In return for the easement, the City has offered the following: 1. Fill from the 1979 street construction for said lots to bring them up to the road grade of Manchester Road. 2. A boundary survey of said lots (to be made in conjunction with the surveying for the storm sewer easements). 3. The square footage in the easement shall be included in the square footage total for determining lot size. Duane, the shop superintendent said if we do them alon9 with the rest it will save us about $~00,00 in labor as they will have everythin9 torn down and won't have to do it twice. I would recommend that we do the complete repair at this time. We then could send the sweeper in each winter starting in December of 1980 for an annual check and small repairs so we don't get a lar§~ bill like this again. For once it feels good to be in the audience~ As Mound's planner, it becomes evident that certain communication and planning coordination take place between Mound and Minnetrista. To this end, I wish to inform your office that at anytime during Mound's planning program we are prepared to meet and discuss common concerns. And although Mound is fully developed and is contained by jurisdictional boundaries, transportation and environmental elements (i.e., lake and wetland preservation), in particular, are two areas initially identified. While Mound's planning project has just recently started as of a few months ago, by this summer we would be in a position to informally present preliminary program elements for Minnetrista's review/comment. In the mean- while, I would appreciate receiving a copy of Minnetrista's wetland ordinance, since obviously the lake and its drainage areas are common to both cities. Coordination with this key issue is worthwhile striving for. Good luck with your Hennepin County 2½ acre grid soil analysis system and agricultural preservation attempts. Passenger Waiting Shelter Permit Agreement 2. Passenger Waiting Shelter Cooperation Agreement Financial Participation Also attached are copies of two diagrams[ one showing a shelter at Shore- line and Bartlett and the other, Three Points Boulevard and Gull Lane. The~cost of each shelter for Mound will be $300 to $500 plus maintenance. It is recommended that the CounCil pass a resolution authorizing the Mayor and Manager to enter into the two agreements with the Metropolitan Transit Commission. Kopp City Manager 5341 Maywood Road Mound, MN 55364 1979 Passenger Waiting Shelter Project Cooperative Agreement Site Number(s): C-874, C-875 Dear Mr. Kopp: The Metropolitan Transit Commission has approved the plans and specifi- cations for its 1979 passenger waiting shelter project. It has also authorized its Chief Administrator and General Manager to enter into cooperative agreements with cities and other p~rties to provide for passenger waiting shelter installations at locations where ridership does not meet current MTC guidelines for shelter installations; into which category the above referenced site(s) fall. The cooperative agreement is a way to allow for installations in cities which would otherwise not be included in the shelter program. Provision has been made to ensure that any city will be eligible for at least one shelter installation per project, if a cooperative agree- ment is executed. Basically,.the agreement calls for participation in the form of financial reimbursement to the MTC for one half of the lccal funding of the shelter. The shelters are funded by 80% federal money and 20% local money. We estimate the individual costs of the new shelters will be in a range from $3,000 to $5,000 for the purchase of shelters, and related site improvement and installation work. Therefore, the participation share will be approximately $300 to $500 per shelter. Additionally, the agreement calls for routine maintenance to be performed by the party entering into the cooperative agreement with the MTC. Routine maintenance includes litter pickup, snow removal, weed and grass control in the vicinity of the shelter and window cleaning. Any structural repairs to the shelter would remain the responsibility of the MTC. Three copies of the cooperative agreement are enclosed for execution by the appropriate individuals. There is no existing passenger waiting shelter permit agreement on file between your City and the MTC. You will also find enclosed three copies of a permit agreement which must be executed prior to any installation. The shelter shall remain the property of the MTC. This agreement is subject to the successful acquisition by the MTC of all approvals, permits and site leases which may be required. Additionally, the MTC reserves' the right to limit the number of shelters installed in any city under the'next project to one, including any shelter not covered by this cooperative agreement. All sites being considered for the project have been prioritized. If more than one site number is listed above, additional sites may be incorporated into the project from first to last as project funding allows. CITY'S OBLIGATION. The CITY shall perform routine maintenance (litter pick up, snow shoveling, window cleaning, weed and