Planning Commission Recommendation Public Hearing - consideration/action on ordinance amending Chapter 129 to prohibit exterior storage on undeveloped lots and new regulations regarding ice shelters Smith said she will provide the overview of proposed changes to Chapter 129 and Field Officer Andy Drilling will present the other items. Smith said the first action is to address exterior storage on undeveloped lots and ice shelter storage and noted this is a topic that has been discussed previously in conjunction with broader conversations on exterior storage and that this is considered somewhat of a baby step to tightening requirements. Smith said zoning amendments require a public hearing and that existing code is 1 storage unit per 3,000 square feet, and the recommendation of the Planning Commission is to eliminate any storage units on undeveloped lots unless they are adjacent to a developed lot that is tax combined to create one PID. Smith said the ice shelter structures seem to be increasing in use and this is an attempt to address them specifically. Velsor asked if the vacant lot can be across the street and Smith said she did not think so for the PIDs to be combined. Mayor Salazar opened the public hearing at 7:09 pm and upon receiving no comment, closed the public hearing. Consideration/action on ordinance amending Chapter 42 of the Mound Citv Code regarding public nuisances affecting peace and safety Field Officer Andy Drilling said Staff is looking to strengthen the definition of the word 'junk' and to link it to the definition in the zoning code and nuisance language. Larson said she still thinks the language is vague. Drilling said the vehicles may or may not be licensed, but it also addresses furniture and construction material. Larson said people's interpretation may differ and asked what if they have a tarp over the junk. Drilling said it would depend on the condition of the items, but noted the City can't write code for 'taste.' Larson said as a complaint -based city, enforcement would depend on neighbor complaining. Drilling agreed and said they try not to be heavy handed but rather work with the property owner. Larson noted two calls in the fall regarding leaves being blown in the street. Drilling said that is covered under the next item. ORDINANCE NO. 02-2020: AN ORDINANCE AMENDING CHAPTER 42 (NUISANCES) OF THE MOUND CITY CODE REGARDING PUBLIC NUISANCES AFFECTING PEACE AND SAFETY 8. Consideration/action on ordinance amending City Code Chapter 46 of the Mound City Code related to detached trailer parking, disorderly property and littering Drilling said this will fall under the jurisdiction of the complaints -based system and it is just considered another tool if the owner is not cooperating. Drilling said if the neighbors are OK with it, it won't be an issue, but there are instances where people who don't have storage space are storing their detached trailer on the street all summer. Salazar asked how many are like that and Drilling said about four. Hoversten clarified there were four complaints but more detached trailers on the streets. Bergquist suggested looking at permitting for contractors that might be needed. Larson noted we are a recreational city and maybe something happened that they need to store it there. Velsor said then they will have an explanation to provide to the nuisance enforcement officer and the neighbors. Drilling said this needs to be addressed as we try to tighten up storage on private property as it may spillover. Velsor said he had issues with an attached trailer that was on a tight corner to begin with so he doesn't have a problem with restricting detached and requiring users to arrange for storage during the boating season. Salazar asked if they were moving it around. Drilling noted one that was parking it 3 blocks away from their property. Hoversten said this is not directed at reasonable people but rather the abusers. Larson clarified vehicle parking is allowed between 2am and Spm and asked if it could stay there for a week. Drilling said over 24 hours, the police would attempt to contact owner to move it and proceed from there. -278- Mound City Council Minutes — January 28, 2020 Drilling said Staff met with the Orono Police Department regarding disorderly properties which get a high volume of public safety calls and they are looking for tools to be able to cite the property owner to address the issues and reduce call volume. Drilling noted the city attorney helped to write the ordinance. Velsor asked if the property owner or renter would be responsible and Drilling said the property owner. Larson asked how many times is considered too many, and Drilling said it depends on the nature of the calls. Lastly, Drilling said the third part is to address the blowing and pushing of leaves and other debris into the street and this is again another tool for the police and public works to be able to abate and charge the expense back to the property owner. Drilling said the property owner would be given notice and the opportunity to resolve the matter before abatement. Requested Actions: i. Review/discussion of concept/sketch plan for proposed redevelopment of Commerce Place shopping center at 2200-2238 Commerce Boulevard Planning Case No. 20-01 Applicant/owner: Schafer Richardson Trapp, consultant planner, noted the concept plan is an optional exercise and that this is an update to the previous concept plan presented in 2019 and the applicant has made adjustments to try to address the concerns noted at that time. Trapp reviewed existing zoning and noted the project overview was provided in the packet, including 24 1 -bedrooms, 18 2 -bedrooms with the reminder studios for a total of 103 units. Trapp suggested the unit sizes suggest this development will not impact the school district. Trapp noted the project requires a replat and vacation of Fern Lane, noting all impacted parcels are owned by the applicant. Trapp said there is a total of 269 parking stalls, 253 multi -family 4 -279- Mound City Council Minutes — January 28, 2020 and 35 commercial, noting the variance has been reduced and as a destination district a traffic and parking study will be required. Trapp said the 50 feet or less at midpoint requirement has been met now that it is 3 stories and that additional images/views have been included in the packet. Trapp said the main feedback was comments from Hennepin County regarding access and those discussions will continue. Trapp said the Planning Commission asked about outdoor storage restrictions and Trapp said the applicant can limit that and the city can also make limits, noting other comments were standard. Trapp said applications will include a Planned Unit Development (PUD), Conditional Use Permit (CUP), major subdivision, preliminary plat and vacation of Fern Lane and that tonight is to give feedback on the concept. Trapp said another neighborhood meeting will be held in February to provide the neighborhood another chance to give feedback as well. Larson noted she has attended the neighborhood meetings and Planning Commission meetings and said the developer knows she is not happy about this project. Trevor Martinez, Shafer Richardson, said he appreciates the opportunity to address the council and is here for any questions. Bergquist said he appreciated the height and parking were adjusted and that they are holding multiple neighborhood meetings. Salazar asked for Martinez to explain 'market rate' for the benefit of the audience here and at home. Martinez said market rate rent is considered in the range of $1200 -$2000 per month with no subsidy, noting Section 8 vouchers would not be eligible for this level of monthly rent payments. Martinez said Steven Scott Management will manage the property and they do not allow exterior storage on the balconies. Martinez said there will be interior storage options for recreational equipment. Salazar asked what the official name will be and Martinez said it will be decided during the design phase and marketing plan development. Larson said she has been conducting an investigation and it would take a lot of time to explain. Salazar said this is the time to air any questions or concerns vs. the 11" hour, so he encouraged Larson to ask them. Larson said her questions were addressed but she just has concerns. Larson asked Trapp about the Livable Communities presentation that aired on television that she appeared on and Trapp said that was many years ago. Larson said she is concerned about CR15 ins and outs around that corner and the associated danger and that she is not going to let go of the traffic issue. Larson said 20 years ago all the area communities had a conversation with the federal government about HWY 12 and they did not listen and now it is named the corridor of death. Larson said she is concerned that the same thing will happen here and she said the road should not have been realigned. Larson said the post office, trail and transit center complicated things. Salazar said all the concerns are valid, but they have to do with many factors besides this project and noted residential is going to have less traffic than when it was thriving commercial and that it will bring more people who will support our existing businesses. Pugh said her concern is that there are only three ways to get out of this neighborhood complicated by the shopping center across the street. Pugh said it is not pedestrian friendly and some of the egresses need to be closed and traffic needs to slow down. Pugh said she avoids rush hours between 7am and gam and she feels the city, developer, county and possibly Mound Marketplace should be involved in creating a solution. Larson said issues will be compounded if Auditor's Road is blocked off. Salazar reiterated these are all valid points and that it is a privilege to be able to drive and there is a responsibility to drive safely and the rules need to be enforced. Salazar said he and the City Manager are working with Hennepin County on the trail crossing. Hoversten agreed the concerns are 61 � Mound City Council Minutes — January 28, 2020 valid and they are problems that need to be solved regardless of the project. Hoversten said concentrating the conflicts and putting more layers of control over them will be more productive but it will cost money and require the