F.]~ . , 9-16-80 CITY OF MOUNO Mound, Minnesota September 15, 1980 COUNCIL MEMORANDUM NO. 80-3i5 :SUBJECT: Park Land and Tax Forfeit Land The City has been holding Lots 6,.13, 14 and 15, Block ll, Devon for park purposes. The Park Commission on ThurSday night recommended this land be sold and the proceeds used for park purposes. Lot 6 is held on a tax deed and this would be returned to the State for sale. They would distribute the proceeds after the assessment~ are paid. Lots 13, 14 and 15 were purchased by the City after someone had purchased them tax fOrfeit and these could be sold by quit claim deed. Lot 6 - On F~iday, the owner of Lot 5 call~dand asked if he could pur- chase Lot '6. Sometime ago, the owner of Lot 7 asked the same question. It was suggested 'to the owner of Lot 5 to get together with'the owner of Lot 7 and possibly each could take half. Two recommendations are made: It is recommended Lot 6 be re~0rned to the State and the Mayor and Manager be authorized to purchase the lot at private sale and'¥esell it to either the owner of Lot 5 or Lot 7 or one half to each. 2. Prior to becoming a full time Police Officer, Patrolman Kraft worked part time for the City. . Lot 4 and the south 5 feet of Lot 3 is too small for a building site and little of Lots 20, 21 and 22 is above water. Placed all together, this will be a good building site. Presently, the owner of Lots 18 and 19 are using Lots 20, 21 and 22 as a dock for their house boat. I called them and notified them when this went tax forfeit. The Gas Company proposes to have a demonstration and picnic on the Saturday during Fire Prevention ~-teek. This would be open to the public. This will be discussed more at the Sg,.pt. meeting. The nature of Claimants' claim against the City of Mound is for negligence and/or willful and wanton failure to complete with reasonable oromptness the road improvements on Sunset Road in the City of Mound, to enforce contractual commitments of road and curb contractors and to provide safe passageway and warning during construction. 4. That on or about August 10, 1980, Claimant Hargaret Vanecek suffered serious personal injury because of the City's negligence as set forthlabove. 5. That Claimants suffered considerable damage, incurred considerable expense and lost income as a result of the City's negligence. 6. That the full amount of Claimants' damages has not yetbeen calculated.
