The following items require Council action: Item 2. Subdivision of Land Lot 42 and 43, Mound Shores zoned Res. B - 6,000 square feet for single family house The Planning Commission recommended the land be divided as follows provided the applicant would provide a bond in the amount of 125% of the Engineer's estimate to provide off street parking on Lot 42. Parcel A - Lot 42 and the West 2 feet of Lots 43 - 10,000 Sq. Fto Parcel B - Lot 43 except the West 2 feet of Lot 43-9,080 Sq.Ft. The Administration concurs. Side Yard Variance West 1/2 of Lot 3 and Lots 4 and 5, Block 18, Devon Zoned A-2 6,000 square feet. The Planning Commission recommended a 1.7 foot side yard variance. The Administration concurs. 4. Street Front Variance Lot 22 and 1/2 of Lot 21, Block 3, Shadywood Point The Council acted on this at a previous meeting. The Planning Com- mission reapproved the 5.3 foot street front variance authorized in 1977. The Administration concurs. 5. Subdivision of Land Part of Lot 47 lying East of the West 200 feet, Auditor's Subd. 168 The Planning Commission recommended the division into two parcels as described on the survey (copy attached). The Administration con- curs. 6. Registered Land Survey Approval Part of Lot 26, Auditor's Subd. 170 The Planning Commission recommended approval of the Registered Land Survey for two lots in a part of Lot 26, Aud. Subd. 170. MINUTES OF MOUND ADVISORY PLANNING COMMISSION January 29, 1979 Present: Chairman Russell Peterson, Commissioners Gary Paulsen, Lorraine Jackson, Bill Renner, Harriett Dewey, Margaret Hanson, Bud Stan- nard; Council Representative Gordon Swenson; City Manager Leonard L. Kopp; City Inspector Henry Truelsen and Secretary Marge Stutsman. 1. MINUTES Jackson moved and Dewey seconded a motion to accept the minutes of the January 8, 1979 Planning Commissioh meeting as presented. The vote was unanimously in favor. Board of Appeals 2. Subdivision of Land Lots 42 and 43, Mound Shores Merv Norling was present. Stannard moved and Paulsen seconded a motion to recommend approval of the subdivision as requested. Discussed parking requirement of two spaces on site with dwelling. Stannard moved to amend the motion to require a bond equal to 125% of Engineer's estimate to insure adequate parking spaces. Amendment was seconded by Renner. The vote on the motion as amended was unanimously in favor. Note: Councilman Swenson requested the property addreSs be included on the agenda of all items. Side Yard Variance Lots 4, 5 and west half of Lot 3, Block 18, Devon Dane Baker was present. Jackson moved and Hanson seconded a motion to reco~nend that the 1.7 foot side yard variance be granted as requested as it is necessary for enjoyment of a substantial property right and it will not be detrimental to the adjacent property owners. The vote was'unanimously in favor. Street Front Variance Lot 22 and 1/2 of Lot 21, Block 3, Shadywood Point David Linner not present; item moved down on agenda. Subdivision of Land That part of Lot 47 lying East of West 200 feet, Auditor's Subd. 168 Eugene Schlee and George Hussman were present. Renner moved and Jackson seconded a motion to recommend approval of the subdivision of property as requested. The vote was unanimously in favor. Street Front Variance Lot 22 and 1/2 of Lot 21, Block 3, Shadywood Point Stannard moved and Jackson seconded a motion to recommend the approval of the 5.3 front yard variance providing it meets all other setbacks because: (Same motion as previously recommended) 1. Road is 60 feet at this point and will be narrowing 2. Setback is compatible with other garages in neighborhood 3. Will not have an adverse effect On traffic and traffic safety. The vote was unanimously in favor. 6. Request for Division to be in form of Registered Land Survey 7o Part of Lot 26, Auditor's Subdivision 170 John Krost not present. Renner moved and Dewey seconded a motion to recommend approving accepting the Registered Land Survey as requested. The vote was unanimously in favor. If-the co~mcil decides to adopt the ordinance, I think it should be made perfectly clear to the organizations that if any-action is brought against the City questioning the consti- tutionality of this ordinance, the City will not incur expenses in defending the ordinance. It is my suggestion that you, the Police Chief and members of the council review this ordinance carefully prior to its adoption and ~..ake any revisions which are deemed necessary. The purpose of this section is to regulate and control the conduct of certain gambling activities pursuant to %he provisions of Minnesota Statutes, Chapter 349, and Laws of Minnesota, 1978, Chapter 507. Section 43:05. Provisions of State ~Law Adopted. The provisiOns of ~innesota Statutes, Chapter 349 and Laws .of Minnesota, 1978, Chapter 507, relating to the definition of terms, licensing, and resir3rictions of gambling are adopted and made a part of this ordinance as if set out in full. Section 43:10. Definitions. Subdivision 1. For the purposes of this ordinance the terms defined in this ordinance have the following meanings. Subd. 2. "Gambling devices" mean those gambling devices known' as "paddlewheels" or "tipboards", or apparatus used in con- ducting raffles. Subd. 3. "Paddlewheel" means a wheel marked off into sections containing one or more numbers, and'which, after being turned or spun,, uses a pointer or marker to indicate winnin¢3 chances. Subd. 4. "Tipboard" means a board, placard or other device measuring at least 12 inches square, marked, off in a grid or similar pattern, in which each section contains a hidden number or hUm. bets, or other symbol, which determines the winning chances. Subd. 5. "Raffle" means a game in which a participaa*~ buys a ticket for a chance at a prize with the winner detern~ned by a random drawing. Subd. 6. "Profit~' ~:eans the gross receipts from the opera- tion of ga]tabling devices and the condt~ct of raffles, less reasonable sums expended for prizes, local licensin9' fees, taxes and mair~.enance costs for the devices. No person who is not an .ac'hive member of an organization, or the spouse or surviving spouse of an active me~er,' may participate in the organization's operation of a gambling device or the con- duct of a raffle. Section 43:45. Reportoin~_~equirements. Subdivision 1.