County's assistance. Larson said she started a business in Mound from ground zero and it is still operating to this day. Larson said we are allowing investors to come into the city and implode it with high density residential in our commercial areas. Larson said Pugh asked about whether the library could be moved to this area. Pugh said it is her dream to have it built in the Harbor District. Larson said she regrets the commercial area was not more lucrative and that Shafer Richardson did not divide the property up to make way for more professional services instead of giving up on it. Martinez said Shafer Richardson is sympathetic to that idea, noting 10 years ago they proposed residential and it was rejected and they spent the next five years looking at ways to make the commercial economically viable and it just wasn't possible, so they returned to residential. Larson asked about the rents since there are so many vacancies already and she said she is not a Millennial but wonders who would pay $2200 in downtown Mound with no view when she can go to Lakewinds for less than $1000 a month that includes an indoor pool and parking, etc. Martinez said a variety of reasons create demand, including that there are no new higher -end rentals in Mound targeting higher earners. Velsor asked if he was a new college grad and couldn't buy a property because of student loans where could he rent, noting the closest is The Mist, but that it is not in Mound. Martinez said they would not propose a plan that is not economically viable and that renters will included both Millennials 25 — 40 and some 55+ who want to downsize for lower maintenance and more time to enjoy the recreation in the area. Martinez said guidelines are housing should be 30% of income which would suggest renters would have income in the $48K - $75K range. Bergquist said it is a great project and there will be growing pains but these are county roads. Pugh said we can't stand by and Bergquist said no one is standing by. Pugh thanked Shafer Richardson for broadening the mailing area for the next neighborhood meeting. Hoversten said this is the opportunity to give the developer 'homework' on any concerns that you see in the concept plan. Pugh said at the Planning Commission it was brought up that the city should initiate a conversation with Wells Fargo and what they might be willing to do to help with the project. Hoversten said the Wells Fargo District Manager and Community Relations folks indicated they do not see any need for change unless the City is willing to build to suit and fund the improvements, so if no leverage is offered, the City and developer don't really have any leverage. Samuel Johnson, 2200 Belmont Lane, said they partially abut the property/proposed parking lot and he is concerned about having a parking lot bordering their yard and he is curious about screening requirements. Smith said they are not at that level of the detail but it is customary to provide a higher level of screening between lower and higher -density uses. Johnson asked if the lot is currently zoned residential. Trapp said it is zoned R3 — multi -family residential which is consistent noting the entire area will be rezoned. Johnson said traffic has been talked about a lot and his stretch is the most dangerous because of the hill and parking is allowed on one side of the street. Johnson said traffic will [y -281 - Mound City Council Minutes — January 28, 2020 go that way to get on CR 15 and the city may consider not allowing parking on the street as it is difficult to pass. Morgaine Johnson, 2200 Belmont Lane, asked because of the increase in people so close to residential neighborhoods, will there be additional security in the area since people can already cut through and now there will be more people in the area. Hoversten said the closure of the break in the existing building will also help reduce the tendency to cut through. Merrick Garland, 4842 Dale Road, said he is owner of 3soteric and that Anytime Fitness will be moving next to his business and that will be a great benefit. Garland said he thinks more activity in Stonegate Plaza will slow traffic along the curve but he agrees the County needs to do more. 10. Consideration/action on resolution approving 2040 Mound Comprehensive Plan (Complete Final Version of 2040 Comprehensive Plan available at www.cityofmound.com) Trapp gave a brief overview and stated the Comprehensive Plan guides development through 2040 and that it was a product of public and agency input and review and that the last year was the Met Council evaluation process to ensure it meets requirements of state statue and regional planning objectives for parks and open spaces and regional growth. Trapp noted it is essentially the same plan as presented in fall of 2018 for overall land use with just some technical changes. Trapp said Met Council approved the plan for adoption and once the council adopts it, changes to the zoning code and work plans will be developed. Trapp said 'mixed-use' vs. commercial or residential is emphasized to provide flexibility in the main corridors. Building Official Recommendation Consideration/action on resolution to authorize proceeding with hazardous building action at 4801 Tuxedo Boulevard Scott Qualle, consulting building official from MNSPECT, said on 2-1-18 there was a footings inspection and the property has since been in foreclosure, noting there has been little progress with the current owner who has no concrete plans to address the hazardous excavation and sediment erosion control issues. Qualle said he recommends moving forward with the hazardous building action to start the process with city attorney to allow the city to demolish it as it is not cost justified to repair, although that is technically an option for the owner. n -282- Mound City Council Minutes — January 28, 2020 Salazar asked about the timeline and Qualle said the attorney will file a document in court and that this action is an important progression to show city's attempts to cooperate with the property owner. Salazar noted this is an unfortunate last resort and hopefully the owner will respond. Bergquist asked if footings would be classified as unbuildable. Velsor said it is an issue when they are exposed to frost. Qualle said they would have to reapply for permits and they would be asked to show they are still viable. RESOLUTION NO. 20-18: RESOLUTION TO AUTHORIZE PROCEEDING WITH HAZARDOUS BUILDING ACTION FOR PROPERTY AT 4801 TUXEDO BOULEVARD Qualle then offered a public safety message to the audience and said he was in court today about a non -licensed contractor for a roofing job where the owner bought the materials and paid the contractor $4K in labor but the roof eventually leaked and caused $5K in damages and the owner had to have someone else do the repairs. Qualle said the contractor was sanctioned, but there is no real recourse as the contractor moved to Wisconsin. The owner is now looking to criminally prosecute the misdeamor offence of acting as contractor without being licensed but the contractor was a no-show. Qualle said the owner did all of this to protect the next guy so the lesson is to make sure you pull a permit so you have those protections to ensure they are licensed and complete the job right, noting cutting corners doesn't always save money. 12. Catherine Pausche, Director of Finance and Administrative Services, requesting discussion and action on updated ADMIN POLICY XXX: Personnel Policy —Code of Conduct Pausche said she and Council Member Larson have been working on this policy since the original version was proposed in August of 2019. Pausche noted the city has a series of policies addressing personnel matters, in addition to the Collective Bargaining Agreement for union employees and the Administrative Code for non-union, but this new Personnel Policy — Code of Conduct consolidates and updates many of them. Pausche said the staff has participated in training on respectful workplace behavior and this policy is meant to define expectations and also to formalize procedures if a complaint or concern is received, particularly in the area of harassment. Pausche said language has been added to include incidents involving harassment of non -employees, including residents, per Council Member Larson's direction and that the City labor attorneys have reviewed the harassment policy section and Complaint form. Pugh asked if there is a policy or procedure addressing how often the policy will be reviewed and updated. Pausche said typically the date is "TBD — to be determined" and noted that the League of Minnesota Cities is good at notifying its members of changes in regulations. Pausche noted any policy can be updated at any time and this will be a living document that will remain at the forefront. Council Member Sherrie Pugh with an update on the 2020 Census Pugh said she attended a Hennepin County complete count meeting and noted how important it is that everyone is counted as Minnesota is at risk of losing a congressional seat. Pugh said an on-line map will be available that will show areas that were undercounted in previous years, noting that they are often in multi -family complexes, and that the library will be accommodating people to complete the census on-line. Pugh said babies born as of March 31' are to be counted which is very important to the school district. Pugh said there are outreach efforts and many organizations are participating in communicating the importance of the census. Salazar said there will be enhanced communication efforts as this will be different as counting is going to be all on-line. Salazar said reps from the county will follow-up with those households that did respond and he encouraged everyone to participate and work with the county reps if asked. 