STATE OF MINNESOTA DEPARTMENT OF REVENUE CENTENNIAL OFFICE BUILDING SAINT PAUL, MINNESOTA 55145 June 28, 1977 TO: THE FINANCE OFFICERS OF COUNTIES, CITIES AND TOWNS SUBJECT TO THE OVERALL LEVY LIMITATIONS (MINNESOTA STATUTES, SECTIONS 275.50 TO 275.56 AS AMENDED) RE: THE DETERMINATION OF WHICH CITIES AND TOWNS HAVE 1977/1978 LEVY LIMIT BASES PER CAPITA WHICH ARE BELOW 80 PERCENT OF THE AVERAGE 1977/1978 LEVY LIMIT BASE PER CAPITA FOR THE CITIES AND TOWNS WITHIN THE SAME COUNTY Article V, Section 5 of the new Onmibus Tax Bill (Laws 1977, Chapter 423) requires that on or before July 1 of 1977 and each subsequent year, the Department of Revenue must determine the average levy limit base per capita for the cities and towns within each county and certify this amount to each of these cities and towns. For levy year 1977, the average levy limit base per capita is determined by averaging the 1977/1978 levy limit bases per capita of the cities and towns within each county. An average for a particular county is determined only if there are two or more cities subject to the overall levy limits within that county. For this purpose, a municipality which is joint in two or more counties is considered one of the cities subject to the overall levy limits within each of those counties. Any city or town whose 1977/1978 levy limit base per capita is below 80% of the average 1977/1978 levy limit base per capita for the cities and towns within the same county may apply to the Levy Limitations Review Board to have its 1977/1978 levy limit base per capita increased to 80% of the average levy limit base per capita for the cities and towns within the same county. A municipality which is joint in two or more counties may apply to have its 1977/1978 levy limit base per capita increased to 80% of the higher of the average levy limit bases per capita for the counties wherein it is situated. A levy limit base per capita adjustment approved by the Levy Limitations Review Board for levy year 1977 payable 1978 pursuant to this provision would be taken into account before the calculation of an additional levy authorized by Laws 1977, Chapter 423, Article V, Section 6 (an excess levy adopted by resolution but not to exceed 10% of the 1977/1978 levy limit base, free of penalty but subject to a reverse referendum) which is effective for levy year 1977, taxes payable 1978. The enclosed table shows the calculation of the 1977/1978 levy limit bases per capita for each of the cities and towns subject to the overall levy limitations within your county, the determination of the average levy limit base per capita for these cities and towns, and the determination of 80 percent of the average. In accordance with Article V, Section 5, Clause (d) of Chapter 423, the average levy limit base per capita is an arithmatic average of the city and town per capita amounts. The prime reason for this request is due to the fact that two years ago the council lost the subsidy of the Suburban Recreation Program. This was somewhat anticipated, as most community recreation programs have been expected to become self sustaining after a period of years. We enjoyed this support for the past twenty-five years. Our proposed budget for this year's program amounts to approximately $20,000.00. The School District directly subsizes the program to the amount of $5,000.00. We are asking each of the cities in our community to raise their contribution to extent of $200.00 in addition to that amount extended this past year.