~ Gross Receipts_. Each organization licensed, to operate gam. b!in_~ devices shall keep record of its g~.oss receipts, expenses-and profits for each single gathering or occasion at which gambling devices are operated or a raffle is conducted. Leases shall be in writing and shall be for a te~ of at least 'one year. No lease shall provide that rental payment[~ be based upon a percentage of receipts. A copy of the lease shall be filed with the city clerk at the time of the application and it shall comprise a part of the application. " Section 43:55. Prizes. Total prizes from the operation of paddle wheels and tipboards awarded in any single day in which they are operated s~a'I.1 not exceed $500. Tohal prizes resulting from any single spin of' a paddle wheel or from any single tipboard shall not exceed $100. Total prizes awarded in any calendar year by any-organization shall r~o-t exceed $15,000. · Section 43:60. Bingo. Nothing in th.~s ordinance shall be construed to authorize th~:~ conduct of bingo without acquiring a separate bingo licensee as required by other applicable city ordinance provisions. Fisher: 2-12-79 Following authorization granted by the school board in its December meeting, central administration arranged a meeting on January 23 to explore the future use of the Mound building. Present were central administrators Dale Eo Fisher, Donald Brandenburg, and Wayne Smith; school board chairman Gary Mayer; police chief Chuck Johnson; com- munity services president Jim Regan; community services committee chairman Craig Clark; and community services coordinator Don Ulrick; with regretted absence by Leonard Kopp, Charles Peterson, and Jeanne Glenn. Herewith is an account of the future use of the Mound school building under the headings of current assumptions, specific plans, and status report. CURRENT ASSUMPTIONS 1. The Mound building should not be sold, but should be kept in district possession as a hedge against unforeseen student enrollment increases. 2. The grounds of the Mound school should be retained for the foreseeable future as school-community athletic and recreation facilities. 3. Portions of the building should be leased to non-profit organizations. 4. Central administration should be housed in the Mound building for the foreseeable future. 5. Seventh graders will be evacuated from the Mound building already for the 1979-80 school year. 6. Primary and Kindergarten children will be evacuated from the building eventually. 7. Community Services should be permitted to grow and function in the Mound building, to the limit of community services revenue. 8. A bond issue for the auditorium at the senior high location is out of the question for the foreseeable future. Future Use.. - 2 - 2-12-79 SPECIFIC PLANS A. Research on the part of central administration on four legal questions: Whether portions of the building can, practically, be leased only to non-profit organizations; whether leases can, practically, cover only the maintenance costs of the district; whether revenue from leases may be returned to the general fund of the district; and whether the district can spend capital outlay funds for the remodeling of portions of the building to be leased. B. A leasing arrangement whereby the-Police Department would take over 8400 square feet of basement, including the current space allotted to central administration and an outside basement entrance on the north side of the building, to be explored immediately and be presented to the school board in its March meeting. C. Removal of seventh graders from the building at end of the school year, and assignment to Grandview next school year. HEDGE: Student registration in the junior high division to be completed in late March will indicate whether any seventh graders must be shuttled back to the Mound building next year. D. Allocation of the first and second floors of the 1939 section of the building, across from the Mound Clinic, to the Community Services Council. E. Summer remodeling of'three pods in the northeast corner of the building for central administration and special services, With some facilities designed to be shared with the community services council. Occupancy in August. F. Early-fall remodeling of the basement quarters by the CiLy of Mound for use by the Police Department. Occupancy in September or October. G. Retention of the five pods in the southeast corner of the building for Kindergarten and primary children until space is found for them in other district schools. HEDGE: If under-expectation funding by the Legislature and over-expectation settlement of employee contracts converge to pressure the district budget, as may become clear by June, the 1980-81 budget may have to be rescued by savings through the precipitous evacuation of the Mound building. This action would temporarily overcrowd other schools, and would permit mothballing of five pods in the Mound building until use for them is discovered. H. Conversion of the gymnasium to an auditorium at some future date when funds permit and growth of the Performing Arts dictates. HEDGE: Because of drain on capital outlay funds for the addition to the Grandview school, the summer of 1982 would be the earliest opportunity to spend money on the downtown auditorium. Future Use.. - 3 - STATUS REPORT 2-12-7g 1. It has been determined through consultations with other school districts that the d~str~ct should lease only to non-profit organizations, that such leases should cover only district maintenance costs, and that lease revenue can be deposited in the district's General Fund. 2. On the subject of remodeling costs for the benefit of lessees, it has been determined through consultations with other school districts that the district should require lessees to stand the cost of their own re- modeling, and that remodeling plans are subject to the approval of.the school district. 