14. The waiver of platting does not disqualify the involved parcels from lot of record status. The waiver of platting must comply with all planning and zoning standards and objectives. The applicant also submitted a variance application to request a 6 -foot setback from Sunrisee Landing. As part of research and Planning Report preparation, Staffs determination is that Sunset Landing was not platted as a street. Therefore, a 6 -foot setback is required in this location and variance approval was not needed. Details regarding Staffs review of the request is included in the Planning Report for PC Cases 20-04/20-05 and supporting information which has been included as an attachment(s). En PLANNING COMMISSION MEETING OVERVIEW AND RECOMMENDATIONS The Planning Commission reviewed this case at their February 4th meeting. The applicant, Daniel Johnson, was present at the meeting. Staff provided an overview of the requested waiver and commented that Lot 1, which is being requested to be separated from the current parcel holding meets the requirements for a R -1A lakeshore lot as a lot of record. The applicant, who resides at 1766 Shorewood Lane, which abuts the subject parcel on the south side, intends to build and reside in the new home to be constructed. Staff also explained that a variance application was submitted however Staff's determination is that a 6 -foot setback is allowed as Sunrise Landing, which serves as a point of access to the lake, was not platted as a street in the Shadywood Point plat. Therefore, the 6 -foot setback is conforming and a variance is not required. 2 neighboring property owners attended the meeting. One of the neighbors in attendance commented on wetland/filling activities that took place by a previous owner. Staff noted that the Hennepin County Natural Resources mapping system and wetlands map in the Comprehensive Plan did not indicate wetlands on the property. However, there is some historical information in the property about floodplain/wetland filling regulations and activities and potential wetland conditions in the property jacket. The applicant informed the Planning Commission that he had been in touch with the MCWD and was informed there were no wetlands present. The Planning Commission unanimously voted to recommended approval of the waiver application, with the recommendations and findings from Staff, with an additional condition that a wetland and soils report be prepared and provided prior to future home construction. The Planning Commission also unanimously voted to recommend Staff's setback determination be affirmed with the finding that Sunrise Landing is not a platted street. Given Staff and the Planning Commission recommendations for approval, a resolution has been prepared for City Council consideration. The draft minute excerpts from the February 4th Planning Commission meeting have been included as information. NOTIFICATION Neighboring property owners, per Hennepin County tax records, were mailed notice on February 5th to inform them that the variance was being included on the consent agenda for the February 11th City Council meeting for action. -287- CITY OF MOUND RESOLUTION NO. 20 - RESOLUTION TO APPROVE WAIVER OF PLATTING FOR 1754 SHOREWOOD LANE The applicant, Daniel Johnson, on behalf of 4 J's Investments LLC, submitted a waiver of platting application for the property at 1754 Shorewood Lane requesting approval to release Lot 1, Block 3, Shadywood Point from the current parcel holding. The purpose for waiver is to create a new conforming lot to accommodate future construction of a new single-family home; and WHEREAS, the property at 1754 Shorewood Lane generally described as Lots 1 — 3, Block 3, Shadywood Point; and WHEREAS, the applicant intends to subdivide Lot 1 (Proposed Parcel 1) from the current parcel along the using original plat lot lines, with the exception of boundary adjustment activities involving the shared lot line with Lot 4, which took place in the early 80's and is not affected with the separation of proposed Lot 1, Block 3, Shadywood Point, to allow construction of a conforming single family house; and WHEREAS, the applicant intends to reside in the future new home to be constructed; and WHEREAS, the property is zoned R -1A and single-family residential is a permitted use; and WHEREAS, City Code Chapter 121-33 (2) states that a waiver of platting request may be granted by the City Council if it is determined that the proposal is in compliance with the City Code; and WHEREAS, lots that are separated by a waiver of platting retain lot of record status; and WHEREAS, a variance application was also submitted to allow a side setback of 6 feet on the north side abutting Sunrise Landing. Staff's determination is that a variance is not required as a 6 foot side setback is allowed as Sunrise Landing was not designated as a street in the plat of Shadywood Point; and WHEREAS, the Planning Commission reviewed the waiver of platting request at its February 4, 2020 meeting and recommended Council approval subject to the conditions and findings, as recommended by Staff, with an additional condition that a wetland and soils condition report be prepared. The Planning Commission also recommended the Council affirm Staff's determination that a variance is not required as the assigned setback on the north side is 6 feet as Sunrise Landing was not platted as a street; and WHEREAS, the City Council's decision on the waiver of platting was made within the required timeline in Minnesota Statutes; and WHEREAS, in approving the waiver of platting, the City Council hereby makes the following findings: 1. The lots created with the waiver are consistent with the Comprehensive Plan guiding of Low Density Residential. 2. The lots involved in the waiver and adjacent property owned by the applicant are original platted lots. The new buildable lot being split is an original platted configuration. 3. The new buildable lot on Lot 1 (Parcel 1) meets the lot size, lot width, and lot depth for a R -1A District lakeshore lot of record. The future new home to be constructed will be conforming to setbacks. 4. The existing/proposed lots have improved access on an improved public street. 5. The proposed lot arrangement can accommodate the construction of new single- family home on Lot 1. 6. The waiver of platting will not alter the essential character of the neighborhood or have an adverse impact on adjoining property. 7. The City Council affirms that a variance is not needed as the required setback on the north side is 6 feet as Sunrise Landing was not platted as a street in the plat of Shadywood Point. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Mound does hereby incorporate and restate the recitals set forth above and approves waiver of platting for the property at 1754 Shorewood Lane with the following conditions: 1. New driveways must be hard surfaced in accordance with City Code regulations. Minimum driveway width is 10 feet; maximum width is 24 feet. Minimum side setbacks of one (1) foot are required for driveways. 2. Drainage shall not be directed to neighboring properties. 3. Any curb, gutter and streets which are disturbed because of construction, including, but not limited to, installation of the water service, sewer service and small utilities, shall be the responsibility of the permit holder. 4. As part of the City's approval of the waiver, the dedication of public drainage and utility easements, to be determined by the Public Works Director, or designee, will be required and shall be submitted in a form to allow for recording at Hennepin County, and shall be subject to review and acceptance by the City, prior to recording. The standard drainage and utility easement is five feet wide on side and rear lot lines and ten feet in width along the front lot line but shall be as determined by the City Engineer or Public Works Director. Easement(s) shall be provided in an appropriate form so as to allow for recording at Hennepin County and shall be subject to review and approval by the City prior to recording and require signatures from property owners and lienholders of record. 5. BOARD OF APPEALS PC Case No. 20-04/PC Case No. 20-05 Waiver of Platting and Variance 1754 Shorewood Lane Applicant: Dan Johnson / 4 J's Investments LLC Smith introduced an overview of the planning case for a waiver of platting to subdivide the property at 1754 Shorewood Lane, submitted by property owner Dan Johnson. The applicant seeks to subdivide Lot 1 from current property along the original lot lines. The current configuration is bounded by Shorewood Lane on the west side, Sunrise Landing on the north side, Lake Minnetonka on the east and 1766 Shorewood Lane on the south side, which is also owned by the applicant. Smith describes the process of the waiver of platting per Mound code as a simplified version of a subdivision that involves lots that have been tax combined. There were lot combination/division and boundary adjustment activities involving the property and adjacent Lot 4 which is also owned by the applicant. The applicant seeks to reestablish original lot lines, as per the original platting of Shadywood and separate Lot 1 from the current parcel. The purpose is to split the vacant lot off so it is its own parcel. The property is zoned R 1-A (single family lot). For the purposes of waiver of platting, a lot needs 50 feet of frontage at the street, 50 feet of frontage at the minimum front setback from the street which is 20 feet, 50 feet of frontage at the ordinary high water mark and a 50 foot lake shore setback. Evaluation of the survey submitted by the owner's surveyor, the proposed subdivision, both the current lot and the proposed new lot, would be conforming to those regulations. -292- Planning Commission Minutes - Draft 2 February 4, 2020 Smith discussed the need for a variance. One of the discussion points is how Sunrise Landing is described in the plat. According to the code, there are different setbacks depending on right of ways, streets of different widths and if those are improved or unimproved. The plat of Shadywood Point designates the area as Sunrise Landing not a street or road. Staff's commented that it views the area similar to a park and its determination is that the required setback on the north side is 6 feet as Sunrise Landing is not a street. The proposed house being planned is for a single family, 2 -story home with an attached garage, accessed from Shorewood Lane on the west side and a walk -out on the lake side. Smith noted that the Johnson's (current land owners) plan to reside in the home to be constructed on Lot 1. The structure, as proposed, is consistent with the setbacks that would apply for the lot. The proposed home is also conforming for the proposed waiver of platting. Smith added that this case consists of the land use