wages paid by both the state of Minnesota or
such political subdivisions and one or more other employers, the amount
payable by the state of Minnesota or such political subdivisions to the
fund shall bear the same ratio to total benefits paid to the individual as
the base -period wages paid to the individual by the state of Minnesota or
such political subdivisions bear to the total amount of base -period wages
paid to the individual by all his base -period employers.
Subd. 28 in part provides:
"(1) Benefits paid to employees of nonprofit organizations shall be
financed in accordance with the provisions of this subdivision. * * *
* * * The commissioner shall bill each nonprofit organization (or group of
such organizations) which has elected to make payments in lieu of
contributions for an amount equal to the full amount of regular benefits
plus one-half of the amount of extended benefits charged during such
quarter or other prescribed period that is attributable to service in the
employ of such organization."
In the instant case the employer did not contest the notice of benefits
chargeable, the calculation of wages in the base period, the benefits paid,
or the calculation of the percentage. The employer sought to reopen the
underlying separation determination. The employer has not shown a basis upon
which they may be relieved from the effects of the underlying separation
determination. The benefits charged to their account were correctly charged
and the employer may not be relieved of those charges at this time. The

record should reflect that the employer offered as an exhibit a photocopy of
a check with which they had subsequently paid the benefit charge in question.
DECISION: The notice of benefits chargeable dated January 21, 1992 charging
the employer's reimbursing account with $520.00 of benefits paid to the
claimant was correctly charged.