3. Exploration of a mutually agreeable lease arrangement betw:een the City of Mound and District 277 is now being carried on by Roger Reed. 4. The junior high division has been directed by central administration to attempt to register all seventh graders in Grandview, and to report the results to central administration. 5. Central administration has complete drawings for central administration headquarters, on file for showing to school board members and others as desired. 6. Central administration is monitoring four contingencies which have a bearing on an earlier evacuation of Kinder- garten and primary children from the Mound building: ongoing enrollment fluctuatio.ns; the prospect of enrollment decline because of the Calvary Memorial School and even the addition of seventh and eighth grades at'the OLL school; the effect on budget of funding actions of the Legislature; and the effects on budget of salary settlements--the latter two matters becoming visible perhaps by June. 7. Upon vote the motion carried. Former Manager Robert B. Carroll. The managers noted, with deep regret, the death of former manager Robert B. Carroll, who~served on the Board of Managers from the establishment of the Board in 1967 until his retirement in 1976. The managers expressed their deep appreciation of Mr. Carroll's long and dedicated service on the Board and have formally extended their sympathies to Mrs. Robert B. Carroll. The managers noted receipt of a communication from Mrs. Carroll thanking the managers for their sympathies extended. Plymouth Boundary Petition. The managers noted receipt of a communication from the Director of the Division of Waters, Department of Natural Resources, acknowledging receipt of the District's petition for a change in the boundaries of the District within the City of Plymouth. Treasurer's Report. The treasurer distributed a revised statement of the administrative fund report dated December 21, 1978 pursuant to the direction of the managers at the last regular meeting. Page Three January 18,; 1979 Minnehaha Creek Floodplain Zoning/City 0.f ~opkins. ~President Coehran repot%ed %ha~ correspondence had been sent from the District to the City of Hopkins expressing the concern of the Managers regarding proposed amendments to the floodplain delineaeion within the City of Hopkins. ~i.ty of Minneapolis Bridge ~roposal. The engineer reported tha~ the City of Minneapolis had indicated its intent to submit to the managers its propos- als for bridge reconstruction and renovation along Minnehaha Creek for concept review by the managers. The managers directed the engineer to advise the City of the applicable District standards regarding such activities. Permit Form Revision. The engineer distributed a revised permit application form pursuant to the direction of the managers at the last regu- lar meeting. Following discussion, further amendments were made to the proposed form and the engineer was directed to resubmit the proposed application form at the next regular meeting of the Managers. Minnehaha Creek Improvement Project. The engineer distributed a memorandum dated January 17, 1979 reflecting a meeting held in the office of the DNR 'Metro Region'Headquarters with the DNR regional hydrologist. The engineer advised the Managers that the status of the work on the new dam and control structure for Gray's Bay were reviewed with the regional hydrologist as well as the current evaluation by the District engineer regarding creek channel characteristics. Agreement with Nine Mile Creek Watershed District and the City of Edina. The engineer reported that further discussions had occurred with the city engineer of the City of Edina regarding the need to'enter into a written agreement regarding the diver- sion structure at the northeast pond (Southdale) in Edina. The managers directed the attorney to prepare a short written agreement to cover the operation of this diversion on an annual basis by the affected municipality and watershed districts. In order for the Council to get a perspective of the two systems, we have drawn together a few statistics for review. In both cases the line would have to be hung on the bridge. The ques- tion then becomes, "can the pipe be kept from freezing, if there is no cir- culation On the line during the Winter"? In all likelihood, a bleeder would have to be on the line to keep it from freezing in the Winter. It is our understanding that the Health Department will not allow a water line to be laid under the Channel. rd L. At the time of the sanitary survey, only two of six wells were totally operational. One of these wells was being pumped 24 hours per day and the other 14 hours per day. If no additional well pumps are repaired, low pressure problems will continue to occur as demand for water increases. This could jeopardize the