portion of the application. Other activities may come forth in the event the waiver moves forward and as more detailed plans and survey information, is received, in terms of existing and proposed grading, will be required as part of building permit processing. The items that staff looks for is a conforming building pad, conforming hard cover, that structures are meeting required setbacks and other applicable code requirements; also agency permits. It's normal and customary that a new single family home will require review by the watershed district for their applied site rules on such things as shoreline alteration, flood plain, wetland, erosion control, storm water, shore line and streams, etc. Most new home construction projects will require, at a minimum, an erosion control permit from the MCWD Smith outlined the process for a waiver. If there are no variances, a waiver can be acted upon by the City Council without Planning Commission review. However, the Council may remand any application back to the Planning Commission. Because of the submitted variance and determination of the north side setback that was done, Staff thought the Commission's review prior to Council consideration would be beneficial. Smith discussed how the proposal is evaluated related to the City's comprehensive plan. The area is guided "low-density' and the new comprehensive plan is 1-6 dwelling units per acre. The addition of one new lot in this area is conforming to the comprehensive plan. Lot of record setbacks are allowed for a lot of record. The new lot and the remnant lot are conforming and will remain conforming. Adjacent land uses are residential with the exception the landing which is public. Flood plain in Mound for FEMA is 931. Structures need to be 2 feet above that the 100 -year elevation. The watershed district elevation is higher by 6 inches and is 931.5. Under their rules you cannot grade, alter or fill at or below the 931.5. For Mound the lowest floor has to be not less than 933. If there are filling activities at or below the 931.5, the watershed will require permitting and fill compensation. With this plan there will be some filling activity. Hennepin County GIS and the wetland map in the comprehensive plan did shown wetlands on the property. Smith explained the process for fees and collection of fees. In regards to lots that are split off as a waiver, when those activities are recorded the new structures trigger standard fees, including a park dedication fee, trunk water, trunk sewer, sewer and water connection charges, in -293- Planning Commission Minutes - Draft February 4, 2020 addition to MCES SAC charges. Trunk and park fees would be collected with the resolution while the other fees would be collected as part of a future building permit. The applicant confirmed the property has no liens or mortgages. It has not been determined if there are sewer and water stubs to the property. If they are not there, they will need to be constructed in coordination with Public Works and the Engineering Department or escrow will need to be submitted. Smith reiterates that this discussion deals solely with the subdivision of the property. The approval of this waiver of platting does not guarantee approval of any future building permits. That would be a completely different phase of the process that would require the submittal of very detailed design plans. Smith says that Staff's recommendation for approval of the waiver of platting is based on several facts of findings. The lots created with the waiver are consistent with the comp plan guidance of low density residential. The lots involved in the waiver and the adjacent properties, owned by the applicant, are original platted lots, the new buildable lot being split is an original platted configuration. The new buildable lot, known as Parcel 1 has access on to an improved public street. The lot arrangement can accommodate construction of a new single family home. The waiver of platting does not alter the essential character of the neighborhood or have an adverse impact on the property. Smith says the applicant is in attendance. She also notes that the while City is not required to notify adjacent owners, Staff does this as a courtesy so neighbors are aware of applications and have the opportunity to learn about a project and ask questions of Staff or an applicant. Pelka asks if anyone has questions for Smith. Baker asks for clarification that in a normal subdivision you lose lot of record, what is the definition of waiver of platting? Smith replies that with a waiver of platting you are working with lots that have been combined for tax purposes or other reason involving original lots. For the subject parcel, there lot combinations/divisions and a small boundary adjustment at one point and the lot being split (Lot 1) is using original lot lines. Historically, there have been properties that have been combined by owners or previous owners including tax purposes. Baker recalls a previous conversation regarding tax combining lots and wonders why a waiver is needed. Smith replies that the 3 lots are combined with 1 PID and requires a waiver to split Lot 1 from the current parcel. Saystrom asks for clarification about the Planning Cases 20-04 (the waiver of platting) and 20- 05 (the variance). He wonders if staff is seeking recommendations that the 6 -foot setback assignment to Sunrise Landing. Smith replies that it is staff's determination and suggests the Planning Commission establish that as part of their action. -294- Planning Commission Minutes - Draft 4 February 4, 2020 Saystrom asks if there are curbs at the landing. Smith replies no. Saystrom asks if the hard cover calculations include a permeable driveway. Smith says the applicant could have up to 40% hard cover with lot of record, subject to conditions. If they use a pervious driveway in a product that is commercially designed, installed and engineered, if approved, the applicant could get up to maximum reduction not exceeding 85%. Saystrom asks if a reduction 85% is correct. Smith replies up to 85%, meaning on an 85% allowable reduction, 15% of the drive way would count. Heal asks what the applicant will do with his driveway, wondering if he will move it to the right because it goes right across the property. Pelka asks what the applicant and asks if anyone has questions for Smith. Hearing none, Pelka asks the applicant to step forward with any discussion and will open up for questions. Applicant Johnson begins by saying he has owned lots 1, 2, 3 and 4, currently residing on Lot 4. Johnson says his family has owned the properties since the 70s. Pelka asks the applicant to state his name and address for the record. The applicant states he is Dan Johnson, residing at 1766 Shorewood Lane. He continues, saying he has owned his current home since 1983 but it has been in his family since the 70s. He stated the Anderson family homesteaded Lots 1 and 2 and Lot 3 came with his house. Previously, there was a cabin sitting on the land, with no footings. That structure burned down. When his family purchased the property they split off Lot 3 and the Anderson's bought that and combined Lots 1 and 2. The Andersons had a summer cabin that sat on Lot 2 which was torn down when Anderson's mother passed and he built a home on Lots 2 and 3. Lot 1 has never had a structure built on it. Johnson acquired the property in 2006 when the owner passed away. A family member lived in the home on Lots 2 and 3, the Johnsons remained in the home on Lot 4 and he now seeks to build a new residence on Lot 1 by restoring the original lot lines. He explains the history behind the lot adjustment that the original house on Lot 4 infringed over the lot line of Lot 3 and so the lot lines were adjusted to make the home conforming to the 6 foot setback. Johnson says the plan is to build a new home on Lot 1 and he will reside in the new home. Johnson addresses the earlier question regarding the driveway that will be right across the property. Johnson says the driveway will come off the road and he won't use it for his boats but will be storage area. Johnson says the driveway comes right off the landing and members of the public block the access or think they can park there. Johnson says they originally thought they would need to use pavers for the driveway, but survey revealed they had more surface area than expected and the current design the property would be slightly under the 40% so pavers won't be needed to remain in compliance. Johnson says the current house on Lots 2 and 3 has a basement at the elevation of 934 and states the low grade on the new home will be at the 934 elevation, as well. -295- Planning Commission Minutes - Draft February 4, 2020 Pelka asks if there are any additional questions for the applicant. Hearing none, he asks if anyone else would like to take the podium with questions or comments. Resident Pat Baker, residing at 1753 Shorewood Lane, which is directly across the street from the proposed project. She says when the previous owner built the house on Lots 2 and 3, he tried to fill in the low spot on Lot 1. She says that someone from the City told him he could not do that and made him drudge the dirt back out of there because it was a wetland. She would like to know why that changed or how that could change. She also states that there is no curb there but that there is a gutter that runs with drainage to the lake. Heal asks Ms. Baker if the proposed new home will block her view, if approved. She confirmed her view will be affected but that she would still have a view. Saystrom asks Smith who the authority would be for elevation maps and surveys. Smith responded that she believes that Mr. Saystrom may be asking about wetland evaluation. The presence of a wetland is based on soils and hydrology and that there are different classifications. Smith reiterated that there is some historical data that talked about the potential of a wetland somewhere in the vicinity, however, there was no wetland delineation in the file. There was also information about flood plain alteration but no permitting in the file. Smith adds this area did not show up on the City's wetlands map in the comprehensive plan. Additionally, wetlands were not depicted on the Hennepin County Natural Resources mapping system. Smith commented