grass control, etc.), unless noted otherwise on Exhibit A. Sprin~er, General }~nager PASSENGER WAITING SHELTEi PERMIT AGREEMENT THIS AGREEMENT, made and entered into this day of · by and between the CITY OF MOUND , a municipal'corporation of the State of Minnesota (hereinafter referred to as "City"), and the METROPOLITAN TRANSIT AREA, a public corporation and political subdivision of the State of Minnesota, acting by and through its governing body, the ~TROPOLITAN TRANSIT COMMISSION (here- inafter referred to as "MTC"); WITNESSETH: WHEREAS, MTC, pursuant to authority provided in Minnesota Statutes, seCtion 473A.06, Subdivision 5, is empowered to use public streets and right-of-way for the purpose of e.recting passenger waiting shelters; and WHEREAS, the MTC has established a passenger waiting shelter pro- gram for the comfort, convenience and safety of its passengers; and WHEREAS, the City recognizes the benefits to be afforded its citi- zens thereby and thus wishes to Permit the establishment of passenger 'waiting shelters within the City limits; NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS: The City does hereby permit and grant, subject to each and every provision of this agreement, to the MTC the right to provide passenger waiting shelters on the public sidewalks and property of the City on the terms and conditions herein set out and provided as follows: 1. The MTC may, at its own expense, construct, install, o~erate, maintain and ~emovepassenger waiting shelters, including the installa- tion of concrete bases and wiring necessary to provide heat, light and~ telephone service to the passenger waiting shelters if desired by the MTC. 2. Approval of Sites. The location of each passenger waiting shelter shall be subject to'the approval of the City. A site plan shall be submitted to the City for each passenger waiting shelter. 3. Notification of Property Owner. The MTC shall notify the abuting la~downer of its intent to construct a passenger waiting shelter on each site at least ten (10) days prior to the beginning of construction. 4. Permits. If required, the MTC shall obtain a building permit from the City Building Inspection Department in the normal manner reqUired by ordinance except that any fees required may be waived. The MTC shall obtain sidewalk construction permits when necessary in the normal manner required by ordinance, except that any fees required may be waived. The MTC shall obtain any necessary electrical and communication services and in so doing shall comply with all applicable City ordinances. -2- 5. Removal of Shelter. The MTC may, upon thirty (30) days written notice to the City, remove any passenger waiting shelter. The MTC shall remove any passenger waiting shelter upon ninety (90) days written notice given by the City. 6. Shelter Site Restoration. Upon removal of a passenger waiting shelter, the MTC shall restore the shelter site to the con- dition or its equivalent as mutually agreed to by the City and the MTC, at the time of the installation of the shelter. 7. Terms of the Agreement. This agreement shall be for an indefinite term of years commencing the date of its execution. Upon ninety (90) days written notice, this agreement and any modifi- cation thereof may be terminated by the City or the MTC when either party determines its convenience requires such termination. 8. Indemnificatfi.on. The MTC shall indemnify and save harmless City from any and all claims by or on behalf of any person or persons for personal injuries, wrongful death or property damages arising out of any act or occurrence committed in or arising from the use of the premises for passenger waiting shelter purposes, except such claims arising from the negligence of the City. 9. It is agreed that neither party relinquishes or waives any of the responsibilities or powers imposed upon it by law or regulations by the execution of this Agreement. NNEPIN COUNTY Problem Statement And Background Information The problem was clearly stated in Police (a 1973 report of the National Advisory Commission on Criminal Justice Standards and Goals): "Small local police departments, particularly those of ten or less men, are unable to provide a wide range of patrol and investigative services to local citizens. Moreover, the existence of these small agencies may work a hardship on nearby jurisdictions. Small police departments which do not have adequate full-time patrol and pre- liminary investigative services may require the aid of larger ~gen- cies in many facets of their police work." -1970 Report on State-Local Relations in the Criminal Justice System, Advisory Commission on Intergovernment Relations At the same time that the problem above was cited at a nationwide level, the identical situation was being studied in Minnesota. The conclusion of that study states: "Law Enforcement is a local problem that must be met at the local level but is one with profound state and national ramifications that must be dealt with in a systematic and coordinated manner. Uncoordinated, incommunicative, and fragmented law enforcement is but one step above individual self-help and amounts