sanitary quality of the water being delivered to the consumers. In addition, the average daily water usage greatly exceeds the guideline of providing a minimum of one day water storage capacity. We strongly recommend that consideration be given to the construction of increased water storage facilities. The city should submit a letter to this Department outlining a proposed course of action for dealing with the deficiencies noted in this report. Personnel from this Department are available at any time to assist you concerning this matter. This means that Certificates of Participation for the Metro HRA Rent Assistance Program will not' be valid in that City-during this period and applicants will need ~to be. informed that rental units in Brooklyn Park-are not eligible for assistance.. The decision to accept t'his request of Brooklyn Park was based on several factors. One· the Metro HRA programs depend on voluntary participation' of communities involved. Two, Brooklyn Park has been the highest achiever in the Section 8 Existing Program. Three,'Brooklyn Park has'achieved over 200% of its three-year allocation plan goal for subsidized housing. In accepting this request of Brooklyn Park, the Metro HRA Advisory Committee was aware that the limitation would affect other participating communities in the Program and could generate some administrative problems. The Metro HRA Advisory Committee is also interested in evaluating the ramifications of relating the participation in the Section 8 Existing Proqr~ to the achievement of Allocation Plan goals. We are acutely aware of the voluntary nature of the Metro HRA. It is dependent upon the cooperation of all participating communities for the successful operation of its programs.. What one community does ~ or does not do can have an effect on the others and on the total program. Sincerely, Fam Nelson 377 hennepln L uman West Hennepin Human Services Planning Board 41 O0 Vernon Avenue South St. Louis Park, Minnesota 55416 920-5533 COMMUNITY FOOD AND NUiTRITION PROJECT Effective November l, 1978, the West Hennepin Human Services Planning Board began a Community Food and Nutrition project in cooperation with the South Hennepin Human Services Council, the Northwest Hennepin Human Services Council and Scott-Carver Economic Council. The project is funded~for nine months by the Federal Community Services .Administration and is a Community Action Program. Goals The overall goals of the project are the same for each of the four council areas, however, each area will function independently and will focus on special local issues regarding food and nutrition. The primary objective of the Community Food and Nutrition project is to establish a citizens advocacy council in each geographic area. The citizen's advocacy council will not only assess the existing food and nutrition programs in terms of their accessibility a~nd appropriateness to West Hennepin residents but will also seek to solve local problems concerning food and nutrition issues by promoting alternatives and needed reform. The councils will include representatives of numerous groups concerned about food and nutrition such as: Seniors, persons on fixed incomes, city and elected officials, agricultural workers, etc. For the nine month duration of the project, the advocacy co6ncils will work with a staff person from each planning board. Following that, the strength of the advocacy councils will be such that they will continue as esta- blished community groups. Role of the Community Advocacy Council One of the primary issues to be addressed during the course of the project is the impact of the change in food stamp regulations which will be im- plemented partially December 1 and finally March 1o It is anticipated that extensive community education will be required to help current and potential recipients understand the impact the new regulations will have on their participation in the program. Likewise, public awareness of other available food and nutrition programs will be stressed. 37/ -2- It is expected that each of the four geographic areas will have different community issues to address within each citizens advocacy council but generally along with specific community issues, each area will address some of the following tasks: 1. Build coalitions with other organizations and agencies involved in food and nutrition planning. 2. Advocacy for more and better delivery and accessibility of needed food and nutrition services to target groups. B. Surveys regarding food and nutrition. 4. Securing more effective outreach both through existing agencies and the development of Public Service Employment projects to expand participation Of the poor in established food programs. 5. Arranging training and providing technical assistance for developing food buying clubs and food co-ops as needed. 6. Establishment of a means to monitor food and nutrition programs. 7. Working with churches and other community groups in establishing and maintaining area food banks. 8. Recruiting volunteers to assist in the distribution of HEW, USDA, and the State Food Stamp Office leaflets, brochures, etco 9. Working with area grocer associations and farmers to pro- mote grea'ter acceptance of the food stamp program by the public. 10. Other issues and tasks as defined by the advocacy council. Staffing and Organization Scott-Carver Economic Council is the grantee for the project; coordination is a joint effort by all four agencies. The entire Community Food and Nutrition Project staff will meet regularly during the project period to develop joint training, share information, solve problems, and monitor the overall success of the project.