that the watershed was forwarded a copy of the proposal and they did not have any comments on the presence of a wetland. Smith says if there are suspected wetlands, the City and the watershed can require delineation. She continues that when you get down to those lower numbers, the soils can get soft, that doesn't indicate wetlands, but it could be due to poor soil. If it is suspected that there may be a wetland, the city can require verification that there is no wetlands present. Applicant Johnson states he researched with the watershed prior to beginning this project and they told him there were no wetlands. Ciatti asks Johnson if it were determined he needed a variance for the side lot, would he need to go back to the drawing board. Johnson believes based on the city's review of the landing that the variance is not required. Smith says that because it is platted as a landing and not a street a 6 -foot setback is correct and appropriate. Ciatti asks Smith about a wetland delineation, if the waiver of platting goes through would additional testing be done to look at the soils. Smith says that the City can order a soils study be completed if they have any question. Smith suggests that the applicant might want to finalize that by having the watershed and the City can look at it but the season is not appropriate for that type of investigation. Smith said the Commission could consider adding that as a condition of the recommendation. -296- Planning Commission Minutes - Draft 6 February 4, 2020 Pugh asks the owner if he is sure he wants to build the house at the 6 foot setback based on her witness of speeding traffic on the lake. Johnson responds that because there is no trailer parking on the road, the majority of the traffic is neighbors landing their boats in the spring and fall so historically he has not noticed much traffic even on weekends. It was discussed that from the paved edge of the landing, to the lot line is about 20 feet and the house would sit past that. Castellano mentions the driveway scenario may actually improve with the presence of a home. Johnson confirms this is his belief as well. Pelka calls for any additional questions from the commission or the audience prior to commissioners beginning discussions. Hearing none, Pelka begins discussions. He believes the question surrounding if there is or is not wetlands on the property would be for the applicant to figure out as part of the new home building application. Ciatti agrees and believes it would be appropriate for the commission to recommend a wetland investigation due to the elevation and because the applicant discussed soil issues on one of the other lots to check for similar soil conditions. Castellano agrees that there are could be any number of reasons why the previous owner was required to remove the fill he added and the absence of a permit could have been the reason. In his opinion if the lot is buildable he believes it's in the best interest of everyone to move forward. Smith is recognized and adds that she believes it would be beneficial to reaffirm the setback determination. MOTION by Castellano to recommend to approve PC #20-04, waiver of platting with staff recommendations 1-22 and findings of fact 1-6 with a recommendation to have a soil and wetland evaluation on the property; seconded by Baker. MOTION carried unanimously. MOTION by Baker to recommend that no variance is needed for PC #20-05 due to the fact that, what is platted as Sunrise Landing is not a street, therefore the side setbacks should be 6 feet as a standard lot of record; seconded by Saystrom. ME Variance City Code Section 129-39 (a) states that a variance may be granted to provide relief to a landowner where the application of the City Code imposes practical difficulty for the property owner. In evaluating the variance, the City Council must consider whether: (1) The variance proposed meets the criteria for Practical Difficulties as defined in City Code Sub. 129-2. (2) Granting of the variance requested will not confer on the applicant any special privilege that is denied by this chapter to owners of other lands, structures or buildings in the same district nor be materially detrimental to property within the same zone. (3) The variance requested is the minimum variance which would alleviate the practical difficulty. (4) A variance shall only be permitted when it is in harmony with the general purposes and intent of the zoning ordinance and when the terms of the variance are consistent with the comprehensive plan. According to City Code Sec. 129-2, 'Practical Difficulties" is defined as follows: Practical Difficulties, as used in conjunction with a variance, means that: (i) The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance; (ii) The plight of the landowner is due to circumstance unique to the property including unusual lot size or shape, topography or other circumstances not created by the landowner; and (iii) The variance, if granted, will not alter the essential character of the locality. Economic considerations alone do not constitute practical difficulties. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. Review Process Timelines. Minnesota statutes require approval or denial of subdivision and land use requests within 60 -days unless an extension is granted by the applicant for the subdivision and the City executes an extension for the land use application as provided by MS 15.99. The applications were submitted on January 7, 2020. Minnesota Statutes 645.15 sets forth the procedures for determining "Day 1" for the purpose of application of the required timeline for action on the waiver and variance applications and was determined to be January 8, 2020. -299- Notification. Abutting property owners per Hennepin County tax records, were sent written notice on January 30, 2020 to inform them of the waiver of platting and variance requests and that the applications were included on the February 4, 2020, Planning Commission meeting agenda for review. SITE INFORMATION The 21,000 square foot lakeshore property is located on the east side of Shorewood Lane and abuts Sunset Landing on its north side which functions as a lake access point to Lake Minnetonka. There is a driveway access for the neighboring property in Sunset Landing. The submitted survey shows the existing and proposed lot configuration for the property at 1754 Shorewood Lane. Historical information from the applicant is that cabins were previously located on both Lot 2 and Lot 3. The existing single family house, which was constructed in 1995, is currently and will continue to be conforming to setbacks and hardcover. The applicant is requesting a waiver of platting to split off Lot 1 from the current parcel holding, which is generally described as Lots 1-3, Block 3, Shadywood, with a slight exception of the south line that involves Lot 4. Based on file research, there were previous waiver actions involving the subject property that took place in the early 80's which generally can be described as boundary adjustment and lot combination/lot rearrangement activities. Staff's determination is that these historical actions do not disqualify the property from a waiver request. ISSUES ANALYSIS Comprehensive Plan. The 2040 Comprehensive Plan guides this area for Low Density Residential, which allows for single-family detached and attached housing types within the density range of 1 to 6 dwelling units/acre. Density is computed area wide as opposed to an individual site. The addition of one home in this neighborhood would meet the comprehensive plan designation. Zoning. The waiver of platting application meets the lot area, width/frontage and depth requirements based on survey information. -300- Adjacent Land Uses. The subject property is surrounded on the south side by residential use and public property on the north side. Residential uses are also located on the west side of Shorewood Lane. Floodplain. Per code, all new structures must meet or exceed the Regulatory Flood Protection Elevation or be three feet above the ordinary high water mark of a wetland, as applicable. This will be a condition of approval for the waiver and future building permit. The 100 -year FEMA Floodplain for Lake Minnetonka is 931.0 and the RFPE is 933.0. the MCWD's 100 -year floodplain elevation is 931.5 and requires permitting for any work at or below this elevation and requires compensation for filling activities. Wetland. Figure 2.4 of the 2040 Comprehensive Plan does not show wetlands on the property subject property. In the event property conditions indicate the possible presence of wetlands, a wetland boundary determination would be required. Wetlands are subject to MCWD regulations and required permitting to include buffering and compensation. Park Land Dedication. Sec. 121-121 of the City Code includes regulations regarding park land and or park dedication in the form of a cash payment for new lots being created. INFRASTRUCTURE Storm Water - Stormwater permitting is under the jurisdiction of the Minnehaha Creek Watershed District (MCWD) following regulatory authority turn back to the District by the Mound City Council which took place in August, 2011. Metropolitan Council Environmental Services (MCES) Sewer Area Charge (SAC). The 2016 MCES fee for a SAC unit is $2,485.00. The MCES charge would be collected at the time of building permit issuance. City Water/ Sewer and Water Trunk Area Charge/Sewer and Water Connection Charges Trunk Fees. The 2020 trunk water fee is $2,000.00 per lot and the 2020 trunk sewer charge is $2,000.00 per lot. Payment of trunk water and trunk sewer charges for one additional lot will be collected prior to release of the resolution. Connection Charges. The 2020 sewer connection fee is $240.00 per lot and the 2020 water connection fee is $240.00 for one additional lot. These fees will be collected at the time of building permit issuance and shall be the amounts in effect at that time. -301 - STAFF/CONSULTANT/AGENCY REVIEW Copies of the applications and supporting materials were forwarded to City departments, the City's consultants and involved public agencies for review and comment. Members are advised that some comments received during review have been addressed and, are therefore, not included in this report. See comment received which is summarized below: Erin Manlick, Minnehaha Creek Watershed District (MCWD) MCWD has no comments on the proposed subdivision other than that a proposed structure on Lot 1 will likely require an erosion control permit. DISCUSSION / INFORMATION 1. A survey of the subject property prepared by Sathre-Bergquist was submitted for the waiver application (revision date January 20, 2020). 