to approach- ing a critical social problem on an atomistic basis. Local law enforcement can be successful in meeting 'the challenge of crime in a free society' if we decide to provide, the police with the resources (organizational and material) necessary to do their jobs." -Stefan J. Kapsch, Minnesota Police Organization and Community Resource Allocations, 1970, Governor's COmmission on Crime Prevention and Control The National Advisory Colamission on Criminal Justice Standards and Goals Police Standards 5.1 speaks of the need to "...provide complete and competent police service through an organizational structure that most eff~ctively and efficiently meets its responsibility." In Minnesota the 1977 Comprehensive Plan of the Governor's Commission on Crime Prevention and Control expressed a similar view; -2- Each Minnesota should have access to law enforcement services: llowing minimum 1) on a 24-hour basis, response to emergency calls by on-duty trained personnel within the shortest possible time; 2) prompt and thorough investigation of criminal compliants; and 3) performance of, and compliance with all statutory duties re- 'quired of sworn Minnesota peace officers. The 1978 Henne~ Criminal Justice Plan and 1979 Henne~Criminal. Justice Annual Action Plan in describing the problem facing the law enforcement subsystem stated: Regionwide, countywide and multi-agency coordination, consoli- dation and cooperative efforts need to be supported and expanded. The 1979 Plan also described goals in this area as: The Hennepin County Criminal Justice Coordinating Council seeks to improve law enforcement in .the county by encouraging the sharing of law enforcement services and resources while improving levels of service by addressing management problems. The Hennepin County Criminal Justice Coordinating Council desires that every resident of Hennepin County'be provided with essential law enforcement ser- vices, including on-duty trained personnel on a 24-hour-per-day basis, prompt and efficient investigation of crimes and professional cost-effective management. Specifically, to insure the attainment of its goals,'the Council will support'activities designed: · To share law enforcement services and resources. To formalize cooperative relationships between law enforcement agencies. To maintain or improve levels of law enforcement services 'within financial limitations. To monitor and evaluate projects that promote cooperative relationships among law enforcement agencies. " To provide technical assistance in the area of management problems, including organizational and policy development, management information and budgeting. To develop and implement community-oriented resource allocation/ management models for law enforcement agencies. The HDnnepin County rban area has, for the most a fortunate combination of good municipal management methods, adequate police resources and outs.tanding law enforcement leadership. Most of the efforts which contribute to this satis- factory picture of the law enforcement subsystem have occurred in the more populous communities of the county. During 1978, the Hennepin County Criminal Justice Coordinating Council and its staff have been requested to meet with officials representing 14 local units of government in the Western and Hort~- western portion of the county. The concerns of these officials centered on better defining the police services needs of their communities and providing services in response to those needs primarily in local jurisdictions each having a population of less than 10,000. .A study of law enforcement service needs and capabilities in Western and North- western Hennepin County is proposed. The study, will be conducted as a coopera- tive effort of=the jurisdictions affected and will be coordinated by the Hennepin County Criminal Justice Coordinating Council.. The study will be staffed by the Criminal Justice Unit of the Office of Planning and Development and will address the following issues: Current Service I.m,~en~o~. In producing these letters for you, we are attempting to be open and above board in our negotiations, but we want to specifically emphasize and have it understood that these letters are being produced with the under- standing that the City or its legal representatives are not waiving the right to object to the introduction of any of these ~documents into evidence or for impeachment purposes on the basis of the lawyer- client privilege. I believe we have responded affirmatively to all your requests except that you ask for dispatch reports. I am informed by the Chief of Police that no such reports are in the City's files and that there is a possibility that the Hennepin Co~u]ty Sheriff may have some dispatch report concerning this incident, but they will not release any information they have without a subpoena. I myself am very doubtful that any reports exist or that there is any tape or other statement of %he radio report directing the officer to go to the liquor store. I am also asking at this time that you. and Mike provide us with any and all updated medical reports you have concerning Mrs. Perron.