2. Waiver applications do not require Planning Commission review according to the City Code, unless a variance is required. As previously mentioned, Staff's evaluation is that the assigned setback on the north side is 6 -feet as Sunset Landing per original plat is not a street/road/avenue. Therefore, a variance is not needed. The waiver is being referred to the Planning Commission as it is Staff's opinion that Planning Commission review of the waiver will be beneficial prior to consideration by the City Council. Staff will provide additional comment regarding the north setback at the meeting. 3. The proposed waiver application does not involve any construction activities. However, future construction of a new single-family home is anticipated by the applicant. Preliminary plans submitted show a 2 -story walkout with lakeside deck and attached garage. The applicant/owner intends to live in the proposed new home. 4. According to Hennepin County property tax records, the subject property is considered to be one parcel. The proposal will split Lot 1 from the subject parcel. 5. As the property includes one structure, municipal sewer and water trunk area charge, connection fees, and park dedication fees are required to be paid for the additional lot being split off prior to the release of the resolution; also the required MCES SAC and connection charges applicable at the time the building permit is issued. 6. The MCWD is the regulatory and permitting authority for Rule B (Erosion Control), Rule C (Floodplain Control), Rule D (Wetland Protection) and Rule N (Stormwater Management); also shoreline alteration. -302- 7. It has not been determined if there are water and sewer service presently available to proposed Parcel 1. If not, all involved work, to include required permitting, will be required and accepted by the Public Works Department prior to resolution release. Alternately, a contractor's estimate for the subject work and financial security in the amount of 125 percent, will be required to be submitted and is subject to review and acceptance by the Public Works Superintendent. 8. Approval of the proposed waiver of platting does not constitute or guarantee future approval of any building permit(s) or any other necessary approval by any other public agency. 9. If applicable, lienholder or bank consent will be required prior to future release of the resolution following the City Council's action on the waiver application. 10. Drainage and utility easements for the subject lots will be required if the waiver of platting is approved and requires execution by the owners of record; also any bank or lien holders. The easements need to be provided in a form to allow for recording at Hennepin County. The location and size of the easements shall be determined by the City Manager -Director of Public Works (or designee). 11. According to Figure 5.3 in the 2040 Comprehensive Plan, Sunrise Landing is classified as Type D Commons (Wetlands, wildlife areas, beaches, boat landings and transient docks. No leased dock sites). 12. Applicant is advised that there are historic indian burial mounds and/or earthwork sites in and around the City of Mound. While many of the mounds have been severely impacted by development over the years, the mounds do, however, receive protection under state law; and penalties are imposed for unauthorized disturbance of mounds. The City maintains some general information about possible sites in an inventory of the "Earthwork/Mound/Burial Areas" and in surveys of the burial sites from Hill and Lewis in 1911 but the completeness or accuracy of this information is unknown. Additional information may be obtained through the Minnesota State Archaeologist. -303- STAFF RECOMMENDATION Staff recommends Planning Commission recommend approval of the waiver of platting subject to the following conditions: 1. New driveways must be hard surfaced in accordance with City Code regulations. Minimum driveway width is 10 feet; maximum width is 24 feet. Minimum side setbacks of one (1) foot are required for driveways. 2. Drainage shall not be directed to neighboring properties. 3. Any curb, gutter and streets which are disturbed because of construction, including, but not limited to, installation of the water service, sewer service and small utilities, shall be the responsibility of the permit holder. 4. As part of the City's approval of the waiver, the dedication of public drainage and utility easements, to be determined by the Public Works Director, or designee, will be required and shall be submitted in a form to allow for recording at Hennepin County, and shall be subject to review and acceptance by the City, prior to recording. The standard drainage and utility easement is five feet wide on side and rear lot lines and ten feet in width along the front lot line but shall be as determined by the City Engineer or Public Works Director. Easement(s) shall be provided in an appropriate form so as to allow for recording at Hennepin County and shall be subject to review and approval by the City prior to recording and require signatures from property owners and lienholders of record. 5. Applicant shall be responsible for procurement of any and/or all public agency permits including the submittal of all required information prior to building permit issuance. 6. Applicant shall be responsible for payment of all costs associated with the land use request. 7. No future approval of any development plans and/or building permits is included as part of this action in the event the waiver application is approved. 8. The applicant shall be responsible for recording the resolution with Hennepin County. The applicant is advised that the resolution will not be released for recording until all conditions have been met and all fees for the waiver application have been paid and the escrow account is in good standing. The submittal of additional escrow may be required. -304- 9. No building permit will be issued until evidence of recording of the resolution at Hennepin County is provided. 10. No grading or alteration is permitted or authorized below the 931.5 which is the 100 - year floodplain elevation for the MCWD unless permitting has been received. 11. All new construction shall take place at or above the Regulatory Flood Protection Elevation or 3 feet above a wetland. The RFPE for Lake Minnetonka is 933.0. 12. No materials shall be stockpiled in the 50 -foot lakeshore setback or 100 -year floodplain area(s). Any work in public right of way or on public property requires permission and coordination with the Public Works Department. 13. Grading and drainage plans for the future new home will be subject to review and approval by the Public Works Director at the time of building permit application. 14. Sewer and water area trunk charges in the amount of $2000.00 each for one (1) lot shall be paid prior to the release of the resolution. Total: $4000.00. 15. A park dedication fee in the amount of $1,100.00 shall be paid prior to the release of the resolution. 16. Sewer connection and water connection fees for one lot shall be paid at the time of the building permit release. The amount due shall be the current rate in place at the time of building permit issuance. The 2020 sewer connection and water connection fees are $240.00 each. 17. One MCES Sewer Availability Charge (SAC) will be collected with the future building permit. The amount due shall be the current rate the time of future building permit release. The 2020 MCES SAC rate is $2495.00 18. Future home construction on the new lot (Parcel 1) shall conform in all regards to City Code requirements and City approvals. 19. As applicable, if the subdivision requires the construction of municipal utility improvements (i.e., services, etc.), these activities must be constructed and installed prior to the release of the resolution or applicant shall be responsible for the submittal of a contractor's estimate, which shall be subject to review and acceptance by the Public Works Director (or designee) and submittal of a cash escrow in the amount of 125 percent of the contractor's estimate. -305- 20. The applicant shall provide legal descriptions in electronic form (MS Word preferred) for the drainage/utility easement document(s) to be prepared. 21. Applicant is responsible for all costs for the waiver request 22. Additional comments and/or conditions from the City Council, Staff, consultants, and public agencies. Staff recommends Planning Commission recommend approval of the waiver of platting based on the following findings of fact: 1. The lots created with the waiver are consistent with the Comprehensive Plan guiding of Low Density Residential. 2. The lots involved in the waiver and adjacent property owned by the applicant are original platted lots. The new buildable lot being split is an original platted configuration. 3. The new buildable lot on Lot 1 (Parcel 1) meets the lot size, lot width, and lot depth for a R -1A District lakeshore lot of record. The proposed lot arrangement can accommodate the construction of new single- family home on Lot 1. 6. The waiver of platting will not alter the essential character of the neighborhood or have an adverse impact on adjoining property. I own lots 1, 2, 3, and lot 4. There are currently two houses on lots 2, 3, & 4 (One house on lots 2 & 3, and one house on lot 4). My family has owned lot 4 since the early 70's, and I have owned lots 1,2, & 3 since 2005. I currently reside in the house on lot 4 and have family living in the house on lot 2 & 3. I am aware of the progression of buildings and splits since the lots were purchased and developed. Lot 1 that we are dealing with here has never been built on. I wish to split lot 1 off under a Waiver of Platting to its original platting. This lot is unique from most properties on the lake in Mound in that it butts up to a city owned piece of land called "Sunrise Landing." The city property was originally designated as a fire lane. However, once the city installed water and sewer there was no longer a need for the fire lane, and most if not all fire lanes in Mound were converted to commons. All of these parcels are left too with natural vegetation. This parcel was used as a commons until mid 1990s when the city decided to turn the parcel into a full- fledged boat landing. In doing so, the city paved the parcel down into the lake. I am told that because there is a road I need a setback of 10 feet on the side butting up to the property. I have done some investigating and found that city of Mound did NOT get approval from the MN DNR to make this a legal landing. This was confirmed by city managers I talked with. Therefore, there should have never been a paved road installed down into the lake. The DNR controls all landings and what can go in and out of the lake, and right now the DNR does not have this parcel registered as a legal landing. Given this fact, my property should be granted a variance that would allow regular set backs for a lake property under Waiver of Platting which is 6 feet on each side. The RFQ/I was sent to over 50 companies involved in the luxury home market and was intended to seek developer interest in a residential development on 2.35 acres in the Mound Harbor District. The results of a Phase II Environmental Study were made available on January 8"' and responses/proposals were due on January 20. While staff remained engaged with multiple interested developers throughout the response period of the RFQ/I, the City received one proposal by the due date. Feedback Staff received thereafter indicates the desired medium density appears to be financially infeasible without City willingness to financially participate in the soils correction. Consistent with that feedback; the submitted proposal is for a 55 -unit, cooperative living, luxury residential development that would be independently financed, pay $800K for the 2.35 acres, and create $16.2M in additional market value. The Development Committee formally reviewed this proposal on February 4a'. The Committee identified several concerns with the proposed project, including overall height, architectural style, and proposed rights of way, that they considered disqualifying unless the developer was willing and able to entertain alternatives. These concerns were conveyed to the respondent. The respondent has indicated they are very interested in reshaping their proposal to address the expressed concerns. Staff requests the City Council discuss how to proceed with the process and next steps. It would seem appropriate to avoid overly -critiquing the current proposal in light of the respondent's desire to present alternatives. It should be noted that while site plan, appearance, and the horizontal features of the proposal are likely to change with any alternatives; the housing product type and high density/intensity of use on the site are likely to remain as proposed based on the economics of the underlying site conditions and improvements needed. A discussion on what level of density should be allowed when weighing it against the original goals and objectives outlined in the original RFQ/I (attached) seems appropriate. -335- EXCERPTS: REQUEST FOR QUALIFICATION AND INTEREST IN A RESIDENTIAL DEVELOPMENT IN THE MOUND HARBOR DISTRICT MOUND, MN Project Goals 1. BOARD OF APPEALS Planning Case No. 20-01 Public Hearing — Proposed Redevelopment of Commerce Place Shopping Center 2200-2238 Commerce Blvd. Applicant: Schafer Richardson -340- Planning Commission Minutes January 7, 2020 Trapp introduced the Concept Plan Review for the proposed redevelopment of Commerce Place Shopping Center. It is a 3.2 Acre site with 7 parcels. The project includes the removal of the current shopping center. The bank currently located in the vicinity is not owned by the applicant and is not included in this concept plan. The bank will remain in place, as is. Trapp stated that the applicant, Schafer Richard is proposing a 3 -story 101 -unit market rate apartment building. The intent is to get feedback from the Planning Commission and the public prior to investing the time and money to prepare the preliminary plat, engineering drawings and such. While there is no specific action sought, members were invited to ask questions and provide their feedback. Trapp noted that the applicant held a neighborhood meeting in mid-December and the concept sketch plan has been on the city's website and interested parties were invited to attend tonight's meeting. Trapp outlined that the concept brought forward in January of 2019 differs from the new concept in that originally the proposal included keeping part of the complex and with this concept the shopping center will be removed in its entirety with a new structure being built in its place. The 2030 Comprehensive Plan guides this area as destination district. Uses identified for the Destination District includes retail, office and service oriented businesses, as well as medium and high density residential. Thus, the proposed project matches what was in the 2030 Comprehensive Plan. The project is a 3 -story, 101 unit building which includes 5 different types of units, ranging from studios to 2 -bedroom units. The majority of units are 1 -bedroom units. Trapp noted that sizes and preliminary rent estimates have been provided by the applicant. The existing accesses to the bank will not change. Two of the access behind the building will be removed. The removal of these accesses does not conflict with the applicant's agreement with the bank. Staff continues to work with the applicant to clarify existing parking needs and proposed parking for the site. Given the interrelationship between the bank and the proposed apartment building, parking will need to be considered as a shared requirement. The applicant is proposing a peaked roof with a mid -point of 47 feet, which is within the 50 foot height maximum of the Destination District. Trapp noted that Hennepin County appreciated the removal of the east side alley access. Hennepin County Staff noted that they have interest in continued discussion about site access and circulation if anything should happen with the bank. Trapp noted that MCES has no comments. Minnehaha Creek comments were to proceed with erosion and storm water management as per usual. -341 - Planning Commission Minutes 3 January 7, 2020 Comments from Staff included that Fern Lane will be vacated. Parking setback and screening requirements will need to be followed. Landscaping will need to be part of future discussions. Pedestrian access from the rear will need to be addressed. Staff also recommends the applicant speak to building official and fire chief regarding compliance. Heal asked about crosswalk and boat parking. Trapp stated that there should be no boat slips included in the proposal and parking and trailers should not be allowed in the parking spaces. It was further noted that requirements regarding outdoor storage can be a part of project conditions. Saystrom asked what variance. Staff noted that as this is concept plan sufficient details have not been provided to date for a full evaluation. Saystrom asked if the property would be subject to the nuisance regulations discussed in the past. Specifically, exterior storage. Trapp says that is for single family residential properties. We could look at if those requirements need to be adjusted as part of this project. The applicant would be required to manage the parking to ensure the residents stay in compliance. Smith says that could be included in the development agreement as a way for the city to manage expectations. Saystrom asked if anyone has notified the school system about the project. Smith noted that the school is not an agency on the required notification list but confirmed that it is something that could be done as part of the process. Trapp added that given the number of studios, alcoves and 1 -bedroom units it unlikely that this will cause a large increase in school-age children. Baker clarified the extent of the Fern Lane vacation. Trapp confirmed it is just the southern part of the road. Pelka asked what guarantees we can expect that the final project will look the same as the drawings. He also wondered about whether traffic congestion has been considered. Trapp noted that both City and County Staff have looked at the concept and didn't have concerns. She explains that the intended use of the shopping center, if it were functioning as designed, would generate much higher traffic rates than city has become accustomed to seeing. Pugh notes that she believes the higher volume may be more of an issue. She believes additional traffic studies should be conducted. Staff confirmed that a traffic study is required as a part of this project. Castellano asked if there is rear access to the building. Trapp said there likely is but because of the views of the concept plan sketches provided it currently is not shown clearly. -342- Planning Commission Minutes January 7, 2020 Representatives from Schafer Richardson, Maureen Michalski and Trevor Martinez, were invited to speak with the Planning Commission. Ms. Michalski explained that boat storage will explicitly not be allowed in the parking areas. She further explained that the balconies will not be for additional storage. This will not be allowed. In reference to the earlier question regarding schools, she explained that based on their research for a property of this configuration, possibly 8% of the units in this proposed project would have school age children. Saystrom asked if her number is based on information specific to Mound or if it's averaged across all properties. Ms. Michalski confirmed it is market data from all of their properties, however she noted that a similar project in Edina mimicked what she had provided. Ms. Michalski confirmed that a parking and traffic study will be part of future submittals. She also reiterated that the existing commercial use typically generates larger volumes of traffic than this proposed project. Pugh inquired about notification of the neighborhood meeting and how were they notified. Mr. Martinez said they used the Hennepin County notification tool to send notice to property owners within 500 feet of the proposed project. Pugh commented that the notification distance was not far-reaching enough to include the entire neighborhood. She also noted that the 7 -day notice combined with holding the neighborhood meeting during the holidays may have prevented some people from attending. Pugh asked what benefit Mound will receive if this project moves forward. Mr. Martinez replied that the economic development will benefit the city. He stated the project will bring in a new demographic of people who aren't able to find a unit like this currently in Mound. Additionally, the tax benefits are projected to be $300,000 to $325,000 per year. Ms. Michalski added that the parcel, as it is, has proven to not be a viable use. She believes this project will bring back vibrancy to the downtown that is lacking due to the commercial space sitting empty. Baker asked about a previous concept plan that was mixed-use, including residential and commercial. Ms. Michalski replied that the decision was made that the previous plan would have created a 4 -story structure and the feedback from the community was that was too tall. Baker asked if the 3 -story residential structure was needed for the project to be viable. She replied that new commercial space, which would be at a higher price point, doesn't make sense since the current commercial space was not performing. The rents would be so high that it would discourage new commercial tenants. Baker asked if the applicant considered the architecture matching the surrounding commercial uses like Walgreens and Carbone's. Ms. Michalski replied that they were trying to mirror the design of the nearby townhomes, with the residential architecture and color scheme. Ciatti stated he has showed the plan to several other residents and he had many positive responses. -343- Planning Commission Minutes January 7, 2020 Castellano asked if the project would be viable as a 2 -story property. Ms. Michalski confirmed that their experience is that a project needs to have about 100 units in order to offset the construction cost. Pugh asked for information on storm drainage and what kinds of materials will be used. She wanted to know what assurances will be provided that the run off isn't going into the lake. She also wanted to know how this project will "look like Mound" rather than every other new apartment going up in the surrounding communities. Ms. Michalski noted the project is still in the preliminary stages of planning and if Pugh or any of the residents have suggestions for color or landscape choices, they are open to suggestions and will take those into consideration during final planning. Pugh says she believes the city should make the county aware of the project. Smith says the county was shown the concept sketch and is aware. The county is will be notified throughout the process and the city will review any concerns brought forth from the county. Pelka suggested a police officer be posted at the corner during busy traffic hours could help resolve traffic congestion. Pugh says there is an officer at the newly painted crosswalk and she believes that is a great addition. Baker asked if the developer has had any negotiation with Wells Fargo to incorporate their site into this project. Ms. Michalski replied that discussions with Wells Fargo Real Estate department have taken place in the past. The discussions concluded that at this time Wells Fargo is not interested in making any changes involving this asset. Smith confirmed that the city has reached out to Wells Fargo and her conversation echoed the reply by Ms. Michalski that they are not looking at a change at this location. Goode requested further information on the trash management at the site. Ms. Michalski said the trash will be stored down in the parking structure. Each floor of the apartment would have a trash chute to collect garbage and recycling. Then a small vehicle will pull the trailer out of the basement on trash collection days. Saystrom asked if this project would conform to the allowable units per acre. Ms. Michalski responded that the number of units per acre is aligned with the 2040 Comprehensive Plan. Trapp says the density requirements would be verified and has been a part of the discussion of this project all along. Pugh asked about amenities that may be included in this project. Mr. Martinez replied that this is still in the planning phases and all of the amenities have not be decided upon yet. Some of the possibilities are a community room, fitness area, pet grooming stations, interior bike parking, pet park, grilling/patio areas, yoga studio, and gaming room. Ms. Michalski says this is an area of development that is constantly evolving and they will work with their property management to decide which amenities will be best suited for a property in this location. Ciatti -344- Planning Commission Minutes January 7, 2020 requested clarification on bike parking, Ms. Michalski stated they provide spaces for that on- site to discourage residents from storing bikes on balconies, which would not be allowed. Goode asked if there are any other questions for the applicant or staff. Goode confirmed that there are no members of the public who wish to speak Planning Case No. 20-02 Review and Recommendation of Proposed Ordinance Amending City Code Chapter 129 (Zoning) Smith presented information regarding our on-going efforts to evaluate code regulations to improve enforcement and improve neighborhood appearance especially related to parking and exterior storage which is on the 2019 project list. Staff is looking to include language in the code to allow for enforcement options and to provide for quicker resolution to issues. Staff has also been working to address projects that have stalled or that have significant building code violations and where the owner is not making any progress or responding to requests for updates. In these cases, Staff can bring the matter to the council and invite the property owner or their representative to the council meeting to give them a chance to provide evidence if there is something that is preventing them from addressing the matter. As part of our efforts are looking at regulations that allow for enhancement of other tools. This is a portion of a larger project, working in cooperation with the City Attorney and the Police Department that will cross reference the zoning ordinance, the nuisance ordinance and Chapter 46. This change would allow that certain violations could be issued a citation. The city is also looking at a possible future amendment to look at parking on soft surfaces. Smith noted that the Planning Commission previously offered a slate of proposed changes to the code and/or procedures in July 2019 to help provide for better neighborhood appearance by reducing the number of storage units on vacant lots and prohibiting storage on vacant lots. The proposed ordinance amending the zoning ordinance that is being reviewed by the Planning Commission would prohibit exterior storage on vacant, undeveloped, residential property. For clarification, if a vacant residential lot exists and there is no adjacent developed lot owned by the same owner, the property owner would not be allowed to store anything on that lot. Current code allows for 1 unit for 3,000 square feet. It was recommended by the Planning Commission and supported by the Council that the current code language be revised and that parking of exterior storage on an undeveloped residential lot no longer be allowed. The Planning Commission discussed previously that this will help reduce the intensity of what is viewed and exposed in neighborhoods, specifically what is viewed from the road and adjacent properties. Along with exterior storage units, the Planning Commission previously discussed that the same regulation would be applied to ice shelter structures. -345- Planning Commission Minutes January 7, 2020 Smith mentioned that the detached trailer parking previously discussed by the Planning Commission will be included in a part of the City Code amendment but is not a zoning matter. Smith noted that City Staff is discussing an amendment, in cooperation with the police department to prohibit detached trailer parking or including an overnight restriction for ease of enforcement. The expectation is that if you have a detached trailer it is there for short term purposes and it will be moved shortly. Saystrom asked if a swing set or play structure would be considered a unit. Smith replies that those items would fall under a different category. Baker asked for clarification, recalling the Planning Commission previously recommendation regarding reducing the number of exterior storage units on developed properties. Smith replied the proposed change was not directed by the City Council. Baker also recalled that previous Planning Commission recommendations were that any vehicle needed current licensing and Castellano recalled during the same conversation that the vehicle needed to be operational. Smith replied that are enforcement issues related to vehicle licensing requirements and the exterior storage code that regulates the number of units. Baker also recalled from a previous discussion that storage would not be allowed on abutting properties even if both properties are owned by the same owner. Smith replied the expectation would be that the properties be tax combined then the property becomes a developed and subject to square footage allowance. Heal asked how would violations be enforced. Smith replies that Mound is a complaint based community. Thus, when a complaint comes in it would be referred to the appropriate entity depending on the complaint ( i.e. police department, field officer, building official, etc.) The responding party would attempt to resolve the complaint informally to be quickly followed up by a formal procedure, creating a paper trail related to the complaint. Heal asked what would be the consequence for a property owner who ignores the informal and formal procedures. Smith commented that there are remedies for code violations in the City Code. MOTION by Baker to recommend City Council adopt the proposed amendments to City Code, Chapter 129-314, as amended, with additional language that the regulations would not apply if a vacant lot that abuts a developed residential lot is combined at Hennepin County; seconded by Castellano.
